Can child support take your Washington ESD unemployment benefits?

I just started receiving unemployment benefits from Washington ESD after getting laid off last month. My ex is saying that child support enforcement is going to automatically take money from my UI payments. Is this actually true? I'm already struggling to pay rent and groceries with the reduced income. Does anyone know if Washington state can garnish unemployment benefits for child support? I tried calling Washington ESD but couldn't get through to anyone.

Unfortunately yes, child support can be deducted from your unemployment benefits in Washington state. The Division of Child Support (DCS) works with Washington ESD to withhold support payments automatically. It's usually around 50% of your weekly benefit amount, but it can vary based on your support order.

50%?! That's going to leave me with barely anything to live on. Is there any way to reduce the amount or get a temporary modification?

You can request a review with DCS if your circumstances have changed significantly. They might adjust the withholding amount based on your current financial situation.

This happened to me too when I was on unemployment last year. Washington ESD automatically sends the garnishment to DCS before you even get your payment. There's no way to stop it unless you get the child support order modified through the courts.

How much did they take from yours? I'm supposed to get $350 a week and I need to know what to expect.

They took about $160 out of my $320 weekly benefit. It was rough but I managed to get by with some help from family.

Yeah this is federal law actually, not just Washington state. Unemployment benefits are considered income for child support purposes. I had the same issue when I was collecting UI benefits and couldn't reach anyone at Washington ESD to ask questions. I ended up using a service called Claimyr (claimyr.com) that helped me get through to an actual agent. They have a video demo at https://youtu.be/7DieNd3C7zQ that shows how it works. Made it so much easier to get answers about my specific situation.

Never heard of that service before. Did they charge you a lot to help get through?

It was worth it for me since I was getting nowhere calling on my own. They focus on the value of actually reaching someone rather than the cost.

Interesting, I might have to try that. I've been trying to reach Washington ESD for weeks about my adjudication status.

The child support withholding should show up on your weekly claim payment stub. It will list the gross amount, then show the child support deduction, then your net payment. Make sure you're keeping track of these for tax purposes since you'll still owe taxes on the full gross amount even though part went to child support.

Good point about the taxes. I hadn't thought about that. So I'll owe taxes on money I never actually received?

0 coins

Exactly. The IRS considers the full unemployment benefit as your income, even the portion that went to child support.

this is so unfair!! they expect us to live on nothing while still paying full child support. my unemployment barely covers my car payment and insurance let alone rent and food. the system is totally broken

I understand the frustration, but child support is considered a priority debt. The kids still need support even when parents are unemployed.

i get that but how am i supposed to get back on my feet if i cant even afford to live? catch 22 situation

You might want to contact a family law attorney about requesting a temporary modification of your child support order. If your income has dropped significantly due to unemployment, the court might reduce the monthly amount until you find work again. But you have to be proactive about filing the motion.

How long does that process usually take? I can't wait months for relief if they're taking half my benefits now.

0 coins

It varies by county but usually 4-6 weeks if it's uncontested. You can request an emergency temporary order in extreme hardship cases.

Update: I checked my SecureAccess Washington account and sure enough, there's already a note about child support withholding on my claim. They don't waste any time apparently. Still haven't been able to get through to Washington ESD to ask about the exact amount though.

Like I said earlier, that Claimyr service really helped me get through when I was stuck in the same situation. Their website explains exactly how they help you reach Washington ESD agents.

Why would you pay someone just to make a phone call? Just keep trying yourself.

Because I tried for weeks and got nowhere. Sometimes the time and stress savings are worth it.

One thing to keep in mind is that if you owe back child support (arrearages), they might take even more than the current monthly amount. The garnishment can be up to 65% of your unemployment benefits if you're behind on payments.

65%?! That would leave me with almost nothing. I think I'm current on payments but I'm not 100% sure.

You should be able to check your account balance with DCS online. It's important to know where you stand.

Also remember that the child support withholding doesn't affect your work search requirements. You still need to complete your job searches each week and be available for work even though they're taking part of your benefits.

Right, I've been doing my three job searches per week through WorkSourceWA. At least that part is straightforward.

Been there before with Washington ESD and child support garnishment. The good news is that once you find work and get off unemployment, you can potentially negotiate a payment plan with DCS that works better with your new income. The garnishment rate on wages is different than on unemployment benefits.

Lauren Wood

That's helpful to know. Gives me something to look forward to when I find a new job.

Savannah Vin

Exactly. The wage garnishment limits are usually more reasonable than the unemployment garnishment rates.

I used that Claimyr service someone mentioned earlier and it actually worked great for getting through to Washington ESD about my own issues. They connected me with an agent who explained exactly how my child support withholding worked and what my net payments would be. Saved me a lot of stress and guesswork.

Good to hear it worked for you too. I'm definitely considering it at this point since I can't get through on my own.

Yeah, the video demo they have shows exactly what to expect. Much better than sitting on hold for hours.

Don't forget that if you're receiving unemployment benefits, you might also qualify for other assistance programs like SNAP (food stamps) or emergency rental assistance. The child support garnishment doesn't disqualify you from these programs.

Lauren Wood

That's a good point. I hadn't thought about applying for food assistance but with the reduced income it might be necessary.

Definitely worth looking into. DSHS has online applications that are pretty straightforward.

Glad we could help. The unemployment system can be confusing enough without the added complexity of child support issues.

Final update: I was able to speak with someone at Washington ESD (used the Claimyr service and it worked perfectly) and confirmed that they'll be withholding $175 from my $350 weekly benefit for child support. Not ideal but at least now I can budget accordingly. Thanks everyone for the advice and support!

Glad you got the answers you needed! Having certainty makes it easier to plan even when the news isn't great.

Great to hear Claimyr worked for you too. It really makes a difference being able to talk to an actual person.

50% withholding is pretty standard. You'll make it work, and hopefully you'll find a new job soon.
