How soon after being fired can you file for Washington ESD unemployment benefits?
Got terminated from my job yesterday and I'm wondering how quickly I can apply for unemployment benefits through Washington ESD. My manager said it was due to 'performance issues' but honestly I think they just wanted to cut costs. Should I wait a few days or can I file my claim right away? Also worried about whether being fired affects my eligibility - does Washington ESD approve claims when you're terminated vs laid off?

You can file immediately - there's no waiting period to submit your initial claim with Washington ESD. The sooner you file, the sooner your benefit year starts. Being fired doesn't automatically disqualify you, but they'll review the circumstances during adjudication.

•Thanks! Should I gather any documentation before filing or can I just start the application online?

•Have your employment dates, wages, and reason for separation ready. You can always upload documents later if Washington ESD requests them during the review process.

Filed the day after I got canned last month. Took about 3 weeks to get approved but they did approve it even though I was terminated. Make sure you're honest about the circumstances when you file.

•Did you have to do a phone interview or anything during those 3 weeks?

•Yeah, had to do a fact-finding interview about why I was fired. Just told the truth and it worked out.

Be prepared for your claim to go into adjudication if you were fired. Washington ESD has to determine if the termination was for 'misconduct' or not. Performance issues usually aren't considered misconduct but they still review it.

•This is exactly what happened to me - took forever to reach someone at Washington ESD to check on my adjudication status. If you need to talk to them, I found this service called Claimyr that helps you get through to actual agents. Way better than sitting on hold for hours.

•Never heard of that - is it legit? How does it work?

•Yeah it's real - claimyr.com. They basically call Washington ESD for you and get you connected to an agent. There's a video demo at https://youtu.be/7DieNd3C7zQ that shows how it works. Saved me so much frustration.

DONT WAIT!! File right away because your benefit year starts from when you file, not when you got fired. I made this mistake and lost a week of benefits.

•Good point - I'll file today then. Thanks for the heads up!

•Same thing happened to my brother. File immediately even if you're not sure about eligibility.

The key distinction Washington ESD looks at is whether you were fired for misconduct or not. Poor performance, personality conflicts, not being a good fit - these typically don't count as misconduct. Theft, violence, repeated violations of company policy after warnings - that's misconduct.

•What if they claim you violated company policy but you disagree with their interpretation?

•That's where the adjudication process comes in. Washington ESD will review all the evidence from both sides and make a determination. You'll get a chance to present your side of the story.

•And if they deny you initially, you can always appeal the decision. Don't give up after the first no.

•That's encouraging! Was your claim approved right away or is it still pending?

One thing to watch out for - if your employer contests your claim, it could delay the process significantly. They have 10 days to respond to Washington ESD about your separation. Sometimes they don't contest it at all.

Miguel Diaz
•How would I know if they contest it? Does Washington ESD notify you?

•Yes, you'll get a notice if there's any dispute. Your claim status will also show if it's under review or adjudication.

Been there! Got fired from my retail job for 'attitude problems' which was BS. Filed the next day and got approved after about 2 weeks. Don't let them intimidate you into thinking you can't get benefits.

•Retail managers are the worst about making stuff up when they fire people. Glad you got approved!

Emma Taylor
•Exactly! They tried to claim I was 'insubordinate' but Washington ESD saw right through it.

Make sure you keep records of everything - your termination letter, any emails about performance, etc. Washington ESD might ask for documentation during the adjudication process.

•Good advice. I have some emails that show they were setting me up to fail. Should I upload those right away?

Isabella Silva
•You can upload them proactively or wait until they ask. Either way works, just make sure you have them ready.

The Washington ESD website makes it seem like you can't get benefits if you're fired but that's not true. Lots of people who get terminated still qualify. Don't let that discourage you from filing.

•Yeah the website could be clearer about this. It's all about whether it was misconduct or not.

•Exactly. Poor performance ≠ misconduct in most cases.

I had a similar situation where I got canned for 'performance' but it was really about budget cuts. Took about a month to get through adjudication but I was approved. The hardest part was actually reaching Washington ESD when I had questions.

•Oh man, trying to call them is impossible. I used Claimyr to get through when I needed to check on my claim status. Totally worth it - got connected to an agent in like 10 minutes instead of waiting hours.

•It's a service that helps you get through to Washington ESD agents. Check out claimyr.com - they have a demo video that explains it better than I can.

File immediately and start doing your job searches right away too. Washington ESD requires 3 job searches per week and they can audit your job search log at any time.

•Do I need to start job searching before my claim is approved?

•Yes, from the week you file your claim. Keep detailed records in your job search log.

got fired for 'poor performance' 6 months ago, claim was approved no problem. they care more about gross misconduct than just not being good at your job. file asap

•This gives me hope. I was worried they'd automatically deny anyone who got fired.

•nah most people who get fired still qualify unless they did something really bad

The system is designed to help people who lose their jobs through no fault of their own, which includes most terminations for performance. Don't let your employer scare you into not filing - that's exactly what they want.

•So true. My boss actually told me I 'probably wouldn't qualify' when they fired me. Total BS.

•They say that hoping you won't file and cost them money on their unemployment insurance. File anyway!

One more tip - when you're filing your weekly claims, be completely honest about any work you do or money you earn. Even small amounts need to be reported. Washington ESD will find out eventually if you don't report it.

Miguel Diaz
•What if I do some freelance work while collecting? Do I need to report that too?
0 coins
Nia Thompson
•Yes, absolutely. Any income needs to be reported on your weekly claim. It might reduce your benefit amount but it won't disqualify you completely.
