OAH hearing scheduled for Dec 26 - how soon will ESD resume payments after favorable decision?

Just got my Notice of Hearing from OAH for December 26. I have two separate appeals (one for a quit issue and another for availability) that they've combined into a single hearing. I'm pretty confident about my case since I have good documentation for everything. Assuming the judge rules in my favor, does anyone know how long it typically takes for ESD to start sending payments again? I've been without benefits since late September and my savings are almost gone. My rent is due January 2 and I'm getting really stressed about making ends meet. Will payments come automatically or do I need to call ESD after the hearing? Also, will they pay me for all the weeks I've been filing while waiting for the hearing? I've kept submitting my weekly claims even though they've been stuck as "disqualified" status.

I went through this back in July. If the judge rules in your favor AT the hearing, it still took about 2-3 weeks for ESD to process everything and start payments again. Make sure you keep filing those weekly claims even though they show as disqualified! They should eventually pay all those weeks if you win. One thing to know - sometimes the judge doesn't give a decision at the hearing itself. Mine took an additional week to get the written decision in the mail. And then the whole process starts after that. If you're really struggling to make rent, you might want to look into rental assistance programs in your area just in case things take longer than expected. Most counties have emergency programs for situations exactly like this.

Thanks for the info! Did you have to contact ESD after you got the favorable decision or did they automatically start processing your payments? I'm worried about the timing since my hearing is right after Christmas and I'm guessing everything will be moving slowly with the holidays.

my frend got a decison in his favor it took 5 WEEKS for $$$ to show up!!! esd is sooooo slow with everything. keep calling them to check on status after hearing. sometimes they "forget" to update ur account lol

This is exactly right. I work with unemployment claimants, and holiday hearings almost always mean additional processing time because of reduced staffing at both OAH and ESD. One important thing to note - if your appeals involve two separate issues (quit and availability), make sure BOTH are decided in your favor. Sometimes claimants win on one issue but still don't get paid because the second issue remains unresolved.

UGH the waiting game is THE WORST!! I had a hearing in August and won but then ESD STILL didn't pay me for another month!!! I was calling EVERY DAY and couldn't get through to anyone. So frustrating!!!

I used a service called Claimyr (claimyr.com) to finally get through to ESD after my hearing when payments weren't showing up. They basically hold your place in line and call you when an agent is available. Saved me hours of frustration trying to get through the phone system. Two days later my payments started coming through including all back payments. Definitely worth calling to check on the status about a week after your hearing.

Make sure you understand exactly what the judge decides at your hearing!! I thought I won my appeal but actually only won on one issue and still had another disqualification I didn't even know about. I spent WEEKS wondering why my payments didn't restart. Finally got through to ESD and they explained I needed to address the second issue separately. Also, do NOT stop filing weekly claims while you wait. I repeat: KEEP FILING EVERY WEEK even though they show as disqualified. If you win your appeal, you'll only get paid for weeks you actually filed claims for.

That's good advice, thank you. I definitely have two separate issues they're addressing in the hearing. I've been careful to keep filing every week even though it feels pointless seeing them all stack up as disqualified. At least now I know that's the right thing to do.

Something I forgot to mention earlier - if your appeal is successful, make sure to check your payment history once payments resume. Sometimes ESD misses paying certain weeks or calculates the wrong benefit amount for some weeks. I had to call them to fix two weeks they somehow skipped even though I had filed claims for them. Also, interest does NOT accrue on back payments owed to you, in case you were wondering.

omg yes check EVERYTHING when they finally pay you!!! they owed me for 6 weeks but only paid 4 at first. had to call and argue with them to get the other 2 weeks. so annoying!!

Thanks everyone for the helpful info. I'll definitely keep filing my weekly claims, and I'll plan to contact ESD about 10 business days after the hearing if I don't see any movement. I've been documenting everything carefully, so hopefully that helps if there are any issues. Still worried about making January rent, but at least I have a better idea of the timeline now. I'm going to look into those emergency rental assistance programs just as a backup plan.

That's a good plan. Just make sure to take detailed notes during your hearing - especially about which specific issues the judge is deciding on and what their ruling is for each one.
