Does Washington ESD take out child support from unemployment benefits automatically?
I'm about to file for unemployment and I have a child support order that takes money from my paychecks. Does Washington ESD automatically deduct child support from UI benefits, or do I need to set that up separately? I want to make sure I don't get behind on my payments while I'm looking for work. Has anyone dealt with this situation before?

Yes, Washington ESD will withhold child support from your unemployment benefits if there's a court order or income withholding order on file. The Division of Child Support (DCS) coordinates with ESD to make sure the deductions continue even when you're receiving UI benefits.

•That's a relief! Do you know if it happens automatically or if I need to contact someone to set it up?

•It should happen automatically if your employer was already withholding support. The system is supposed to track your SSN across different income sources.

I went through this last year when I got laid off. The child support kept getting deducted from my weekly claims without me having to do anything. But it took about 2-3 weeks after my first payment for the deductions to start showing up.

•Good to know there might be a delay. Did you have to make separate payments during those first few weeks?

•I called DCS to let them know about the job loss and they worked with me on the timing. Better to be proactive than let it go.

If you're having trouble getting through to DCS or Washington ESD about this, you might want to check out Claimyr at claimyr.com. They help people get connected to ESD agents when the phone lines are jammed. There's a demo video at https://youtu.be/7DieNd3C7zQ that shows how it works. Could be useful if you need to verify your child support withholding status.

•Thanks for the suggestion! I'll definitely look into that if I can't get through on my own.

•Never heard of Claimyr before but sounds like it could be helpful. The ESD phone lines are always busy.

Just to add - the amount they take out is based on your UI weekly benefit amount, not your old salary. So if your unemployment is less than what you were making, the child support deduction might be less too. But you should confirm this with DCS.

•That makes sense. I hadn't thought about how the percentage would work with a lower benefit amount.

•Yeah, it's usually a percentage of income so it should adjust automatically. But double check your court order to be sure.

Whatever you do, don't try to avoid the child support payments while on unemployment. The system will catch up with you and you'll end up owing back payments plus interest. Better to work with DCS from the start.

•Absolutely, I have no intention of trying to dodge my responsibilities. Just wanted to make sure everything would continue smoothly.

•Smart approach. Being upfront about changes in your employment status usually works in your favor.

I had issues with this when I first filed for UI. The withholding didn't start automatically and I ended up with a balance due. Turned out there was some kind of communication gap between agencies. Had to call both DCS and ESD to get it sorted out.

•That's exactly what I want to avoid. How long did it take to resolve once you got them talking to each other?

•About two weeks once I got the right people on the phone. The hard part was actually reaching someone who could help.

•This is exactly why I mentioned Claimyr earlier - situations like this where you need to actually talk to an ESD representative instead of just using the website.

Check your SecureAccess Washington account regularly to make sure the deductions are showing up correctly. Sometimes there are glitches and you want to catch them early.

•Good advice. I'll make sure to monitor my account closely once I start receiving benefits.

•Yes! I caught an error in my deductions by checking my account weekly. Saved me from a bigger headache later.

Does anyone know if back child support (arrears) also gets taken out of unemployment benefits? Or is it just the current monthly amount?

Eloise Kendrick
•Both can be withheld from UI benefits. If you owe back support, they'll typically take the current amount plus something toward the arrears.

•Yeah, they can take up to 50% of your unemployment for child support including back payments, but there are federal limits.

Make sure your address is updated with both DCS and Washington ESD. If they need to send you any notices about the withholding and can't reach you, it can cause delays or problems.

•Good point. I just moved recently so I'll double check that both agencies have my current address.

•Online account updates are usually faster than calling for address changes, just FYI.

I'm going through something similar right now. Filed for unemployment three weeks ago and still waiting for my first payment. Getting worried about falling behind on child support even though it's not my fault the claim is taking forever to process.

•That's tough. Have you been able to contact DCS to explain the situation?

•Tried calling but keep getting put on hold for hours. Might try that Claimyr service someone mentioned to get through to ESD first.

•Definitely worth trying Claimyr if you're stuck. Sometimes getting your UI claim moving is the first step to getting everything else back on track.

Pro tip: keep records of all your unemployment payments and any child support deductions. If there's ever a dispute about payments made or missed, you'll want documentation.

•That's smart. I'll make sure to download and save all my payment statements.

Quick question - does the child support withholding affect your weekly claim filing? Like do you need to report it as a deduction or anything?
0 coins
Eloise Kendrick
•No, you don't report the child support withholding when filing your weekly claims. That's handled automatically by the system.

JaylinCharles
•Good to know! One less thing to worry about when filing my weekly claims.

Thanks for posting this question! I'm in a similar situation and was wondering the same thing. Sounds like as long as everything is set up correctly, it should work automatically.

•Glad the thread was helpful! Seems like the key is just making sure both agencies are communicating properly.

•Yeah, and being proactive about staying in touch if anything seems off with the payments.

One more thing to consider - if your unemployment benefits are much lower than your regular income, you might be able to request a modification of your child support order. The amount should reflect your current financial situation.

•That's something I hadn't considered. How long does that process usually take?

•It varies by case, but you'd need to petition the court. Might be worth consulting with a family law attorney if unemployment drags on for several months.
