Can I get Washington ESD unemployment if I got severance pay from my job?
My company laid me off last week and gave me 8 weeks of severance pay. I'm wondering if I can still file for unemployment benefits with Washington ESD while receiving this severance? The HR person wasn't really clear about how it affects my eligibility. Has anyone dealt with this situation before? I don't want to mess up my claim by filing incorrectly.

Yes, you can still file for unemployment even with severance pay, but Washington ESD will likely reduce your weekly benefit amount. The severance is considered income and they'll calculate how much to deduct from your UI benefits each week.

•So I should still file right away even though I'm getting severance? I don't want to wait too long and miss out on benefits later.

•Definitely file as soon as possible. Your benefit year starts when you file, not when the severance runs out. Just make sure to report the severance income on your weekly claims.

i got severance too and filed right away but washington esd is taking forever to process my claim... been 3 weeks and still in adjudication

•The adjudication process can take time, especially when there's severance involved. They need to verify the details of your separation and how the severance affects your benefits.

If you're having trouble reaching Washington ESD by phone, I actually found a service called Claimyr that helped me get through to speak with an agent. They handle the calling and waiting for you - saved me hours of frustration. There's a demo video at https://youtu.be/7DieNd3C7zQ that shows how it works, and the website is claimyr.com. Might be worth checking out if you need to talk to someone about your severance situation.

•Never heard of that before - is it legit? Seems weird to have someone else call for you.

•Yeah I was skeptical at first too, but it worked. They don't need your personal info or anything sketchy - just helps you get connected to an actual Washington ESD representative.

For severance specifically, Washington ESD will prorate it over the period it's supposed to cover. So if you got 8 weeks of severance, they'll divide that amount by 8 and deduct that weekly amount from your UI benefits. You'll still get something, just reduced.

•That makes sense. So if my severance covers my full salary for 8 weeks, I probably won't get much in UI benefits during that time?

The Boss
•Exactly. But once the severance period ends, you'll get your full UI benefit amount assuming you're still unemployed and meet all other requirements.

•wait i thought severance didn't affect unemployment at all? my friend said it doesn't count as wages

•Your friend might be thinking of federal taxes or a different state. In Washington, severance is definitely considered income that reduces your UI benefits.

The whole system is so confusing!! Why can't Washington ESD just make this stuff clearer on their website? I'm dealing with the same thing and nobody seems to give straight answers.

•I agree their website could be more user-friendly. The information is there but it's buried in policy manuals that are hard to understand.

Make sure you report the severance correctly on your weekly claims. I made the mistake of not reporting mine properly at first and had to deal with an overpayment notice later. Not fun.

•Oh no, what happened? How did you fix the overpayment issue?

•Had to appeal it and provide documentation from my employer about the severance terms. Took months to resolve but they eventually waived the overpayment.

•This is exactly why I used Claimyr to talk to someone at Washington ESD about my severance situation upfront. Better to get it right the first time than deal with overpayment headaches later.

I'm in a similar boat - got 6 weeks severance and filed for UI right away. My first weekly claim got paid but at a reduced amount like everyone said. At least I'm getting something while I job search.

•That's encouraging to hear! How long did it take for your claim to get approved?

•About 10 days, but I think that was pretty fast. No complications with my separation so the adjudication went smoothly.

Pro tip: keep all your severance paperwork from your employer. Washington ESD might ask for it during the adjudication process to verify the amount and terms.

•Good point. I also took screenshots of everything in case I need to reference it later.

•Thanks for the reminder! I have the separation letter but should probably ask HR for more detailed documentation about the severance terms.

Anyone know if severance affects the job search requirements? Do I still need to log job contacts while receiving severance pay?

The Boss
•Yes, you still need to meet all the usual requirements including job search activities, even if your UI benefits are reduced due to severance.

•Ugh that seems like a lot of work for reduced benefits... but I guess it makes sense since you're still technically unemployed

The Washington ESD phone system is absolutely terrible. I've been trying to call for days about my severance question and keep getting disconnected after waiting on hold for hours.

•Same here! It's so frustrating. I finally gave up and just filed my weekly claims online and hoped for the best.

•That's why services like Claimyr exist - the phone system is broken and people need alternatives to actually reach someone. I watched their demo video and it actually looks pretty helpful for situations like this.

Just wanted to update - I filed my UI claim while receiving severance and it all worked out fine. The key was being honest about the severance amount on my weekly claims. Washington ESD adjusted my benefits accordingly and I didn't have any issues.

Does anyone know if a lump sum severance is treated differently than severance paid out over time? My company is giving me the option to choose.

The Boss
•For UI purposes, Washington ESD will prorate it the same way regardless of how you receive it. The choice might affect your taxes though, so you might want to consult a tax professional about that aspect.

•I took the lump sum and just had to report it spread over the weeks it was supposed to cover. Worked fine.
