Can you get unemployment when you get fired in Washington?
Got terminated from my job last week and honestly not sure if I can even apply for unemployment benefits. My manager said it was due to performance issues but I feel like they were setting me up to fail. I've been working in retail for 3 years and never had problems before. Does Washington ESD even approve claims when you get fired instead of laid off? Really stressed about making rent next month.

Yes you can definitely apply! Getting fired doesn't automatically disqualify you from unemployment benefits in Washington. The key is whether you were terminated for 'misconduct' or not. Performance issues usually don't count as misconduct unless it was willful or repeated after warnings.

•That's a relief to hear. They did give me a couple warnings but I was trying my best. Should I mention the warnings when I file my claim?

•Be honest about everything when you file. Washington ESD will investigate and contact your employer anyway. Better to be upfront than have them find out later.

File your claim ASAP! Don't wait. Even if they deny it initially you can appeal. I got fired from my warehouse job for being late too many times and still got approved after explaining my situation.

•How long did the whole process take for you? I'm worried about the gap in income.

•Took about 3 weeks total but I had to go through adjudication. Worth it though - got backpay for the waiting period.

The Washington ESD looks at the specific reason for termination. 'Misconduct' has a very specific legal definition - it has to be willful disregard of employer interests or deliberate violation of rules. Poor performance, inability to do the job, or personality conflicts usually don't qualify as misconduct.

•This is exactly what I needed to know. They said I wasn't meeting sales targets but I was trying. That shouldn't count as misconduct right?

•Correct - not meeting performance standards when you're making a good faith effort is not misconduct. Document everything you can remember about your termination.

•What if they fired you for attendance issues though? I've been wondering about my own situation.

Had a similar situation last year and couldn't get through to Washington ESD for weeks to check on my claim status. Was so frustrated until someone here recommended Claimyr (claimyr.com). They have this service that calls Washington ESD for you and gets you connected to an actual person. Saved me hours of busy signals and hangups.

•Never heard of that before. How does it work exactly?

•You just give them your info and they call Washington ESD repeatedly until they get through, then conference you in. They have a video demo at https://youtu.be/7DieNd3C7zQ that shows how it works. Super helpful when you need to talk to someone about your claim.

•That actually sounds really useful. I've been trying to call for days about my own claim.

THE SYSTEM IS RIGGED!!! They'll find any excuse to deny your claim. I got fired for 'insubordination' which was complete BS - I just questioned a policy that made no sense. Still fighting it 2 months later.

Rajiv Kumar
•That sounds terrible. Did you try appealing?

Sophie Hernandez
•Yeah I'm in the appeal process now. Have a hearing next month. The whole thing is a nightmare.

•Insubordination cases can be tricky. It depends on what exactly happened and how it was documented. Don't give up on the appeal.

Update: I filed my claim online through the Washington ESD website. It was pretty straightforward. Now I'm waiting to see if they approve it or if it goes to adjudication. Fingers crossed.

•Good for you! Make sure you keep filing your weekly claims even while waiting for a decision.

•Yes definitely keep filing weekly. If you get approved you'll get backpay for those weeks.

I'm in a similar boat. Got fired for 'attitude problems' which I think is just code for standing up for myself. Really hoping Washington ESD sees through their BS.

•That's frustrating. Make sure you document your side of the story and any witnesses if this goes to adjudication.

•Good idea. I do have a couple coworkers who saw what really happened.

Been trying to call Washington ESD for days about my own claim. Anyone else having trouble getting through? It's like they don't want to help people.

•Try that Claimyr service I mentioned earlier. Seriously saved my sanity when I couldn't get through.

•Might have to look into that. This is ridiculous.

Quick question - if you get fired do you still have to do the job search requirements?
0 coins
Chloe Delgado
•Yes, you still need to meet the work search requirements once your claim is approved. You need to make 3 job contacts per week and register with WorkSource.

•Thanks, wasn't sure about that part.

I got fired from my last job for being 10 minutes late three times in a month. Still got unemployment though. Sometimes employers try to scare you into not applying.

Rajiv Kumar
•That's encouraging. How long did it take to get approved?

Ryan Kim
•About 2 weeks. No adjudication needed in my case.

Just want to add that even if you get denied initially, APPEAL IT. I know people who got denied the first time but won on appeal. Don't give up.

Rajiv Kumar
•Good to know. How long do you have to file an appeal?

Zoe Walker
•You have 30 days from the date of the determination letter to file an appeal.

Honestly the worst part is the waiting. Filed my claim 3 weeks ago and still haven't heard anything. Bills don't stop coming.

•This is exactly why I used Claimyr to get through to someone at Washington ESD. Being able to actually talk to a person and get updates on your claim status is huge.

•Yeah I'm definitely going to check that out. Thanks for the tip.

Got fired for 'violating company policy' but it was such a minor thing. Wore the wrong color shirt one day. Hopefully Washington ESD doesn't consider that misconduct.

Chloe Delgado
•That sounds like it would be considered a minor infraction, not misconduct. Especially if it was a first offense.

•It was my first time doing anything wrong too. Fingers crossed.

Remember to keep records of everything. Save emails, texts, any documentation from your employer. You might need it for your claim.

Rajiv Kumar
•Good point. I should probably write down everything I remember about my termination while it's still fresh.

Natalie Chen
•Exactly. Details matter if this goes to adjudication or appeal.

Anyone know if getting fired affects how much you get in benefits? Or is it the same as being laid off?
0 coins
Chloe Delgado
•The benefit amount is the same regardless of how you became unemployed. It's based on your previous earnings, not the reason for separation.

Santiago Martinez
•Oh that's good to know. I was worried they'd give me less because I got fired.

The key is being honest on your application. Washington ESD will find out the truth anyway when they contact your employer.
0 coins
Rajiv Kumar
•Yeah I definitely plan to be completely honest. No point in lying about it.

Samantha Johnson
•Smart approach. Lying on the application is a surefire way to get denied.

My brother got fired from his construction job for safety violations and still got unemployment. It really depends on the specific circumstances.
0 coins
Rajiv Kumar
•That's surprising. I would think safety violations would count as misconduct.

Nick Kravitz
•I think it was because he wasn't properly trained on the equipment. Employer's fault more than his.

Don't let your employer intimidate you into not filing. Some bosses will try to scare you by saying you can't get benefits if you're fired. That's not true.
0 coins
Rajiv Kumar
•My manager did kind of hint at that actually. Said I probably wouldn't qualify for anything.
0 coins
Hannah White
•They're probably just trying to discourage you from filing. Don't listen to them.

Make sure you understand the difference between being fired 'for cause' vs 'without cause'. Makes a big difference for your claim.
0 coins
Rajiv Kumar
•What's the difference exactly?
0 coins
Michael Green
•For' cause means misconduct or serious rule 'violations. Without' cause is more like layoffs or performance issues. Without cause is much easier to getbenefits.

Bottom line - file your claim no matter what. Worst case scenario they deny it and you appeal. Best case you get approved right away. Nothing to lose by trying.

Rajiv Kumar
•You're absolutely right. I'm glad I filed when I did. Now just playing the waiting game.
