ESD overpayment waiver approved but no refund - typical wait times?

I've been through a rollercoaster with ESD and finally got my overpayment waiver approved last week after I had already paid back $2,800 over the past 3 months. The letter says I'm eligible for a refund but doesn't mention any timeline. Has anyone gone through this process before? How long did it take to actually get your money back after the waiver was approved? I'm trying to figure out if I should be checking my bank account daily or if this is going to take weeks/months. Really need that money back for medical bills coming up in April!

Thanks for sharing! Did you have to do anything during those 6 weeks? Did you call them at all to check on the status?

Mine took forever!! My waiver was approved in October and I didn't see my $4,900 until January. I called every week and got different answers every time. One rep said 2-3 weeks, another said 90 days, and a third one told me there was no timeline at all. The ESD system is completely broken.

You're right about inconsistent info, but the official guideline is 30-45 business days for refund processing after waiver approval. The delay you experienced was likely due to the year-end processing backlog (Oct-Dec is their busiest period with Q4 reconciliations). For anyone waiting now, the current processing time is running closer to 30 days according to the OAH dashboard.

I got my waiver approved too but haven't paid anything back yet... does this mean I just don't have to pay now? The letter was really confusing.

If your waiver was approved and you haven't paid anything yet, then correct - you don't need to make any payments. The waiver essentially cancels the overpayment debt. Keep that approval letter forever though! Sometimes these cases get reopened years later and you'll need proof of the waiver. The confusion in ESD letters is unfortunately common - they use very technical language without clear explanations.

Has anyone had luck reaching an actual human at ESD to check on refund status? I've been trying for DAYS and keep getting disconnected or stuck in that horrible phone tree. Feels impossible to talk to someone who can actually look at my account and tell me what's happening with my refund.

I was struggling with the same thing and was about to give up, but then I tried using Claimyr (claimyr.com) and it worked! They have this system that holds your place in line and calls you back when an ESD agent is available. Saved me hours of frustration. They have a video showing how it works: https://youtu.be/7DieNd3C7zQ?si=26TzE_zGms-DODN3. My refund was stuck in processing and the agent I spoke with was able to expedite it once I finally got through.

I work with unemployment cases regularly, and here's what you should know about waiver refunds: 1. The standard processing time is 30-45 business days from waiver approval 2. Refunds typically come via the same method you made payments (direct deposit or check) 3. The system processes refunds in batches twice a month 4. If you paid via multiple methods, you may receive multiple refunds 5. The letter confirming the refund is typically sent separately after processing begins If it's been more than 45 business days, request a formal case escalation by calling 833-572-8400 and specifically asking for a "refund status escalation" - this puts your case in a different queue.

This is SO helpful! Thank you. I'm at day 8 now so I guess I need to be patient. Do weekends count in the 30-45 business days timeline?

@OP no weekends dont count in the business days! and also holidays dont count either... thats why mine took so long cuz of christmas and new years

Ugh, that makes the wait even longer. Thanks for clarifying though!

My situation was similar but with different amount ($1,890). I got the waiver approval letter on February 6th and the refund hit my account on March 12th. So about 5 weeks for me. The weird thing was I never got any notification that the refund was coming - it just appeared in my bank account with a reference to ESD treasury. I actually thought it was a mistake at first lol

Has anyone noticed that ESD seems to be getting WORSE each year instead of better? Like they've had years to fix these systems and they still can't get simple things right like telling people when they'll get their money back. I swear the whole department is running on Windows 95 computers and fax machines.

Some additional insights that might help those waiting for refunds: - The refund process is handled by a completely separate department from the waiver approval team - Refunds over $5,000 require additional verification steps and take longer - If you made payments while under an active payment plan, the refund is typically faster than if you made lump sum payments - The fiscal year transition (June-July) can cause additional delays - If your banking information has changed since you made payments, notify ESD immediately to avoid further delays For the original poster, since your amount is $2,800, you're in the standard processing category which is generally more predictable.

This is really detailed information - thank you! I did make monthly payments rather than a lump sum, so hopefully that helps speed things up. I'll make sure to watch my account over the next few weeks.

I'm in a very similar situation - got my overpayment waiver approved about 3 weeks ago after paying back $3,200. Reading through everyone's experiences here is really helpful but also shows how inconsistent the process is! It sounds like I should expect anywhere from 4-8 weeks total based on what people are sharing. The fact that there's no way to track the refund status online is so frustrating. I guess I'll just have to keep checking my bank account and hope for the best. Thanks everyone for sharing your timelines - at least now I know I'm not the only one dealing with this uncertainty!
