ESD overpayment appeal hearing wait time - 12 weeks with no date yet

I got hit with a $4,200 overpayment notice from ESD in January (they claim I wasn't eligible for benefits from October-December). I filed an appeal right away (within the 30 day window) and requested a hearing with OAH. It's now been 12 weeks and I still haven't received a hearing date. My online account just shows 'appeal pending' status. Is this normal? How long are people waiting for overpayment hearings these days? I'm stressed because the interest keeps adding up while I wait. Has anyone gone through this recently and can share their timeline?

Mine took FOREVER!!! Almost 4 months before I even got a hearing date, then another 3 weeks until the actual hearing. The whole system is a JOKE. They expect us to respond to everything within like 5 days but then they can take however long they want?? And yeah the interest thing is total BS - even if you win they've been charging you interest the whole time. Make sure you keep checking your notices tab on eServices because sometimes they send hearing info there and don't bother calling.

my freind had this happen took like 5 months before hearing but they won in the end. ESD made mistake on there part. just hang in there dude

Have you tried calling ESD to ask about expediting? I was in a similar situation last fall and was getting desperate after waiting 11 weeks with no hearing date. I couldn't get through on the regular line (kept disconnecting after 2+ hours on hold), but I found this service called Claimyr (claimyr.com) that got me connected to an actual ESD agent in about 20 minutes. One more thing - if your overpayment is because they're claiming you weren't eligible (rather than fraud), you can request a payment plan once you get the hearing date. Don't wait until after the hearing because that might be too late.

This is partially incorrect information. Interest is only removed if you win your appeal AND file a specific request for interest removal within 30 days of the favorable decision. It's not automatic. The rest of the advice about documentation and payment plans is spot on though.

this happened to me to!!! its soooo stressful. i just got my hearing date yesterday after waiting since december!!! almost 5 months of waiting and my hearing isnt even until June 3rd so thats like another month of waiting. the whole thing is making me sick with worry

Just wondering - did they actually explain WHY they think you weren't eligible? My notice was super vague and it wasn't until the hearing that I found out they thought I hadn't been looking for work properly (which wasn't true).

They said I didn't meet the work search requirements because I only documented 2 activities per week instead of 3. But during that period I was on a partial standby because my employer said they'd be bringing me back part-time. I have emails proving this that I submitted with my appeal.

That sounds EXACTLY like my situation! Make sure you highlight that standby status in your hearing - that's what saved me. If you were formally on standby status (even partial), the work search requirements are different. Print out the standby rules from 2025 to bring to your hearing.
