ESD claim reset stuck in adjudication after employer failed to respond

I'm at my wit's end with this ESD nightmare. My claim reset on Oct 15th and the system actually TOLD me I'd receive payments while they confirmed my new UI eligibility. Fast forward almost 3 weeks: NOTHING. My former company (construction management) had 10 days to respond and they completely ignored the deadline. Instead of processing my claim, ESD moved it from 'needing more information' back to 'adjudication' status! Like...what??? I've been trying to survive on savings but that's almost gone now. Had to call the Governor's office last week because I was desperate - they confirmed NO ONE had even looked at my account since Oct 15th. Not a single agent assigned! I've got a job interview tomorrow morning (fingers crossed) but bills are piling up and I need these benefits I'm entitled to. Anyone else dealt with this weird reset-to-adjudication loop? Any advice before I call ESD again tomorrow?

This happens ALL THE TIME with ESD. The system is broken! I had a similar situation last month where my employer didn't respond but instead of moving forward with payment, they put me in this endless adjudication loop. The key is to keep calling and explicitly ask them to review the employer response deadline. Make sure to mention the exact date the employer's response period ended (sounds like Oct 25th for you). When you call, tell them you want them to check if an adjudicator has been assigned, and if not, you want to request an expedite based on financial hardship.

Thank you so much for this advice. I didn't know I could request an expedite! Do I just straight up tell them I'm experiencing financial hardship, or do I need to provide documentation? I definitely will mention the Oct 25th employer deadline. It's ridiculous they can just ignore the timeframe and I'm the one who suffers.

Sadly, this is a very common ESD issue. When a claim resets and an employer doesn't respond, it should automatically proceed after the deadline, but their system often fails to do this correctly. Here's what you need to do: 1. Call early tomorrow morning (right when they open at 8am) 2. Specifically request a "status escalation due to exceeding employer response timeframe" 3. Get a reference number for your escalation 4. If they say they can't help, ask to speak with a claims specialist or tier 2 agent 5. Document everything - who you spoke with, time of call, what they promised The system is supposed to auto-approve if employers don't respond, but it often glitches. Good luck with your interview tomorrow - hope it works out and you can get off UI soon!

Thank you for the detailed steps! I'll definitely follow this exact process. I've been calling randomly throughout the day, but sounds like first thing in the morning is the way to go. Do you know if there's any specific department I should ask for when I call? The reference number tip is gold - I haven't been tracking those.

I went through this EXACT adjudication nightmare last quarter when my seasonal work ended. Tried calling ESD for WEEKS with no luck - either couldn't get through or got disconnected after waiting for 2+ hours. Finally used Claimyr (claimyr.com) and got connected to an actual ESD agent in about 20 minutes. They have this video showing how it works: https://youtu.be/7DieNd3C7zQ?si=26TzE_zGms-DODN3 The agent was able to see that my claim needed manual intervention because the system didn't process the employer non-response correctly. They forwarded my case to a specialist and I had my issues resolved within 3 days. Definitely worth checking out if you keep hitting walls with the regular phone line.

is this service legit tho? seems sketchy that we have to pay extra just to talk to esd when its literally their job to help us lol

I was skeptical too at first, but after wasting so many hours trying to get through the regular way, it was worth it for me. They don't replace talking to ESD - they just get you through the phone system and connected to an actual agent. After that, you're just talking directly with ESD. But I get the frustration about having to pay at all when this should be a basic service.

The same thing happened to me back in August. It's a known issue with the ESD system that claims get stuck after resets. I waited 7 weeks with zero progress until I finally contacted my state representative's office. They have a constituent services team that can sometimes move things along faster than the governor's office. I had my claim approved 4 days after my rep's office got involved. Worth a try if tomorrow's call doesn't get results!

7 WEEKS?? I can't wait that long! But contacting my state rep is a great idea I hadn't thought of. I'll try ESD directly tomorrow and if that doesn't work, I'll try my rep's office. Thank you!

This hole benefit system is a JOKE!!!! Ive been fighting with them since jULY about my benefits and still not fixed. They make up new rules evry week and expect us to just deal with it. Why bother even giving deadlines to employers if they just ignore them???? The only thing that worked for me was filing a formal complaint with the states unemployment ombudsman office. Google WA state unemployment ombudsman and fill out there form. They are seprate from ESD and can actually do something.

The Ombudsman office is a good suggestion, but they typically only get involved after you've already gone through the normal channels. OP should try calling ESD directly first, then escalate if needed. But keeping the Ombudsman as an option is definitely smart if things continue to stall.

I was an adjudicator with ESD until last year, so I can explain what's happening. When a claim resets, the system generates an employer response request. If they don't respond within 10 days, the system SHOULD automatically proceed, but there's a known glitch that sometimes puts these into manual review instead. What likely happened is your claim got caught in this automated error. When you call tomorrow, specifically ask for a "claims center agent" and use the phrase "employer non-response adjudication review." Tell them you need a "fact-finding interview bypass" since the employer didn't respond within the statutory period. This specific terminology will help get your issue to the right department. Good luck with both the call and your interview!

THANK YOU! Having the exact terminology to use is incredibly helpful. I'll definitely say "fact-finding interview bypass" and "employer non-response adjudication review" when I call. Hopefully speaking their language will get me better results. Really appreciate the insider perspective!

This is excellent advice. Using the correct terminology makes a huge difference when dealing with ESD. I've found that agents respond much better when you can speak their language precisely like this.

Yes, I've definitely been keeping up with my weekly claims! That's one thing I made sure to do even through all this frustration. Thanks for the reminder though - I've heard horror stories about people who stopped filing and had to restart the whole process.

Any update? Were you able to get through to ESD today? Did any of these suggestions help? Also, how did your job interview go?

Update! First, the interview went really well - they're checking my references, so fingers crossed! As for ESD, I called at 8:01 AM and actually got through after about 40 minutes. Used the "employer non-response adjudication review" phrase that was suggested here, and the agent immediately knew what I was talking about. They confirmed my employer never responded and have now expedited my claim for processing. They said I should see movement within 72 hours! Thank you all SO MUCH for the help and support. This forum has been a lifesaver.
