Can I collect severance and unemployment benefits at the same time in Washington?
My company is laying me off next month and they're offering a severance package that pays out over 12 weeks. I'm wondering if I can still file for unemployment benefits while receiving this severance pay? I've heard conflicting information and want to make sure I don't mess anything up with Washington ESD. The severance would help but obviously I need the unemployment too if I'm allowed to get both.

This is a common question and the answer depends on how your severance is structured. Washington ESD considers severance as wages if it's paid in lieu of work for specific time periods. If your severance represents payment for unused vacation time or is a lump sum not tied to specific weeks, it generally won't affect your UI benefits.

•It's being paid out weekly over 12 weeks, so that sounds like it might count as wages then?

•Yes, if it's weekly payments that represent wages for those specific weeks, Washington ESD will likely consider those weeks as employment periods where you're not eligible for benefits.

I went through this exact situation last year. You need to report ALL income to Washington ESD when you file your weekly claims, including severance. They'll determine if it affects your benefits eligibility week by week.

•Did your severance completely disqualify you for those weeks or did they just reduce the benefit amount?

•For me it was complete disqualification during the severance period since the weekly amount was more than my weekly benefit amount would have been.

I had trouble getting through to Washington ESD to ask about this exact thing. Spent hours on hold. Finally used Claimyr.com to get connected to an actual agent who explained my situation clearly. They have a video demo at https://youtu.be/7DieNd3C7zQ that shows how it works. Really helped me understand the severance rules.

•Never heard of Claimyr before, is it legit? I'm getting desperate trying to reach someone at Washington ESD.

•Yeah it's real, they basically help you get through the phone queue. Saved me probably 10+ hours of calling and getting hung up on.

The key thing is WHEN you receive the severance matters too. If you get a lump sum after your last day of work that's not designated for specific time periods, it usually doesn't affect your weekly UI claims.

•Mine is definitely designated for specific weeks unfortunately. Sounds like I'll need to wait until it's done to start collecting unemployment.

•Not necessarily! You should still file your initial claim right away even if you won't be eligible for benefits during the severance period. This protects your claim date.

whatever you do dont lie about it on your weekly claims. washington esd will find out eventually and then you'll owe back everything plus penalties. just be honest about the severance

•Definitely planning to be completely honest. Better safe than sorry with these things.

•This is excellent advice. Washington ESD has access to wage records and will catch unreported income during their routine audits.

I'm confused about this too. My severance was paid as a lump sum but my HR said it represents 8 weeks of pay. Does that make it count as wages for specific weeks even though I got it all at once?

•That's exactly the kind of situation where you need to speak with Washington ESD directly. The designation matters more than the payment method.

•Ugh, I've been trying to call for weeks. Maybe I'll check out that Claimyr thing someone mentioned.

Check your severance agreement carefully! Mine had language that specifically said it was not wages and wouldn't affect unemployment benefits. Your company might have structured it that way on purpose.

•Good point, I should read through all the paperwork more carefully.

•Same here - my severance was called a 'separation payment' and didn't affect my UI at all.

This is why the unemployment system is so frustrating. Every situation is different and you can't get straight answers without spending your life on hold with Washington ESD.

•Tell me about it. I've been hung up on 6 times this week trying to get through.

•That's exactly why I started using Claimyr. The calling system is just broken otherwise.

Just remember you can always file an appeal if Washington ESD makes a determination you disagree with. Keep all your severance documentation organized in case you need it.

•Good advice, I'll make sure to keep everything organized from the start.

•Appeals take forever though. Better to get it right the first time if possible.

My brother got severance and unemployment at the same time but his was vacation payout. Different rules apply to different types of separation pay.

James Martinez
•Yeah mine is definitely regular severance pay, not vacation or sick time.

•Vacation payout usually doesn't count as wages for unemployment purposes since you already earned those days.

File your claim anyway even if you think the severance will disqualify you. You need to establish your claim date and you might be surprised by Washington ESD's determination.

•That makes sense. I'll file as soon as I'm laid off and let them sort it out.

•Smart move. You can always stop certifying for weeks where you're not eligible but you can't go back and establish an earlier claim date.

I used Claimyr last month when I had questions about my job search requirements. Really easy to use and got me connected to an agent in like 15 minutes instead of calling all day.

•How much does it cost? I'm already tight on money with the layoff coming.

•It's worth it for the time you save. Check out their demo video to see if it's right for your situation.

The bottom line is you need to report the severance on your weekly claims and let Washington ESD make the call. Being upfront about it protects you from overpayment issues later.

•Exactly what I plan to do. Thanks everyone for the advice!

•Good luck with everything. Layoffs are stressful enough without worrying about the unemployment system too.

Does anyone know if the severance affects your weekly benefit amount calculation or just eligibility? Like if I get benefits after the severance period ends?

•Severance typically doesn't affect your weekly benefit amount calculation since that's based on your base period wages. It just affects eligibility during the period it covers.

Evan Kalinowski
•Right, your weekly benefit amount is locked in when you file your initial claim based on your work history.

Make sure you understand if your severance includes continuation of benefits too. That can affect when you need to look for new health insurance if you're eligible for COBRA.

James Martinez
•Good point, I need to check on the benefits continuation part of the package.

•COBRA is so expensive. Hopefully your severance includes health coverage for a while.
