Washington ESD unemployment after getting fired - how does this work?
I just got terminated from my job last week and I'm confused about how unemployment benefits work when you get fired. My supervisor said it was due to performance issues but I feel like it was more about personality conflicts. Can I still file for Washington ESD unemployment? What happens during the application process? I've never dealt with this before and I'm really stressed about paying my bills.

You can definitely apply for unemployment even if you were fired. Washington ESD will review your case to determine if the termination was for 'misconduct' or not. Performance issues usually don't count as misconduct unless it was willful negligence. File your claim online at esd.wa.gov as soon as possible.

•Thanks! I was worried I couldn't even apply. How long does it usually take to hear back about whether I qualify?

•Usually 2-3 weeks for a decision, but it can take longer if they need to investigate. They'll contact both you and your former employer.

The key thing is whether Washington ESD considers it 'misconduct in connection with work.' Simple poor performance or not being a good fit usually doesn't qualify as misconduct. Things like theft, insubordination, or violating company policies would be misconduct.

•That makes me feel better. It really was just that my manager and I didn't click, and I was struggling with some of the new software they implemented.

•Yeah that sounds like performance issues not misconduct. You should be fine but be honest when they ask about the circumstances.

I got fired 3 months ago for attendance issues and still got approved for UI benefits. Washington ESD really looks at whether you were deliberately doing something wrong. Missing work due to transportation problems or childcare issues isn't usually considered misconduct.

•That's encouraging to hear. Did you have to do anything special during the application process?

•Just be completely truthful about what happened. They'll ask specific questions about the termination and may contact your employer too.

One thing to be prepared for - if your employer contests your claim, it might go to adjudication. That's when Washington ESD investigates further and it can take weeks to resolve. I had to wait almost a month for my decision.

•What happens during adjudication? Do I need to provide documentation or anything?

•They'll send you a fact-finding questionnaire and might schedule a phone interview. Keep any emails or documents related to your termination just in case.

•If you end up in adjudication and can't reach anyone at Washington ESD by phone, check out claimyr.com - they help people get through to ESD agents. There's a demo video at https://youtu.be/7DieNd3C7zQ that shows how it works.

ugh the whole system is so frustrating!! i got fired for being 10 minutes late too many times and they made me wait 6 weeks before approving my claim. meanwhile bills are piling up and nobody at ESD answers the phone

Lukas Fitzgerald
•6 weeks?! That's terrifying. I can't afford to wait that long for a decision.

Ev Luca
•That sounds unusual unless there were complicating factors. Most straightforward cases are decided within 2-3 weeks.

Make sure you apply within the first week after your termination. You can backdate your claim but it's easier if you file right away. Also, you'll need to do weekly claims and job searches once you're approved.

•How many jobs do I need to apply for each week? I heard it changed recently.

•It's 3 job search activities per week in Washington. This includes applications, networking events, job fairs, etc. Keep detailed records.

Document everything about your termination while it's fresh in your memory. Write down dates, who was present, what was said. If Washington ESD needs to investigate, having detailed records helps your case.

•Good point, I should write down everything that happened in that final meeting with HR.

•Exactly. Include any witnesses, what reasons they gave, and your response. Even if you don't need it, better to have it ready.

Been there! Got fired from my retail job for 'customer service issues' but really the manager just didn't like me. Washington ESD approved my claim after about 3 weeks. The employer didn't even contest it.

Lukas Fitzgerald
•That gives me hope. Did you have to do a phone interview with Washington ESD?

Misterclamation Skyblue
•No phone interview needed in my case. They just sent some paperwork to fill out and then approved it.

Remember that even if your initial claim gets denied, you can appeal the decision. You have 30 days to file an appeal and request a hearing. Don't give up if the first decision doesn't go your way.

•How does the appeal process work? Is it complicated?

•You'll get a hearing with an administrative law judge over the phone. You can present your side of the story and provide evidence. It's less formal than court but take it seriously.

If you need to reach Washington ESD and can't get through on the phone, I had success using Claimyr. It's a service that calls ESD for you and gets you connected to an agent. Saved me hours of calling.

•Is that expensive? I'm already worried about money.

•It was worth it for me to avoid the phone queue nightmare. Sometimes you just need to talk to someone at ESD to get things moving.

One more tip - when you file your weekly claims, be honest about any work you do or money you earn. Even small amounts need to be reported. Washington ESD can find out anyway and it's not worth risking an overpayment issue.

•Good to know. I might do some freelance work while looking for a full-time job.

Tate Jensen
•That's fine, just report it on your weekly claim. They'll reduce your benefit amount for that week but you won't lose eligibility entirely.

don't stress too much about it, most people who get fired for performance stuff get approved eventually. the system is designed to help people who lose their jobs through no fault of their own

•Thanks, I needed to hear that. This whole situation has me really anxious.

just make sure you keep calling if you don't hear anything after 3 weeks. squeaky wheel gets the grease with Washington ESD unfortunately

•I've heard their phone system is terrible. Any tips for getting through?

•Call right when they open at 8am or try the Claimyr service someone mentioned earlier. The regular phone lines are always busy.

Bottom line - being fired doesn't automatically disqualify you from unemployment. Washington ESD looks at the specific circumstances and reasons. Performance issues and personality conflicts usually don't count as misconduct.

same thing happened to my brother last year - fired for 'not meeting expectations' but got approved for benefits. washington esd was pretty reasonable about it

Lukas Fitzgerald
•That's exactly what they told me - not meeting expectations. Makes me feel better about my chances.

Quick reminder - make sure your contact information is up to date in your Washington ESD account. They need to be able to reach you for any interviews or additional information requests.

Last thing - if you do end up needing to call Washington ESD multiple times and getting frustrated with the phone system, definitely check out that Claimyr service. Made a huge difference in my experience getting help.

Good luck with your claim! Remember to file your weekly claims on time once you're approved and keep looking for work. The job search requirement is important to maintain eligibility.

•Yeah, I'm grateful we have this safety net. Now I just need to get approved and find a new job.

One final tip - if your claim gets approved, the first payment might take a week or two after your first weekly claim. Don't panic if it doesn't show up immediately.
