Washington ESD unemployment after quitting job due to harassment - am I eligible?
I'm in a really tough spot and need advice. I quit my retail job two weeks ago because my manager was constantly making inappropriate comments and creating a hostile work environment. I documented everything and even talked to HR but nothing changed. Now I'm wondering if I can still file for Washington ESD unemployment benefits since I technically quit instead of being fired. Has anyone been through this situation? I'm worried they'll deny my claim because I wasn't laid off.

Yes, you can potentially qualify for UI benefits if you quit for "good cause." Harassment definitely falls under this category in Washington state. When you file your claim with Washington ESD, make sure to explain the situation thoroughly and provide any documentation you have. They'll investigate your case during the adjudication process.

•Thank you! I kept emails and wrote down dates of incidents. Should I submit these when I file my initial claim or wait for them to ask?

•Submit everything upfront. The more documentation you provide initially, the smoother your adjudication will go.

I went through something similar last year. Washington ESD approved my claim after I quit due to a toxic supervisor. The key is proving you had "good cause" - which harassment absolutely is. Make sure you mention any attempts you made to resolve the situation with HR or management.

•How long did the adjudication process take for your case? I'm worried about how long I'll be without income.

•Mine took about 3 weeks, but I've heard it can vary. Some people get approved faster, others take longer depending on how complex the case is.

If you're having trouble getting through to Washington ESD to check on your claim status or provide additional information, I recently discovered Claimyr (claimyr.com). They help people actually reach ESD agents by phone instead of getting stuck in the endless phone tree. There's a demo video at https://youtu.be/7DieNd3C7zQ that shows how it works. Might be worth checking out if you need to speak with someone about your harassment documentation.

•I've never heard of this service. Is it legitimate? I'm already stressed enough without worrying about scams.

•It's legit - they just help you get connected to actual ESD staff. I was skeptical too but it worked when I couldn't get through on my own.

•I used Claimyr last month when I was stuck in adjudication hell. Got through to an agent same day and was able to explain my situation properly. Worth it when you're dealing with something as serious as harassment claims.

The system is so messed up! They make it impossible to reach anyone and then act like we're trying to cheat the system when we actually need help. I hope your case goes better than mine did.

•What happened with your case? Now I'm getting more worried...

•Don't let one bad experience scare you. Every case is different and harassment claims are taken seriously by Washington ESD.

Make sure you understand the difference between voluntary quit and constructive discharge. If the harassment was severe enough that any reasonable person would have quit, it might be considered constructive discharge which is treated more like being fired. Document everything including how it affected your work performance and mental health.

•I hadn't heard of constructive discharge before. The harassment definitely made it impossible for me to do my job properly.

•That's exactly what constructive discharge is - when working conditions become so intolerable that quitting is the only reasonable option. Keep that terminology in mind when talking to ESD.

•Are you appealing the denial? I'm trying to prepare for all possibilities.

Also remember that you'll need to be actively searching for work and available for work while your claim is being processed. Don't let the harassment situation prevent you from meeting your job search requirements - Washington ESD still expects you to look for new employment.

•Good point. I should start applying places right away then, even while waiting for my claim to be approved.

•Yes definitely start job searching immediately. You need to log your job search activities in WorkSourceWA too.

One thing that helped my case was getting a statement from a coworker who witnessed some of the harassment. If you have any colleagues who saw what happened, see if they'd be willing to provide a written statement.

Evelyn Xu
•That's a great idea. There were definitely other employees who witnessed the inappropriate behavior.

•Just make sure they're comfortable doing it and understand it might be contacted by ESD during their investigation.

Whatever you do, be completely honest on your unemployment application. Don't try to hide the fact that you quit - explain the circumstances clearly. Washington ESD will find out anyway and lying on your application is way worse than quitting for good cause.

•Definitely planning to be upfront about everything. I have nothing to hide since the harassment was real and documented.

my friend had a similar situation and her claim got approved but it took like 6 weeks because they had to investigate everything. just be patient with the process

•6 weeks sounds tough but if it gets approved that's what matters. Did she have to do anything special during the investigation?

•they called her a few times to ask questions and also contacted her old employer. she just had to be available to answer their calls

If Washington ESD does contact your former employer as part of their investigation, that's normal. They'll want to hear both sides of the story. Having your documentation ready will help counter any claims from your employer that the harassment didn't happen.

•I'm actually a little worried about what my manager might tell them, but I guess that's why having documentation is so important.

Kayla Jacobson
•Exactly. Let the facts speak for themselves. If you documented everything properly, the truth will come out.

Just wanted to say I'm sorry you went through that harassment situation. It takes courage to leave a toxic work environment and you did the right thing prioritizing your wellbeing.

•Thank you, that means a lot. It was really hard to make the decision to quit but I couldn't take it anymore.

One more tip - when you file your weekly claims (assuming your initial claim gets approved), you'll probably see questions about why you left your last job. Be consistent with what you put on your initial application. Any discrepancies could cause problems.

Evelyn Xu
•Good to know. I'll make sure to keep track of exactly what I write on the initial application so I can be consistent.

How long were you at the job before the harassment started? And how long did you endure it before quitting? Sometimes Washington ESD looks at whether you gave the employer enough time to address the issue.

Evelyn Xu
•I was there for about 8 months total. The harassment started around month 4 and I dealt with it for about 3 months before finally going to HR. When nothing changed after that, I quit about a month later.

Oscar Murphy
•That timeline sounds reasonable - you gave them multiple chances to fix the problem. That should work in your favor.

THE WHOLE SYSTEM IS DESIGNED TO DENY CLAIMS! They'll probably make you jump through a million hoops just to prove what you already know happened. But don't give up if they initially deny you - appeal everything!

Dominic Green
•While the system can be frustrating, harassment cases with proper documentation do get approved regularly. Try to stay positive.

Evelyn Xu
•I'm trying to stay optimistic but also prepare for the possibility of having to appeal.

Make sure you file your claim as soon as possible. There can be delays in processing and you want to get in the queue ASAP. The sooner you file, the sooner you might start receiving benefits if approved.

•I was planning to file this weekend. Is there a best day of the week to file or does it not matter?
0 coins
Nora Bennett
•Doesn't really matter what day, but avoid Mondays if possible since that's when most people file and the system can be slower.

been following this thread and just wanted to mention that if you do end up needing to call Washington ESD during your case, that Claimyr service mentioned earlier really does work. i was skeptical at first but when you're dealing with harassment claims you need to be able to actually talk to someone

Evelyn Xu
•Thanks for the follow-up on that. If I run into issues getting through I'll definitely consider it.

Don't forget that even if your unemployment claim gets approved, you should still consider filing a complaint with the Washington State Human Rights Commission about the harassment. That's a separate process but important for protecting other employees.
0 coins
Evelyn Xu
•I hadn't thought about that but you're right. I don't want this to happen to someone else.
0 coins
Evan Kalinowski
•Exactly. The unemployment claim helps you financially but the Human Rights Commission complaint could prevent future harassment.

Quick question - did you get any kind of severance or final paycheck weirdness when you quit? Sometimes employers try to mess with your final pay when you quit for harassment reasons.
0 coins
Evelyn Xu
•They did try to withhold my last few days of pay claiming I didn't give proper notice, but I fought it and eventually got it. Could that affect my unemployment claim?
0 coins
Lauren Zeb
•Probably not, but it does show the employer was being vindictive which might actually support your harassment claim.

Final reminder - make sure you have all your personal documents organized before filing. You'll need your Social Security number, previous employer information, and details about your last day of work. Having everything ready will make the application process smoother.

•Good reminder. I'll gather everything this weekend before filing. Thanks to everyone who responded - this has been incredibly helpful!
