Washington ESD disqualified my unemployment benefits - options if I was disqualified?

Got a letter yesterday saying I was disqualified for unemployment benefits from Washington ESD. The notice mentions something about 'voluntary quit without good cause' but I left my job because my hours got cut to less than 10 per week and I couldn't afford to keep working there. Is there anything I can do if I was disqualified? The letter talks about appeals but I don't really understand the process. Has anyone successfully challenged a disqualification decision?

You absolutely can appeal that disqualification! Washington ESD has to prove their case, and reduced hours can qualify as good cause for leaving. You have 30 days from the notice date to file an appeal. The form should be included with your disqualification letter.

Thank you! I see the appeal form but it's pretty confusing. Do I need to include documentation about my hours being cut?

0 coins

Yes, gather any texts, emails, or schedules showing your hours were reduced. Pay stubs comparing before and after hours are especially helpful.

same thing happened to my brother last year, Washington ESD initially said he quit voluntarily but he appealed and won because he could prove constructive dismissal

0 coins

What's constructive dismissal? Is that different from just quitting?

0 coins

Constructive dismissal is when working conditions become so unreasonable that a reasonable person would quit. Drastically cutting hours can qualify as this.

I've been trying to reach Washington ESD for weeks about my own disqualification but their phone lines are impossible. Has anyone found a way to actually talk to someone there? I keep getting disconnected after waiting 2+ hours.

I found this service called Claimyr (claimyr.com) that helps you get through to Washington ESD agents. They have a video demo at https://youtu.be/7DieNd3C7zQ showing how it works. Saved me hours of calling.

0 coins

Is that legit? I'm desperate enough to try anything at this point.

0 coins

Yeah it's real, they basically handle the waiting and calling back when an agent is available. Way better than sitting on hold all day.

The Washington ESD system is SO frustrating!! They make it seem like every quit is voluntary even when you have legitimate reasons. I got disqualified initially too but kept appealing and eventually won.

0 coins

How many levels of appeals did you have to go through? This is so stressful.

0 coins

I had to go to a hearing with an administrative law judge. It was scary but the judge actually listened to my evidence, unlike the initial reviewer.

For your specific situation with reduced hours, Washington ESD recognizes 'constructive discharge' when hours are reduced by more than 25% or to less than 20 hours per week for a full-time employee. Document everything about your original schedule vs. the reduced schedule.

0 coins

I was working 35-40 hours before and they cut me to 8-10 hours. That's definitely more than 25% reduction!

0 coins

wow that's a huge cut, no wonder you had to quit. that's not sustainable at all

0 coins

Make sure you keep filing your weekly claims even while appealing the disqualification. If you win the appeal, you'll get backpay for all those weeks, but only if you kept claiming.

0 coins

Really? I thought I couldn't file claims if I was disqualified.

0 coins

Nope, you should keep filing. The system will show $0 payments but it preserves your claim weeks for backpay if you win.

0 coins

This is correct advice. Always continue filing weekly claims during an appeal process.

0 coins

the hardest part about appeals is getting all your documentation together. i had to get written statements from coworkers about the schedule changes

0 coins

Did you need a lawyer for the hearing?

0 coins

no but i watched some youtube videos about unemployment hearings to prepare. some people do get lawyers though

0 coins

I'm confused about something - if you quit because of reduced hours, why didn't you just stay part-time and file for partial unemployment benefits? Wouldn't that have been easier than quitting completely?

0 coins

I didn't know that was an option! Can you get partial benefits if you're still working some hours?

0 coins

Yes, Washington state allows partial unemployment if your hours are significantly reduced. But at 8-10 hours per week, quitting might have been the better choice anyway.

0 coins

Update - I tried that Claimyr thing and actually got through to a Washington ESD agent in less than an hour! They helped me understand my disqualification better. Definitely recommend it if you're stuck in phone hell.

0 coins

How much did it cost?

0 coins

It's worth it compared to wasting entire days trying to call. The peace of mind alone is valuable.

0 coins

Washington ESD disqualifications are often overturned on appeal if you have good documentation. The initial reviewers seem to automatically deny anything that looks like a voluntary quit without really examining the circumstances.

0 coins

That's encouraging to hear. I was starting to think I had no chance.

0 coins

dont give up! the system is designed to discourage people but you have legitimate reasons

0 coins

For the appeal hearing, practice explaining your situation clearly and concisely. Judges want to hear facts, not emotions. Stick to: what your original hours were, when they were reduced, why the reduction made continued employment impossible.

0 coins

Should I mention that I looked for other jobs before quitting?

0 coins

Absolutely! Showing you tried to find alternative employment before quitting strengthens your case for good cause.

0 coins

I hate how Washington ESD makes you feel like a criminal for needing help. The whole system assumes you're trying to cheat them.

0 coins

So true! They act like unemployment benefits are charity instead of insurance we all paid into.

0 coins

The disqualification letter definitely made me feel that way. Like I did something wrong by leaving a job that wasn't sustainable.

0 coins

Make copies of everything you submit for your appeal. Washington ESD has been known to lose paperwork, and you'll want backup documentation if you need to escalate further.

0 coins

Good point, I'll make sure to keep copies of everything.

0 coins

also send everything certified mail so you have proof they received it

0 coins

The 30-day appeal deadline is firm, so don't wait. I've seen people lose their chance to appeal because they missed the deadline by even one day.

0 coins

I'm definitely not waiting. Filing the appeal tomorrow morning.

0 coins

smart move, time is not on your side with these appeals

0 coins

If your first appeal gets denied, you can appeal again to a higher level. Don't give up after the first review if you truly believe your case is valid.

0 coins

How many levels of appeals are there?

0 coins

Three levels: initial determination, administrative law judge hearing, then Board of Appeals review. Most cases get resolved at the ALJ level.

0 coins

Good luck with your appeal! Reduced hours that make employment unsustainable is definitely grounds for good cause. You've got a strong case.

0 coins

Thank you for all the encouragement everyone! Feeling much more confident about appealing now.

0 coins

keep us updated on how it goes!

0 coins

I went through something similar and won my appeal. The key was showing that reasonable person would have quit under those circumstances. Your hour reduction sounds even more extreme than mine was.

0 coins

That's exactly what I'm hoping to prove. A 75% hour reduction isn't sustainable for anyone.

0 coins

definitely not, especially with gas and commute costs making those few hours barely worthwhile

0 coins

One more tip - if you have any medical conditions or family obligations that made the reduced schedule particularly problematic, mention those in your appeal. It adds to the 'good cause' argument.

0 coins

I do have a child in daycare, and the reduced hours actually made it harder to afford childcare while working so little.

0 coins

Perfect example! That's definitely relevant to include in your appeal documentation.
