Remote worker confusion - where do remote employees file for unemployment in Washington?
I've been working remotely for a tech company based in California but I live in Washington state. Got laid off last week and I'm completely confused about where I'm supposed to file for unemployment. Do I file with Washington ESD since I live here, or do I need to file in California where my company is located? My paystubs show Washington state taxes were taken out but I'm not sure if that matters. Has anyone dealt with this situation before?

You file where you live and work, not where the company is headquartered. Since you live in Washington and worked from home here, you file with Washington ESD. The fact that Washington taxes were deducted from your pay confirms this.

•Thank you! That makes sense. Do I need any special documentation since it's a remote position?

•Just your regular employment documentation - W2s, pay stubs, separation notice. Washington ESD doesn't require anything special for remote work.

I had the exact same situation last year. Filed with Washington ESD and had no issues. The key is where you physically worked, not where the company is based.

•Good to know! How long did it take for your claim to get approved?

•About 2 weeks, but that was before all the call volume issues they're having now.

If you're having trouble getting through to Washington ESD to verify this, I recently discovered Claimyr.com - they help you get connected to actual ESD agents. There's a demo video at https://youtu.be/7DieNd3C7zQ that shows how it works. Saved me hours of calling.

•Interesting, I'll check that out. I tried calling Washington ESD yesterday and gave up after an hour on hold.

•How much does that service cost? Seems too good to be true.

•It's worth it when you consider the alternative is potentially days of failed calls. The value is in actually getting to talk to someone at ESD.

wait im confused... I thought you had to file in the state where your employer pays taxes? My company is in Oregon but I live in Washington and I've been stressing about this for weeks

•No, that's a common misconception. You file where you work, not where the company pays taxes. If you work from your Washington home, you file with Washington ESD.

•omg thank you!! I was about to file with Oregon and that would have been a mess

This is exactly why the unemployment system is so confusing. Remote work has made everything complicated and they haven't updated their guidance clearly enough.

•Agreed. I spent 3 hours on the Washington ESD website trying to find clear info about remote work situations.

•The rule is actually pretty straightforward - file where you physically worked. The problem is finding someone at ESD who can confirm this quickly.

I work for a company in Texas but live in Spokane. Filed with Washington ESD no problems. Just make sure your separation notice is clear about you being a Washington resident.

•Did you have to provide any proof of residency beyond your address?

Chloe Taylor
•Nope, just the standard info they ask for during the application process.

File in Washington since that's where you worked. But be prepared for potential delays if your employer doesn't respond quickly to ESD's verification requests.

•What kind of verification do they need from my employer?

Diego Flores
•Usually just confirmation of your employment dates, wages, and reason for separation. Out-of-state employers sometimes take longer to respond.

This whole remote work thing has created so many edge cases. I know someone who worked for a Washington company but lived in Idaho and had to file in Idaho.

•That's correct - it's always based on where you physically work, not where the company is located.

•Makes sense when you think about it. Your local state needs to track its employment statistics.

Pro tip: when you file your Washington ESD claim, make sure to clearly indicate in the employer information section that you worked remotely from Washington. It helps avoid confusion later.

•Great advice! I'll make sure to be extra clear about that.

•Yes! I didn't do this and had to clarify later which delayed my first payment.

The Washington ESD website actually has a section about this under 'Work Search Requirements' - it mentions remote work scenarios. Worth checking out.

Javier Gomez
•I'll look for that section, thanks!

•I couldn't find that section when I looked last month. Maybe they moved it?

Had a similar situation with a New York company. Filed with Washington ESD and everything went smoothly. The adjudication process was normal, took about 3 weeks.

•That's reassuring. I was worried there might be complications with an out-of-state employer.

•Nah, ESD deals with this all the time now. Remote work is pretty common.

Just a heads up - if you need to speak to someone at Washington ESD about this, the phone lines are absolutely slammed. I used Claimyr to get through last week and it was a game changer.

•Second person to mention that service. Might be worth trying if I run into issues.

CosmicCrusader
•What exactly does Claimyr do? Help you get through the phone system?

•Yeah, they handle the calling and waiting for you, then connect you when an agent is available. Check out their demo video to see how it works.

File in Washington definitely. I've been remote for 5 years and always file here. Never had an issue with ESD accepting claims from remote workers.

•Good to hear from someone with lots of remote work experience. Makes me feel more confident about filing.

•Same here. Remote work is mainstream now, ESD handles it routinely.

washington for sure! but make sure you have all your documentation ready because they might ask for extra verification since your employer is out of state

Javier Gomez
•What kind of extra verification might they want?

Carmen Ortiz
•maybe proof that you actually worked from washington, like home office setup or something? idk for sure though

Emma Wilson
•They don't typically ask for proof of home office setup. Standard employment documentation is usually sufficient.

This is why I love working remotely but hate the bureaucracy that comes with it. Everything is more complicated when you don't fit the traditional employment model.

•At least unemployment filing is clearer than tax situations for remote workers!

•True, taxes are a nightmare when you work remote for an out-of-state company.

I tried calling Washington ESD about this exact question last month and spent 2 hours on hold before giving up. Eventually used Claimyr and got my answer in 10 minutes. Worth every penny.

•That's the third recommendation for Claimyr. Definitely going to check it out if I need to call ESD.

•How does Claimyr work exactly? Do they just call for you?

•They handle the calling and waiting, then patch you through when they get an agent. You can see the whole process in their demo video.

Washington ESD has been pretty good about remote work claims in my experience. Filed twice in the past 3 years for remote positions with out-of-state companies, no issues either time.

Javier Gomez
•That's really encouraging! Were your claims processed at normal speed?

Liam O'Sullivan
•Yeah, normal processing times. I think they're used to this situation now.

Just wanted to add - make sure your employer knows you're filing in Washington. Sometimes they expect you to file in their state and it can cause confusion with their HR department.

Javier Gomez
•Good point! I should probably give them a heads up about where I'm filing.

Giovanni Conti
•Yeah, it helps avoid delays when ESD contacts them for verification.

Washington state, no question. The rule is simple - file where you work, and you work from your home in Washington. Don't overthink it!
