ESD overpayment waiver approved - how long until refund of money already paid back?
I'm in a weird situation and wondering if anyone has been through this. I just got a letter yesterday saying ESD approved my waiver request for an overpayment from mid-2023. The thing is, I had already started making payments on it (about $2,700 total over 8 months) because I didn't want it hanging over my head or affecting my credit. The letter says I don't owe anything anymore, but doesn't mention anything about getting back the money I already paid. Has anyone else been in this situation? If you got an overpayment waiver approved AFTER you'd already made some payments, how long did it take for ESD to refund your money? Did you have to call them or submit something extra to get the refund process started? I've tried calling but you know how that goes... 😫

I went through this exact situation back in November. They approved my waiver after I'd paid about $1,800 of a $3,200 overpayment. Here's what I learned: 1. The refund is NOT automatic - you have to specifically request it 2. The fastest way is to call and speak with an agent who can initiate the refund process 3. You'll need to verify your payment history with them (have your bank statements ready) 4. Once processed, it took about 6-7 weeks for my refund to arrive Make sure you explain clearly that you already made payments BEFORE the waiver was approved. Some agents will try to tell you that the waiver only applies to the remaining balance.

•They refunded the full amount, but it came as a paper check in the mail even though my benefits had been direct deposit. They said something about refunds having to go through a different department that only issues checks. Just keep that in mind - I almost threw mine away thinking it was junk mail!

Good luck ever seeing that money again! ESD is a nightmare! I had a similar waiver approved in October and I'm STILL fighting to get my $3,400 back. Every time I call they give me a different story. First it was "in processing" then it was "needs supervisor approval" then they "couldn't find record of my payments" even though they cashed my checks!!! The whole system is designed to make you give up. I've called at least 20 times and sent 5 secure messages through my account. STILL NO REFUND!!!

•I actually did email my state rep last week! Still waiting to hear back. I'll update if it makes any difference. Definitely keep ALL your payment receipts - they tried to tell me I only paid $1,700 when I actually paid $3,400. The left hand doesn't know what the right is doing over there!

have u tried using claimyr? it costs $ but they get u through to ESD right away. i used it to fix a different issue and talked to someone in like 15 mins instead of waiting for hours or getting hung up on. their website is claimyr.com and they have a video that shows how it works here: https://youtu.be/7DieNd3C7zQ?si=26TzE_zGms-DODN3 my sister got a refund for overpayment but it took forever cuz she couldnt get through on the phone. once she used that service and got to talk to someone they started the refund process and she got her money like a month later

Refunds over $3,000 require additional approvals (adds 2-3 weeks) One important tip: when you call, ask the agent to create a "Refund Request Ticket" and get the ticket number. This gives you something specific to reference in follow-up calls. Without this ticket, your request may not actually enter the system properly.

I got approved for a waiver in January after paying back about $1,200 of a $5,500 overpayment. I called immediately after getting the approval letter and was told they'd process my refund. That was over 8 weeks ago and I still haven't seen a penny! I've been calling weekly and keep getting told "it's in process" or "it's been approved and just needs to be issued." Last week, I finally spoke to a supervisor who admitted there's a huge backlog of refunds because of all the pandemic-related waivers being approved in 2025. She said they're processing them in the order received, but they're currently working through November 2024 approvals. So based on my experience, I'd say prepare for a 3-4 month wait, minimum. It's ridiculous how quick they are to take our money but how slow they are to give it back!

•Yes, they did confirm I'll get the full amount back. The supervisor actually was pretty sympathetic and said they're trying to hire more staff to handle the backlog. I'm not holding my breath though. If I don't see anything by next month, I'm planning to contact the state ombudsman's office.

just wondering - was your overpayment from regular UI or from the pandemic programs like PUA? i heard they're handling those differently.

•Mine was from regular UI. I was on standby status for a while in 2023, and they initially approved it, then later said I didn't qualify for the weeks I claimed. But now they've reversed that decision again with this waiver. The whole thing has been very confusing!

Update on my earlier comment - I found out from a colleague who used to work at ESD that there's actually a specific form you can submit to potentially speed up the refund process. It's called the "Refund Request Form" (or sometimes "Form RRF-2025") and you can ask them to email it to you when you call. You'll need to fill it out with: 1. Your claim ID 2. The overpayment ID number (from your waiver approval letter) 3. Details of all payments you made (dates and amounts) 4. Copies of proof of payment (receipts, bank statements, etc.) You can upload this through your eServices account, and it supposedly puts you in a separate, faster queue than just calling and requesting the refund verbally. I didn't know about this when I went through the process, but it might be worth trying!

I waited 5 months for my refund and then they only sent half of what they owed me! Had to go through the whole process again for the rest. The trick is to be super persistent. Call every week and keep detailed notes of who you talked to and what they said. Eventually you'll get someone who knows what they're doing.
