How long does it take to get child support from Washington ESD unemployment benefits?

My ex-husband just started getting unemployment benefits and I'm wondering how long it usually takes for child support to start getting deducted from his Washington ESD payments? The court order was sent to them about 2 weeks ago but I haven't seen any payments yet. Does anyone know how this process works with unemployment benefits? I really need that support money.

From what I understand, Washington ESD has to process the income withholding order first, then it usually takes 1-2 pay periods before deductions start. Since unemployment is paid weekly, you're probably looking at 3-4 weeks total from when they received the court order.

The Division of Child Support (DCS) handles the withholding orders, not Washington ESD directly. They send the order to ESD who then implements it. You might want to call DCS to confirm they sent everything properly - sometimes there are delays on their end too.

Be prepared that unemployment child support deductions might be less than what you're used to. UI benefits are way lower than regular wages so even the maximum deduction won't be as much.

The whole system is so slow. My friend went through this last year and it took almost 6 weeks before she saw the first deduction. Then Washington ESD messed up the amount and she had to get DCS involved again to fix it.

One thing to keep in mind - if his unemployment claim is in adjudication or there are payment issues, the child support deduction won't happen until his benefits are actually flowing. So make sure his UI claim is approved and he's getting paid first.

Does anyone know if they take the child support before or after taxes? Like if he's getting $500/week, do they calculate the 50% before or after the tax withholding?

Child support is calculated on the gross amount before taxes. So if he's getting $500 gross, they'd take up to $250 for child support, then taxes come out of the remaining $250.

Make sure you keep records of everything - when you submitted the court order, any confirmation numbers, dates you called DCS, etc. If there are delays you'll need that documentation to show you did everything right on your end.

Also worth noting that if he stops getting unemployment, you'll need to update the child support enforcement again. The withholding order only applies to the current income source.

I think it was general income withholding. The court clerk said it would cover any income including unemployment.

That should be fine then. General orders are actually better because they cover all income sources automatically.
