ESD approved my overpayment waiver but no refund after 3 weeks - what's next?

So confused right now. ESD finally approved my overpayment waiver after fighting with them for months (they initially said I was overpaid $8,700 because of some employer reporting error). I got the official decision letter three weeks ago saying my waiver was approved and that I would get back the $2,950 I had already paid towards the overpayment. The letter said refunds would be processed within 10 business days, but I haven't seen a penny! My eServices account shows the overpayment balance as $0 now, but no sign of any refund being processed. I've called probably 30 times and can't get through to anyone. Has anyone else dealt with this waiver refund situation? How long did it actually take to get your money back? I'm literally about to be evicted and that money would save me.

I went through this exact situation last summer. It took about 5 weeks total to get my refund after my waiver was approved, even though the letter said 10 business days. The ESD system marks your account as resolved once the waiver is processed, but the refund goes through a completely separate department. If your eServices account shows $0 balance, that's a good sign that everything is moving correctly. Have you checked your mail? Sometimes they send a separate notice about the refund method (direct deposit vs. check).

Thanks for the response! Nothing in the mail yet beyond the initial approval letter. Did they just randomly deposit it one day or was there any warning? I'm checking my bank account obsessively every morning.

there not gonna automatically kno where to send ur money. did u give them direct deposit info?? they probly mailing u a check if u didnt update ur payment prefernces

I've had direct deposit set up the whole time - that's how I was receiving my benefits before all this happened. My banking info is still in the system (I can see it in my profile). They took the payments FROM my account automatically when I was on the payment plan, so they definitely have my banking info.

The problem is that ESD's refund process is completely separate from their regular payment system. I know it's frustrating but 3 weeks isn't actually that unusual. The waiver approval goes through one department, then the finance department has to verify everything before issuing the refund. In my case, I had to actually call and speak with someone in the benefits payment control unit to get my refund processed after my waiver was approved. Have you tried using the message center in eServices to specifically ask about the status of your refund? Sometimes you get a faster response that way compared to calling.

I've sent three messages through the portal over the past two weeks and haven't gotten any responses. I'll try specifically mentioning the benefits payment control unit next time. Do you know if there's a direct number for that department?

I went through EXACTLY what you're going through in January. My waiver was approved but no refund for over 40 days!!! The system is DESIGNED to be slow when giving money back but FAST when taking it away. It's infuriating! I finally got my money after filing a complaint with my state representative's office. They have constituent services that can speed things up when ESD is being ridiculous. THREE DAYS after contacting my rep's office, I magically got my refund direct deposited.

Wow, that's a great tip about contacting the state rep! I never would have thought of that. I'll give ESD one more week and then try that approach. Did you just call your rep's local office?

Try using Claimyr to get through to an ESD agent faster. It really worked for me when I had a similar issue with a missing payment. I was able to talk to a real person who could actually see what was happening with my claim instead of just guessing. Their site is claimyr.com and they have a video showing how it works: https://youtu.be/7DieNd3C7zQ?si=26TzE_zGms-DODN3. Basically, they help you skip the hold times and get to an actual agent. In my case, the agent was able to see that my refund was approved but stuck in some processing queue and they were able to prioritize it.

I'm glad you mentioned Claimyr. That's actually what I ended up using when my refund was delayed too. It was the only way I could get a straight answer about what was happening with my money.

For overpayment waiver refunds, there are actually two different processes depending on how you originally paid the overpayment: 1. If you made payments directly (like through a payment plan), those refunds go through the financial department and typically take 4-6 weeks. 2. If they recouped it from your benefits, those refunds are processed more quickly (10-15 business days). Based on what you described, it sounds like you were on a payment plan, so unfortunately the 4-6 week timeframe is pretty standard. The system is definitely frustrating. The $0 balance is definitely a good sign though - it means your waiver was properly processed in the system. If you're facing eviction, you might want to ask about a hardship expedition of your refund. Call and specifically ask to speak to someone in the Benefits Payment Control unit and explain your housing situation. They can sometimes flag refunds for expedited processing in genuine hardship cases.

Thank you so much for this detailed explanation! Yes, I was on a payment plan and had made about 6 payments before the waiver was approved. I'll definitely ask about the hardship expedition - that would be a lifesaver if they could speed it up.

UPDATE: I finally managed to get through to someone at ESD this morning! For anyone dealing with this in the future - the rep told me that waiver refunds are indeed processed separately from regular benefits and take 30-45 days to process. She confirmed mine was approved and in the system, and should be deposited within the next 7-10 days. She also noted that they're currently dealing with a backlog of waiver refunds from a recent system update. Thanks everyone for your help and suggestions!
