How do I know if I won my unemployment appeal - waiting for Washington ESD decision
Had my unemployment appeal hearing with Washington ESD last week and I'm going crazy waiting for the decision. The hearing went okay I think but the administrative law judge didn't give any hints about which way it was going. How long does it usually take to get the written decision? And will they call me or just send it in the mail? I really need to know if I won so I can figure out if I need to find another job ASAP or if I'll get my back benefits.

You should receive a written decision within 2-3 weeks of your hearing date. Washington ESD will mail it to your address on file, and it should also appear in your online account. The decision will clearly state whether your appeal was granted or denied.

•Thanks! Do they post it online first or does the mail come first? I check my account like 10 times a day lol

•Usually they update the online account within a day or two of mailing the physical letter. So if you're checking obsessively, you'll probably see it online first.

mine took almost 4 weeks last year, don't panic if it takes longer than expected. covid really backed everything up and they're still catching up

•4 weeks?? I don't think I can wait that long without knowing. Did you get back pay when you won?

Benjamin Johnson
•yeah I got all my back benefits from when they originally denied me. it was like $4800 total

I had the same anxiety after my appeal hearing. If you're having trouble getting through to Washington ESD to check on the status, I discovered this service called Claimyr (claimyr.com) that actually got me through to a real person at ESD. They have a video demo at https://youtu.be/7DieNd3C7zQ showing how it works. Really helped when I needed to verify they had all my documentation.

•Interesting, never heard of that. Did it actually work for you? I've been trying to call ESD for days.

•Yeah it worked great. I was skeptical at first but got through within like 20 minutes when I'd been trying for weeks on my own.

•How much does something like that cost? Sounds too good to be true

The decision letter will have three possible outcomes: 1) Appeal granted - you win and get benefits, 2) Appeal denied - original decision stands, or 3) Remanded - sent back to ESD for more review. If you win, they'll tell you exactly how much back pay you're getting.

Ezra Collins
•What does remanded mean exactly? Is that good or bad?

Aaliyah Reed
•Remanded means the judge found issues with how ESD originally handled your case and is sending it back for them to look at again. It's not a win or loss, just means more waiting unfortunately.

ugh the waiting is the worst part!! I literally couldn't sleep for weeks after my hearing

•Yes! I keep replaying everything I said wondering if I messed something up

•same here, kept thinking about all the things I should have said differently

One thing to watch for - if your appeal is successful, Washington ESD will typically process your back benefits within 1-2 weeks of the decision. They'll pay you for all the weeks you were eligible but didn't receive benefits.

•That would be such a relief. I've been barely scraping by for months now.

•I know it's tough. The good news is if you do win, that back pay can really help catch up on bills.

Check your secure messages in your ESD account too. Sometimes they send updates there before the official letter arrives.

Ezra Collins
•Good tip! I haven't been checking messages, just looking at claim status

Gavin King
•Yeah the messages section sometimes has more detailed updates about where things stand in the process

btw if you lose the appeal you can still appeal to the board of appeals, so it's not necessarily over even with a bad decision

Ezra Collins
•Really? How long do you have to file another appeal?
0 coins
Benjamin Johnson
•I think it's 30 days from the date on the decision letter, but don't quote me on that
0 coins
Aaliyah Reed
•That's correct, 30 days to appeal to the Board of Appeals if you disagree with the administrative law judge's decision.

Just wanted to follow up on the Claimyr thing - if you do need to call ESD about your appeal status, that service really does work. I used it again last week to ask about a different issue and got through right away.

•I might try that. I've been calling the regular number for 2 weeks straight with no luck

Zara Perez
•Yeah the regular number is basically impossible. This actually connects you to a real person who can look up your case.

The hardest part is not knowing. I won my appeal but the 3 weeks waiting for the decision were brutal. Try to stay busy and not obsess over it.

Ezra Collins
•Easier said than done! What was your appeal for if you don't mind me asking?

Eleanor Foster
•They said I quit voluntarily but I was actually laid off. Had to get my old manager to testify at the hearing.

whatever happens, don't give up. the unemployment system is so messed up but sometimes you do win

•Thanks for the encouragement. Some days I feel like I'll never get through this process.

•I know exactly how you feel. It's exhausting fighting for benefits you're entitled to.

Pro tip: if you win, make sure to file your weekly claims right away if you haven't been. They'll pay you retroactively but you still need to file for ongoing benefits.
0 coins
Ezra Collins
•Wait, should I be filing weekly claims even though I'm currently disqualified?
0 coins
Lucas Turner
•Check with ESD on that one. Some people are told to keep filing during appeals, others aren't. Don't want to give you wrong info.

Aaliyah Reed
•Generally you should continue filing weekly claims during an appeal unless ESD specifically told you not to. Better safe than sorry.

I had my hearing 2 months ago and still nothing. This system is completely broken.
0 coins
Ezra Collins
•2 months?! That's insane. Have you tried calling to check on it?
0 coins
Kai Rivera
•I've called probably 100 times. Either can't get through or they just say it's 'in process' with no timeline.

•That's exactly when something like Claimyr is worth it. At least you can get a real person to look into the delay.

The decision letter will be very detailed about their reasoning. Even if you lose, you'll understand exactly why they decided against you.
0 coins
Ezra Collins
•That's something I guess. At least I'll know where I stand instead of this limbo.

Anna Stewart
•Exactly. The not knowing is probably worse than a bad decision at this point.

hang in there. i know it sucks waiting but at least you got your hearing. some people wait months just for that
0 coins
Ezra Collins
•True, I did get my hearing pretty quickly. Only waited about 6 weeks for that.

Layla Sanders
•yeah that's actually pretty fast these days. hopefully the decision comes soon too

If you win, celebrate! If you lose, don't give up. I've seen people win on their second appeal after losing the first one.

Ezra Collins
•Thanks for the perspective. I'm trying to prepare myself for either outcome.

•That's smart. Having a plan for both scenarios helps with the anxiety.

The judge at my hearing said decisions usually take 10-14 business days but that was pre-COVID so who knows now
0 coins
Ezra Collins
•Mine didn't give any timeline. Just said I'd receive a written decision 'in due course' whatever that means.
0 coins
Kaylee Cook
•Yeah they're probably being more cautious about giving timeframes since everything got so backed up

Keep checking that online account! Mine showed up there on a Friday evening when I wasn't expecting it.

Ezra Collins
•I check it constantly lol. Good to know it might show up any time of day or week.

Oliver Alexander
•Yeah it's not like they only update during business hours. Could be anytime.

Update: I tried that Claimyr service someone mentioned and actually got through to ESD in 15 minutes. The rep told me my appeal decision was mailed yesterday! Thanks for the tip.

Whatever the outcome, you did everything you could. That's all anyone can do with this system.

•Second-guessing yourself won't change anything now. You presented your case and that's what matters.
