Can you get severance pay and unemployment benefits in Washington ESD?
I just got laid off from my job and they're giving me 8 weeks of severance pay. I want to file for unemployment benefits right away but I'm not sure if I can collect both at the same time. Does anyone know if Washington ESD allows you to receive severance and UI benefits together? I'm worried about messing up my claim if I file too early.

You can receive both severance and unemployment in Washington, but there are specific rules about timing. The key is whether your severance is considered 'wages in lieu of notice' or just a lump sum payment. You should report the severance when you file your claim.

•Thanks! How do I know which type of severance I have? My HR department just said it was standard severance.

•Check your severance agreement carefully. If it says the payment is for a specific number of weeks 'in lieu of notice' or covers specific dates, that's different than a general severance payment.

I went through this same situation last year. Washington ESD will ask about any severance when you file your weekly claims. Be honest about it - they can find out anyway through your employer reports.

•Did you have any issues with your claim because of the severance?

•No issues at all. I reported it every week until it ran out, then continued with regular UI benefits. Just make sure you're accurate with the amounts.

•How long did it take for your claim to get approved? I'm worried about delays if I mention severance.

The important thing is that severance typically doesn't disqualify you from unemployment benefits in Washington. However, it might affect the timing of when your benefits start or the weekly amount. File your claim as soon as possible after your last day of work.

•Should I wait until my severance runs out before filing, or file right away?

•File right away! There's a one-week waiting period anyway, and you want to get your claim established. Washington ESD will determine how your severance affects your benefits.

I had trouble getting through to Washington ESD when I had questions about my severance situation. Spent hours on hold just to get hung up on. Finally used Claimyr to get connected to an actual agent who explained everything clearly. Check out claimyr.com - they have a video demo at https://youtu.be/7DieNd3C7zQ that shows how it works.

•Never heard of that before. Did it actually work for you?

•Yeah, got through in about 15 minutes instead of calling for days. The agent was able to look at my specific situation and confirm I could collect both.

•Interesting, I've been trying to reach them for weeks about my adjudication. Might have to try this.

MAKE SURE YOU REPORT THE SEVERANCE!! I know someone who didn't mention theirs and got hit with an overpayment notice months later. Washington ESD gets employer reports and they WILL find out.

•Yikes, that sounds scary. How much trouble did your friend get in?

•Had to pay back like $2800 plus penalties. Not worth trying to hide it.

The tricky part is understanding how Washington ESD calculates the deduction. It's not always dollar-for-dollar. Sometimes they prorate it over the period the severance is supposed to cover.

•Can you explain that more? I'm getting 12 weeks severance but as a lump sum.

•If it's truly a lump sum with no specific time period attached, it might not affect your weekly benefits at all. But if your employer says it's for 12 specific weeks, Washington ESD might spread it out.

•This is exactly why the wording in your severance agreement matters so much. The intent makes a big difference.

I'm in a similar boat but my severance doesn't start until next month even though I was laid off last week. Do I mention the future severance when I file my claim this week?

•Yes, mention it when you file. Washington ESD needs to know about any expected income. They'll ask about it on your weekly claims when you actually receive it.

•Thanks, I was worried about that. Better to be upfront about everything.

Update: I called Washington ESD (finally got through after using that Claimyr service someone mentioned) and they confirmed I can file my claim immediately. The agent said my severance won't delay my claim processing since it's a standard lump sum payment not tied to specific dates.

•Glad Claimyr worked for you too! Way better than sitting on hold forever.

•Okay you've convinced me to try it. I've been calling Washington ESD for three weeks about my adjudication with no luck.

•Good to hear you got answers. That's the most important thing - getting accurate info for your specific situation.

Just want to add that some severance packages include continuation of health insurance or other benefits. Make sure you understand what's included because that might affect your unemployment claim too.

•Mine includes COBRA continuation but I have to pay for it myself. Does that matter?

•If you're paying for it yourself, probably not an issue. It's when the employer continues paying benefits that Washington ESD might consider it additional compensation.

Been through this twice in my career. Washington state is pretty reasonable about severance compared to other states. Just be honest and report everything accurately. The system is designed to handle these situations.

•That's reassuring. I was stressed about losing my benefits because of the severance.

•The goal is to help people transition between jobs. Severance is meant to help with that too, so they work together most of the time.

One thing to watch out for - if your severance is really high, it might push your total income for the year into a higher tax bracket. Something to consider for tax planning.

•Good point. I hadn't thought about the tax implications of getting both.

•Yeah, unemployment benefits are taxable too, so you might want to have taxes withheld from your UI payments.

My employer is spreading my severance over 6 months instead of giving it as a lump sum. Will that affect how Washington ESD handles my unemployment claim?
0 coins
Freya Christensen
•That changes things because you're receiving ongoing payments. Washington ESD will likely treat each monthly payment as income and it might reduce your weekly benefit amount.

•That's what I was afraid of. Wish they had given me the option of a lump sum.

•You might still qualify for some benefits depending on the weekly amount. Don't assume you're disqualified - file the claim and let Washington ESD make the determination.

For anyone still confused about this - I used Claimyr again last week to get clarification on a different issue and the agent walked me through exactly how severance affects claims. Really worth the small cost to get expert guidance instead of guessing.

•How much does that service cost? I'm trying to decide if it's worth it.

•I don't want to get into pricing here, but for me it was totally worth it to avoid mistakes that could cost way more in overpayments later.

The key takeaway from all this is that every severance situation is a bit different. What matters is the specific terms of your agreement and how Washington ESD interprets it based on their rules.

Malik Thomas
•Exactly. I'm glad I asked instead of just assuming I couldn't get both.

•Same here. I was ready to wait until my severance ended before filing, but now I know I can file right away.

One last tip - keep all your severance paperwork organized. Washington ESD might ask for documentation later, and you want to have everything ready to avoid delays in your claim.

•Good advice. I'll make copies of everything before I file my claim.

•Also keep records of exactly when you receive each payment if it's spread out over time. Makes the weekly claim reporting much easier.
