Just won my ESD overpayment waiver - how long until I get my full benefits back?

Finally got that letter from ESD saying I don't have to repay the overpayment from my job separation back in November! They've been taking 50% of my weekly benefits for months while this was being decided. Now that I've won my case, does anyone know how long it'll take for ESD to process this and start giving me my FULL benefit amount again? And will they pay back the money they've been withholding? The letter doesn't explain any of this and I'm trying to budget for rent next month. Thanks for any help!

THEY ARE THE WORST!!! i won my appeal 4 months ago and they're STILL taking money from my benefits every week even tho i've called like 20 times!!! the system is completely broken and nobody there knows what they're doing. good luck getting your money back - you're gonna need it!

Have you tried contacting your state representative? That's what fixed it for me when ESD wouldn't stop taking money after my waiver was approved. Just Google your district and email them explaining the situation.

This happened to my cousin last month. ESD stopped taking the 50% after about 2 weeks, but she never got the back payments. Have you checked your overpayment balance in eServices to see if it shows zero now?

Just checked and it still shows the full overpayment amount. Guess they haven't processed the waiver in their system yet. Thanks for the tip about checking that!

I used Claimyr to get through to ESD when I was dealing with a similar situation. Saved me hours of redial frustration. You basically pay them to wait on hold for you and then they call you when an agent is on the line. Yes! The key was actually talking to a live agent who could submit the request for retroactive payment. They can't do that automatically through the system. Once I got through, they processed it and I got the money about 5 days later.

This is a tricky situation because there are actually two separate processes happening: 1) Updating your overpayment status to waived, and 2) Returning previously withheld funds. The first typically happens within 10-14 days. For the second, you MUST call and request it specifically - this is called a "recoupment refund request" and needs to be manually entered by an agent. Make sure to note the exact dates and amounts they withheld so you have all the information ready when you call. They should be able to see this in their system, but it helps to have your own documentation.

Quick update for you - I just helped someone last week with this exact situation. There's a specific form you should fill out called the "Request for Refund of Recouped Benefits" that you can find in your eServices account under "Upload a Document." This isn't well known, but it can start the process without having to call. Still, calling will speed things up considerably once you've submitted the form.
