ESD won't accept backdated claim - can't enter October week because 'last day worked' is in November

I'm so confused trying to file for unemployment! I only need to claim two weeks - one week in October and one week in November (November 6 week). I took some temp jobs in between. But when I try to file, the system won't let me enter the October week because my 'last day worked' is showing as November 20 (today). The system keeps rejecting dates earlier than my last day worked. Does anyone know how to claim for non-consecutive weeks like this? I worked sporadic temp jobs and only need UI for specific weeks when I had no work. Do I need to file separate claims? Call ESD directly? The instructions online are super unclear for situations like mine. I don't want to mess this up and lose benefits for those weeks I really needed coverage!

You need to file what's called a 'backdated claim' for the October week. You can't do this through the regular online system - it has that restriction about not going earlier than your last day worked. You'll need to call ESD directly and explain your situation. The agent can manually process the backdated claim week for you. Make sure you have documentation of why you're filing late for the October week (if you have any). They might ask for an explanation about the delay in filing.

ya i had this EXACT same issue last month when i was trying to file for a week in september after taking some gig work. spent 3 hours on hold with esd and gave up!!! their system is so broken

I had to deal with this last year. Here's exactly what you need to do: 1. First, file your claim for the November week as normal 2. Then call ESD at 800-318-6022 and explain you need to backdate a claim for a specific week in October 3. Good luck trying to get through to ESD on the phone lol... I've been trying for THREE DAYS and just get the "we're experiencing high call volume" message and then they hang up. It's ridiculous.

I had the same problem but then I found this service called Claimyr that got me through to an ESD agent in about 20 minutes. It basically calls ESD for you and holds your place in line, then calls you when an agent is available. Saved me hours of frustration. Just to clarify some misinformation in this thread: The 4-week limit mentioned above isn't always strictly enforced. ESD can actually backdate claims up to 52 weeks in certain circumstances, but you need to demonstrate "good cause" for the late filing. Good cause examples include: - You were physically/mentally unable to file (illness, etc.) - You received incorrect information from ESD - You attempted to file but encountered technical issues - You were unaware you could file while working temp jobs When you call, be very clear about why you didn't file for the October week at the time. If they initially deny your request for backdating beyond 4 weeks, you can appeal that decision. Document everything.

This gives me hope! I honestly didn't know I could file during weeks I had no work if I had worked before and after those weeks. I thought I had to wait until I was completely done with all temp work. So maybe that counts as "good cause"?

my cousin had this exact same problem and ESD ended up denying his backpay for weeks that were more than a month old even though he had a really good reason for not filing earlier. the whole system is designed to deny benefits!!! they make everything so complicated on purpose!!!

One thing nobody has mentioned yet - when you file for that November week, make sure you report ALL work and earnings accurately, including the temp work you did between October and November. If your earnings for any week exceed your weekly benefit amount, you won't receive benefits for that week, but you still need to report it all correctly. Also, depending on how long you worked at those temp jobs and how much you earned, it might affect your benefit year or weekly benefit amount. The system recalculates based on recent work history. Thanks for this advice! I definitely planned to report all my temp work earnings. I'm just hoping I can still get benefits for those specific weeks when I had zero income. I'll update once I get through to ESD.
