ESD reopened my adjudication AFTER approving my claim - will my payments stop?
I'm completely confused about what's happening with my ESD claim. After 8 frustrating weeks stuck in adjudication, I finally contacted the governor's office last week as a last resort. To my surprise, it actually worked! An adjudicator called me within an hour of my complaint, approved my claim, and I received payment within 2 days. I thought my nightmare was FINALLY over. But this morning I woke up to an alert saying they need MORE information about my separation from my employer?! How does this make any sense? They already approved everything and paid me! Does anyone know if this means my weekly payments will stop while they investigate AGAIN? I've already waited 2 months with no income and barely survived. I can't go through this rollercoaster again. Has anyone dealt with ESD reopening an adjudication after approval? I'm panicking about next week's claim.

This actually happened to me too back in January. After getting approved, they sent me a request for additional documentation about why I was laid off. It turned out my former employer was contesting my claim even though I'd already been approved and paid for 3 weeks. The good news is that in my case, they continued paying me during this second review. However, they did warn me that if the new adjudication resulted in a disqualification, I'd have to pay back what I received. I recommend uploading any additional documentation they're asking for ASAP and then calling to confirm they received it. During the second review they may place a hold on payments, but from my experience, they continued paying me until a final determination was made.

omg the ESD is a DISASTER. they did this exact thing to my cousin. approved him, paid him for like a month, then suddenly decided they needed to reinvestigate his quit. turns out his old job told them he voluntarily quit when he was actually laid off!!! make sure u have ALL ur paperwork from when u separated from ur job. they might be getting conflicting info from ur employer.

•That's what I'm worried about! My employer told me it was a layoff due to restructuring, but I'm scared they're telling ESD something different. I've uploaded my termination letter that clearly states it was a business decision, but who knows if they'll actually look at it.

I work in HR and see this happen frequently. What's likely occurring is that your employer responded to the initial claim after ESD had already made a determination in your favor. Employers have 10 business days to respond, but many miss this deadline and submit late responses. When they do, ESD is required to review that new information regardless of having already approved your claim. My advice is to: 1. Continue filing your weekly claims as normal - if you stop, you'll definitely not get paid 2. Upload any documentation proving your separation reason (termination letter, emails, etc.) 3. Call ESD to explain the situation and ask if you can expedite this second review 4. Document all communications meticulously in case you need to appeal In most cases I've seen, if the initial approval was for a qualifying separation reason, the second review typically confirms the original decision.

same thing happened with me in march!! they approved me then 2 weeks later sent a letter saying they needed info about my job search activities?? but that was totally different from what they originally approved me for. i just uploaded what they asked for and kept filing claims and eventually they sent a letter saying everything was fine and i kept getting paid the whole time. the system is so confusing. just keep filing ur claims every week no matter what

I had something similar happen and had to call ESD multiple times but it was impossible to get through. After getting hung up on 8 times, I found a service called Claimyr that got me connected to an ESD agent in about 20 minutes. They basically call ESD for you and then call you when they have an agent on the line. It costs money but was worth it to get answers and resolve my claim issue. The ESD system is BROKEN!!! They did this to me too and then CUT OFF my benefits without warning during the second "investigation" even though I provided everything they asked for. Then they had the nerve to say I owed them $4800 back! The entire system is designed to frustrate people so they'll give up. I fought it and eventually won my appeal but it took 4 months. The governor's office contact is your best bet for getting actual help. Call them again!

One important thing I forgot to mention - make sure to check your eServices account for any action items or questionnaires they want you to complete. Sometimes they don't send an email about these, and if you miss them, it can delay your claim or cause payments to stop. I'd recommend logging in daily to make sure nothing new has popped up that requires your attention.

Following up on my earlier comment - I think it would be helpful to understand that under WAC 192-220-017, ESD can reexamine a decision at any time if they receive new information. However, any benefits paid before a redetermination are typically only considered overpayments if there was claimant fraud or misrepresentation. In your case, since it appears to be your employer potentially contesting the claim after an initial determination, you should be entitled to continue receiving benefits during the review unless ESD specifically notifies you of a hold. Even if they eventually rule against you, you might qualify for a waiver of overpayment if you received the benefits through no fault of your own (which appears to be the case here).

btw did u use a fact finding form to respond to their new questions? make sure u fill that out SUPER detailed. my friend got denied cuz she just wrote short answers and they said she didn't provide enough info
