ESD claim stuck in limbo for 6 weeks - employer responded but still in 'separation issue' purgatory

I'm at my wit's end with this unemployment claim! Applied on February 12th and now it's week 6 with NOTHING. After getting nowhere with regular ESD calls, I contacted the governor's office yesterday (desperate times...). They actually escalated it and I got a call from ESD within an hour. The conversation was bizarre - the agent seemed confused why I was even calling! When I explained I'd been waiting 6 weeks and had already cleared identity verification, he was like "Oh, it's actually a separation reason issue now." WHAT? I told him I completed the fact-finding questionnaire the same day I applied. He acted surprised and said "Well, now I can send it to an adjudicator." I thought it was ALREADY with an adjudicator this whole time! My former employer confirmed they responded to ESD on March 18th with the separation information. They've had everything they needed for weeks! I'm burning through savings and don't know how much longer I can last. Has anyone dealt with this separation reason limbo before? Any advice on how to actually get this resolved?

Typical ESD bureaucracy BS! They SAY one thing and then do another. Your claim is probs sitting in some digital folder and no one even looked at it until you got the governor involved. I had almost the same thing happen - waited 8 WEEKS before I found out my claim wasn't even assigned to an adjudicator yet despite being told it was "in process" multiple times. It's like they hope you'll just give up and go away. Keep being the squeaky wheel - it's the only way to get anywhere with them.

That's what I'm afraid of - that it was just sitting there all this time! Did your employer confirm they had responded too? Mine said they replied within 3 days of getting the request. It's so frustrating that nobody seems to communicate with each other.

oh man this happened to me 2!! was told my claim was in adjudication for like a month, then randomly called one day and they were like "oh we dont have the separation info yet" but my boss had already sent it in weeks b4. its crazy how they dont even know whats going on in their own system

This is unfortunately very common with ESD's system. There's often a disconnect between what employers submit and what actually gets processed in the ESD system. Sometimes the employer response gets flagged incorrectly or routed to the wrong department. When you called, did they give you any timeframe for when the adjudicator will review your case?

Separation issues are tricky because they require human review. What you're experiencing is the classic ESD black hole where claims get stuck before being assigned to an adjudicator. The fact that they only sent it to adjudication after you called (even though your employer responded weeks ago) is actually quite common. A few things that might help: 1. Call ESD first thing in the morning (7:30am) every 2-3 days to check status and create "contact notes" on your account 2. Send a secure message through your eServices account specifically asking about the separation issue status 3. Continue filing your weekly claims without fail 4. Ask for a ticket number every time you call so you have proof of contact Don't give up! The system is frustrating but persistently following up does make a difference.

Thank you for these specific tips. I didn't know about asking for a ticket number - will definitely do that from now on. The agent yesterday said I "should hear something today" but of course, nothing happened. Do you know if there's any way to speak directly with the adjudication department?

Unfortunately, there's no direct line to the adjudication department. They work behind the scenes and only contact you when they need additional information or have made a decision. When agents say "you should hear something today," they often mean your claim will be reviewed today, not necessarily that you'll get a decision. One thing that worked for me when my claim was stuck was using Claimyr (claimyr.com). It's a service that helps you get through to ESD agents without the endless busy signals and disconnects. They have a demo video at https://youtu.be/7DieNd3C7zQ?si=26TzE_zGms-DODN3 that shows how it works. I was skeptical at first, but it actually got me connected to an agent who could see my entire claim history and explained exactly what was causing the delay. Worth considering if you keep hitting walls.

I'll second this - used Claimyr when my claim was stuck for 2 months. Got through to an actual tier 2 agent who fixed my issue on the spot. Better than waiting on hold for 6 hours just to get disconnected!

They're different steps in the process. The fact-finding questionnaire is where you provide your side of the separation story. Adjudication is when an ESD specialist reviews both your information and your employer's response to determine if you qualify for benefits. If there's any discrepancy between your account and your employer's, that's usually what causes delays in adjudication. Hope that helps clarify things!

Just to add some useful context: When your employer responds to ESD, their response first goes through an automated processing system. Sometimes responses get misfiled or don't properly attach to your claim, especially if there's any formatting issue with their response. In my experience as someone who's helped many people through this process, what likely happened is: 1. Your employer responded on March 18 2. Their response either wasn't properly tagged to your account OR 3. It was tagged but no alert was generated to move your claim forward The governor's office escalation did exactly what it's supposed to do - it forced a human to actually look at your claim. Now that it's been sent to adjudication (for real this time), you should expect 1-3 weeks before a decision, depending on current backlogs. Make sure to check your ESD account and physical mail daily, as adjudicators often send requests for additional information with tight deadlines.

This is really helpful to understand what might have happened behind the scenes. It's been 2 days since the ESD agent said he was sending it to adjudication - should I follow up again soon or give it more time? I'm worried about it falling into another black hole.

I think you should give it at least a week before following up again. From what I've seen, once your claim actually gets sent to adjudication and is in the queue, calling repeatedly doesn't speed things up and might just annoy the staff (which never helps). But definitely keep filing your weekly claims! And check your online account daily for any notices or requests for information. Once it gets assigned to an actual adjudicator, things usually move pretty quickly.

This matches my experience too. Once it was finally in adjudication it took about 10 days to get a decision. And then they paid all my back weeks at once which was a huge relief!

Quick update request - it's been about a week since your governor's office escalation. Has there been any movement on your claim? Sometimes these escalations create a ripple effect where things suddenly start moving quickly.

Yes! Finally got some movement. Received a call from an adjudicator yesterday who asked a few additional questions about my separation. She said my employer confirmed I was laid off due to lack of work, so there shouldn't be any issues with qualification. She said to expect a decision in the next 48 hours and that if approved, all my back weeks would be paid at once. Fingers crossed this is the final stretch! Thanks to everyone who offered advice - this forum has been a lifeline during this stressful time.

That's fantastic news! So glad the governor's office escalation worked out for you. It sounds like everything is finally moving in the right direction. The fact that your employer confirmed it was a layoff due to lack of work should make this a straightforward approval. Keep us posted on how it turns out - stories like yours give hope to others dealing with similar situations!
