ESD Overpayment Waiver approved - how long until refund arrives?
Finally got my ESD overpayment waiver approved last week after fighting it for nearly 2 months! I had to pay back $4,250 while the appeal was pending, which completely drained my savings. The determination letter says I'm eligible for a refund of what I paid, but doesn't mention WHEN I'll actually get my money back or how they'll send it. Has anyone gone through this process recently? How long did it take to get your refund after approval? Will they mail a check or direct deposit? I need to pay rent next week and was really counting on having this money back by now.

•6 WEEKS?? Ugh I was hoping it would be faster. Did you call them at all during that time or just wait it out?

In my experience working with several clients, ESD usually processes refunds from approved overpayment waivers within 3-4 weeks, but it can take longer during busy periods. They typically refund it using the same payment method you originally received benefits (direct deposit or debit card). They don't automatically send a notification when the refund is processed, so I recommend checking your account every few days. You can also call ESD to check on the status, though getting through can be challenging.

•Thanks for the info! I've been trying to call ESD every day this week but can't get through. It's so frustrating - I just need to know when to expect the money since I have bills coming up.

I got a waiver approved back in January and still havent seen a penny of my refund!!! Called 23 times and either get hung up on or told "its processing" whatever that means. The system is rigged to take our money but when they owe US suddenly everything moves at snails pace!!

•Oof, that's concerning. Have you tried contacting your state representative? Sometimes they can help move things along with state agencies.

I had a similar situation with my waiver being approved last year. For me, it took about 4 weeks to get the refund, and it came via direct deposit (same way I received benefits). I did receive a letter about a week AFTER the deposit happened, which was kind of useless honestly. One thing that helped me was getting through to an actual ESD agent who could check the status. Have you been able to speak with anyone directly?

•I've been trying to call but keep getting the "high call volume" message and then it disconnects me. Tried different times of day but it's always the same. So frustrating!

I was stuck in the same situation last month trying to get info about my refund. After days of calling and getting nowhere, I used this service called Claimyr (claimyr.com) that actually got me connected to an ESD agent in about 20 minutes. They have a video showing how it works: https://youtu.be/7DieNd3C7zQ?si=26TzE_zGms-DODN3 The agent told me exactly when my refund would be processed and I was able to plan accordingly. Saved me a ton of stress and time spent redialing ESD.

•Thanks for the tip! I've never heard of that service before. Did you find out anything specific about how the refund process works?

•Yes! The agent explained that refunds go through a separate department from regular benefits processing. After approval, it gets queued up in their system. They told me refunds are processed in batches every 2 weeks, so timing depends on when your approval hits their system relative to their processing schedule. The agent was able to tell me which batch my refund was in and when to expect it.

According to the ESD website, refunds from approved overpayment waivers should be processed within 30 days of the final determination. However, I've seen it take anywhere from 2-8 weeks in practice. They generally don't send any notification before the refund arrives. If it's been more than 30 days since your waiver approval, you should definitely contact them to check on the status. Refunds are typically issued in the same form as your original benefits (direct deposit or debit card).

•30 days is what they CLAIM but thats complete BS based on my experience and everyone else I know who's gone thru this!! They take ur money in 5 seconds flat but make u wait MONTHS to get it back smh

•You're right that the timeframes they provide aren't always accurate. The 30-day guideline is their target, but staffing issues and backlogs can extend it significantly. If you're still waiting after several months, you might consider filing a formal complaint through the ESD website or contacting your state representative.

Just went through this exact situation! Got my waiver approved on March 2nd and received my refund on April 8th, so about 5 weeks total. I never received any letter about when to expect the refund - it just appeared in my account. I had paid via check but they refunded via direct deposit to the account I had on file for benefits. I was also counting on the money for bills and ended up having to borrow from family while waiting. The waiting period is definitely stressful.

•Thank you for sharing your timeline! That helps me set realistic expectations. Looks like I need to figure out a backup plan for next week's rent since it probably won't come that quickly.

Just wanted to add - make sure all your banking info is up to date in your ESD account! My friend had his waiver approved but the refund was delayed another 3 weeks because his direct deposit information had changed. If you've switched banks since you received benefits, you should definitely try to get through to ESD to update that.

•That's a really good point! I haven't changed banks but I did move to a new apartment. I should make sure my address is updated in case they mail anything.

Just checking in - any luck with your refund yet? I'm curious because the processing times seem to vary so much from person to person.

•Not yet! I actually used that Claimyr service someone mentioned above and got through to ESD yesterday. The agent told me my refund is scheduled to be processed in their next payment batch which runs on Friday, so should be in my account early next week. Fingers crossed! Such a relief to at least know when it's coming.
