Washington ESD disqualified me - why was I disqualified for unemployment?
Got a letter today saying I'm disqualified from unemployment benefits and I have no idea why. The letter just says 'disqualified due to separation from employment' but doesn't explain what that means. I was laid off from my job at a warehouse after they said they were downsizing. I thought layoffs automatically qualified you for benefits? I've been filing my weekly claims for 3 weeks and now they're saying I owe them money back. Can someone help me understand what's going on?

There are several reasons Washington ESD might disqualify someone. Did you quit, get fired for misconduct, or refuse suitable work? Even if you think you were laid off, if your employer reported it differently to Washington ESD that could cause issues.

•I definitely didn't quit and I wasn't fired for misconduct. They said it was a layoff but maybe they reported something different to Washington ESD?

•That's exactly what might have happened. Your employer's report to Washington ESD determines your eligibility, not what they told you.

This happened to me too!! I got disqualified and had to appeal. Turned out my old boss lied and said I quit when I was actually laid off. You need to appeal this ASAP - you only have like 30 days.

•How do I appeal? The letter doesn't really explain the process clearly.

•You can appeal online through your SecureAccess Washington account or mail in the appeal form. But honestly, calling Washington ESD to talk to someone is way better if you can get through.

•Good luck getting through to Washington ESD by phone though. I've been trying for weeks and can never get past the busy signal.

I was in a similar situation last month and couldn't reach anyone at Washington ESD after dozens of calls. Found this service called Claimyr (claimyr.com) that actually got me through to a real person at Washington ESD within a day. There's a video demo at https://youtu.be/7DieNd3C7zQ that shows how it works. Might be worth checking out if you need to talk to someone about your disqualification.

•Is that legit? Sounds too good to be true honestly.

•I was skeptical too but it actually worked. They handle all the calling and waiting for you and connect you when an agent is available.

•I'll look into that if I can't get through myself. Thanks for the suggestion.

The Washington ESD system is SO confusing. Half the time they don't even explain why they make decisions. You definitely need to appeal though - don't just accept the disqualification.

•Agreed, the whole system is a mess. But appeals do work if you have a good case.

•How long does the appeal process usually take?

Appeals can take 4-8 weeks depending on how backed up they are. The important thing is to keep filing your weekly claims even while the appeal is pending. If you win the appeal, you'll get paid for those weeks retroactively.

Mikayla Brown
•Wait, I should keep filing even though I'm disqualified? That seems weird.

Sean Matthews
•Yes, absolutely keep filing. If you don't file weekly claims during the appeal period, you can't get paid for those weeks even if you win.

•This is correct - always keep filing during appeals. I learned this the hard way.

Also make sure to gather any documentation you have about your layoff - emails, notices, anything that proves it wasn't voluntary separation. You'll need evidence for your appeal hearing.

•I don't have much documentation unfortunately. Just a text from my supervisor saying my position was eliminated.

•That text message could actually be really helpful! Screenshot it and save it as evidence.

The whole Washington ESD phone system is ridiculous. I've been calling for 3 weeks straight and either get a busy signal or get disconnected after waiting on hold for hours.

•Try calling right when they open at 8am. That's usually the best time to get through.

•I've tried that too. Still can't get through most days.

•That's exactly why I ended up using Claimyr. Saved me so much time and frustration.

Was there any severance involved in your layoff? Sometimes that can affect your eligibility timing even for legitimate layoffs.

Mikayla Brown
•No severance, just my final paycheck. Does that matter?

Harper Collins
•No severance is actually better for unemployment timing. One less complication to worry about.

ugh the same thing happened to my brother last year. His employer claimed he was fired for attendance issues but he was actually laid off due to COVID cutbacks. Had to fight it for months.

•Did he end up winning his appeal?

Kelsey Hawkins
•Yeah eventually but it took forever and was super stressful. The employer finally admitted they made an error in their reporting.

Make sure you understand exactly what type of separation your employer reported. Was it 'quit without good cause', 'discharged for misconduct', or something else? The reason determines your appeal strategy.

Mikayla Brown
•The letter just says 'separation from employment' but doesn't specify which type.

•You should be able to see more details in your online account or by calling Washington ESD. Definitely need to know the specific reason they're using.

This is why I hate dealing with government agencies. Everything is so complicated and they never explain anything clearly.

•Tell me about it. But you gotta fight for your benefits if you're entitled to them.

I work in HR and see this all the time. Sometimes there are honest mistakes in how separations get reported to Washington ESD. Your employer might not have meant to cause problems but reported the wrong separation code.

Mikayla Brown
•Is there a way to contact my old employer to ask them to correct their report?
0 coins
Edwards Hugo
•You can try, but they're not required to change it. That's why the appeal process exists - to sort out these disputes.

Don't forget that during your appeal hearing, your employer will have a chance to present their side too. Be prepared to explain exactly what happened from your perspective.

•Will it be like a court hearing? I'm nervous about that part.

Gianna Scott
•It's usually done by phone and is less formal than court. Just be honest and stick to the facts.

Whatever you do, don't miss any deadlines. Washington ESD is super strict about appeal timelines and won't accept late appeals except in very rare circumstances.
0 coins
Mikayla Brown
•When did you say the deadline was? 30 days from the letter date?
0 coins
Alfredo Lugo
•Yes, 30 days from the date on the disqualification letter. Don't wait until the last minute though.

I had success getting through to Washington ESD using that Claimyr service someone mentioned earlier. Took about 2 days but way better than the weeks I spent trying to call myself.

•How much does something like that cost?

Sydney Torres
•I'd rather not get into costs but it was worth it for me to actually talk to a real person about my claim issues.

Just want to add that even if your appeal is successful, it can take a while to actually receive the back payments. Be prepared for that delay too.

•Good to know. This whole process is taking way longer than I expected.

The most important thing is don't give up. I know people who have successfully appealed disqualifications that seemed hopeless at first. If you were truly laid off, you deserve those benefits.

Mikayla Brown
•Thank you, that's encouraging. I'm definitely going to file the appeal this week.
