I quit my job can I apply for unemployment - Washington ESD eligibility question
So I finally quit my retail job last week after dealing with a horrible manager for months. The stress was affecting my health and I just couldn't take it anymore. Now I'm wondering if I can still file for unemployment benefits with Washington ESD? I know usually you have to be fired or laid off, but I've heard there might be exceptions. Has anyone successfully gotten UI benefits after quitting? What do I need to prove to Washington ESD?

You can potentially qualify if you quit for "good cause" but it's harder to prove than being laid off. Washington ESD will look at whether you had no reasonable alternative but to quit. Things like unsafe working conditions, harassment, or significant changes to your job duties might qualify.

•What counts as harassment exactly? My manager was constantly yelling at employees and making personal comments about our appearance.

•That could potentially qualify as creating a hostile work environment. You'd need to document incidents with dates and any witnesses if possible.

i quit my job too and got denied at first but then appealed and won. you have to really document everything though

•How long did the appeal process take? I'm worried about paying bills while waiting.

•took like 6 weeks total but i got backpay for the whole time once it was approved

The key is proving you quit for reasons that would cause a reasonable person to leave. Washington ESD considers things like: discrimination, unsafe conditions, harassment, significant reduction in hours/pay, or being asked to do something illegal. Just being unhappy with your boss usually isn't enough unless it rises to the level of creating an intolerable work environment.

•This is so confusing! I tried calling Washington ESD multiple times but can never get through to actually talk to someone about my specific situation.

•I had the same problem with getting through to Washington ESD. After weeks of trying to call, I found this service called Claimyr (claimyr.com) that actually got me connected to an agent. They have a demo video at https://youtu.be/7DieNd3C7zQ showing how it works. Saved me so much time and frustration!

•Really? That actually worked for you? I'm getting desperate here.

Don't get your hopes up. Washington ESD almost always denies voluntary quit cases initially. They assume you're just trying to game the system.

•That's discouraging but I guess I should still try? I really did have good reasons for leaving.

•Even if you get denied initially, you can appeal. Many people win on appeal if they have good documentation.

Make sure you file your claim right away even if you're not sure you qualify. There's a waiting period anyway and you don't want to lose potential benefit weeks.

•Good point. Should I mention that I quit when filing or just say I'm unemployed?

•Be honest about quitting. Lying on your application is fraud and will cause bigger problems later.

ugh the whole system is so broken. why should people have to prove they deserve help when they're already struggling

•I get the frustration but there have to be some rules otherwise everyone would just quit and collect benefits

•i guess but it feels like they make it impossible on purpose

Document EVERYTHING from your old job - emails, texts, witness statements, dates of incidents. I wish I had kept better records when I was dealing with my toxic workplace.

•I do have some text messages from coworkers complaining about the same manager. Would those help?

Jamal Anderson
•Absolutely! Anything showing a pattern of problematic behavior helps your case.

When you file, they'll ask for your reason for leaving. Be specific - don't just say 'bad manager' but explain exactly what happened that made continuing impossible.

•Should I mention the health issues the stress was causing?

GalacticGladiator
•Yes, if you have medical documentation showing work-related stress, that strengthens your case for good cause.

My sister quit her job for similar reasons and got approved but it took forever. She had to do a phone interview with Washington ESD and everything.

•What kind of questions do they ask in the phone interview?

Liam McGuire
•they wanted details about why she quit, what she tried to do to resolve the situation first, stuff like that

Update on the Claimyr thing - I used them again last week to check on my claim status and got through in like 10 minutes. Way better than the 2+ hour waits I was dealing with before.

•How much does it cost though?

Yuki Yamamoto
•It's worth it compared to the time I was wasting trying to get through on my own. The peace of mind alone was huge.

The important thing is showing you tried to resolve the issues before quitting. Did you talk to HR? Document any complaints you made?

Nia Thompson
•We didn't really have HR, it was a small store. I did complain to the district manager once but nothing changed.

•That actually helps your case - shows you tried to address the problem through proper channels first.

I'm dealing with something similar right now. My workplace became totally toxic after new management took over. Trying to decide if I should quit or stick it out.

•If you're considering quitting, start documenting everything now in case you need it for an unemployment claim later.

•Good advice, I'll start keeping a log of incidents.

honestly just apply and see what happens. worst case they say no and you appeal. you've got nothing to lose at this point

•True, I'm already unemployed either way. Might as well try.

Make sure you're still doing job searches even while your claim is being processed. Washington ESD requires you to look for work regardless of why you're unemployed.

•How many job applications do I need to do per week?

Mateo Rodriguez
•It varies but generally 3 job search activities per week. Check the WorkSourceWA website for current requirements.

The whole adjudication process for voluntary quit cases takes FOREVER. Be prepared to wait weeks or months for a decision.

•Ugh, that's what I was afraid of. I really need the income.

•That's another reason why I'm glad I found Claimyr - at least I can actually get updates on what's happening with my claim instead of wondering.

Don't let them intimidate you during the interview process. You have rights and if you truly quit for good cause, you deserve benefits.

•Thanks for the encouragement. I'm nervous about the whole process but I know I had valid reasons for leaving.

•You've got this! Just be honest and thorough in explaining your situation.

One more thing - if your employer contests your claim (which they probably will), don't panic. That's normal and doesn't mean you won't get approved.
0 coins
Nia Thompson
•Why would they contest it?

•Their unemployment insurance rates can go up if too many former employees get benefits, so they often fight claims automatically.

Nia Thompson
•That seems unfair but I guess it makes sense from their perspective.

Good luck OP! It's a frustrating process but don't give up. You might be surprised and get approved on the first try.

•Thanks everyone for all the advice! I'm going to file my claim today and start gathering my documentation.
