How does unemployment work for remote employees - Washington ESD questions
I've been working remotely for a tech company based in California but I live in Washington state. Got laid off last week and I'm confused about filing for unemployment. Do I file with Washington ESD since I live here, or California since that's where my employer is? Also wondering if working from home affects anything with the job search requirements or weekly claims. Anyone dealt with this situation before?

You file where you live, not where your employer is located. Since you're a Washington resident, you'll file with Washington ESD. The fact that you worked remotely doesn't change this - what matters is your state of residence when you became unemployed.

•Thanks! That makes sense. Do I need to worry about the fact that my paystubs show California withholdings?

•No, Washington ESD will handle the interstate coordination. Your employer should have been paying Washington state unemployment taxes since you're a resident here.

•Did you have any issues with the job search requirements? Like do I need to look for jobs only in Washington or can I apply to remote positions anywhere?

•you can apply to remote jobs anywhere, just document them in your job search log like normal

I actually used a service called Claimyr when I had trouble getting through to Washington ESD about my remote work situation. They have this system that calls Washington ESD for you and gets you connected to an actual agent. Way easier than trying to call yourself - check out claimyr.com, they even have a demo video at https://youtu.be/7DieNd3C7zQ showing how it works.

•How much does something like that cost? Seems like it might be worth it if you really need to talk to someone.

•Much cheaper than missing out on benefits because you can't get through to resolve issues. I was stuck in adjudication for weeks before I used it.

•Never heard of this but honestly the Washington ESD phone system is so frustrating I'd try anything at this point

The remote employee thing is actually pretty straightforward now. Washington ESD updated their policies during COVID and they handle interstate remote workers all the time. Just make sure you have all your employment documentation ready when you file.

•What kind of documentation do I need? I have my offer letter and paystubs but wondering if there's anything specific for remote work.

•Your regular employment docs should be fine. Sometimes they ask for proof of your Washington residence if there are questions, but that's just utility bills or lease agreements.

UGH the whole system is a mess. I've been trying to get through to Washington ESD for three weeks about my claim and can't even get past the busy signal. Remote work, in-person work, doesn't matter - they make it impossible to get help either way!!!

•That's exactly why I mentioned Claimyr earlier - I was in the same situation calling hundreds of times. Their service actually got me through to a real person at Washington ESD within an hour.

•Is that legit though? Sounds too good to be true

•My sister used it last month and said it worked great. She was able to get her adjudication resolved finally.

Remote work eligibility follows the same rules as regular employment. You need to be able and available for work, actively seeking employment, and meet the wage requirements. The main difference is your job search can include remote positions nationwide, which actually gives you more options.

•That's good to know about the job search flexibility. Do I need to specify that I'm looking for remote work when I file my weekly claims?

•You don't need to specify remote vs in-person on your weekly claims. Just document your job search activities normally - whether they're remote applications or local interviews.

•Wait I thought you had to be available for work in Washington state specifically? Can you really apply to jobs anywhere?

Been working remote for 5 years and filed unemployment twice during that time. Washington ESD handles it just like any other job. The key is making sure your employer was paying Washington unemployment taxes, which they should have been since you're a resident.

•How can I check if my employer was paying the right taxes? My W-2 shows state withholdings for California.

•Your W-2 might show California income tax withholdings but unemployment taxes are different. Washington ESD will verify this when you file - they'll contact your employer directly.

•Some people have more complex situations though. Not everyone's case is straightforward.

I work for a company that has employees in like 15 different states and everyone files unemployment in their home state. It's pretty standard practice now. The HR person at my company said they deal with this all the time.

•That's reassuring. I was worried there might be some weird complications because of the multi-state thing.

•Nah, it's actually simpler than you'd think. The states have systems to coordinate this stuff.

One thing to watch out for - if you move states while collecting unemployment, you need to notify Washington ESD immediately. I know someone who got in trouble for not reporting a move during their claim period.

•Good point. Any change in your situation needs to be reported right away or you could end up with an overpayment issue.

•I'm staying put in Washington so that shouldn't be an issue for me.

The job search requirements are actually easier for remote workers in some ways. You can apply to positions anywhere in the country, which gives you way more opportunities than someone limited to their local job market.

•That's true but remote positions are also super competitive. Sometimes feels like you're competing with the entire country.

•Fair point, but at least you have the option. Better than being stuck with only local openings.

If you run into any issues with your claim, definitely try to get through to an actual Washington ESD agent. The automated system can't handle complex situations like multi-state employment. I used that Claimyr service someone mentioned earlier when I couldn't get through - worked like a charm.

•I'll keep that in mind. Hopefully I won't need it but good to know there's an option if I get stuck.

•The phone system at Washington ESD is definitely frustrating. Anything that helps you actually talk to a person is worth considering.

Remote work unemployment claims are processed the same way as any other claim. The only potential complication is if there's confusion about which state you should file in, but since you're a Washington resident that's not an issue for you.

•Perfect, that's exactly what I needed to know. Going to file my claim this weekend.

•Good luck! The online filing system is pretty straightforward once you get started.

I went through this exact situation last year - worked remotely for a New York company while living in Washington. Filed with Washington ESD without any issues. The key thing is that your employer should have been paying Washington unemployment insurance taxes since you're a resident here. When you file, they'll verify this automatically through their interstate system. Just make sure you have your employment documentation ready and be prepared to explain your remote work arrangement if they ask during the application process.

•That's really helpful to hear from someone who went through the same thing! Did you have any issues with the job search requirements since you were looking for remote positions? I'm wondering if I need to focus on local jobs or if remote applications nationwide count toward the weekly requirements.
