Can you get Washington ESD unemployment while on short term disability?
I'm currently receiving short term disability through my employer's insurance plan for a back injury that happened 3 months ago. My doctor says I might be cleared to return to work in another month, but my employer just told me they're eliminating my position due to budget cuts. Since I'm technically still employed but can't work right now, can I apply for Washington ESD unemployment benefits? Or do I have to wait until my disability period ends? This whole situation is confusing and I'm worried about how I'll pay bills once my STD runs out.

This is actually a complex situation that comes up more often than you'd think. Generally, you can't collect Washington ESD unemployment benefits while receiving short term disability because you have to be able and available for work to qualify for UI. However, if your employer eliminated your position, that changes things once your disability ends.

•So I have to wait until I'm cleared by my doctor to work again before I can even apply?

•Exactly. The able and available requirement is pretty strict. You need medical clearance first.

Been through something similar last year. You definitely can't double dip - can't get both STD and unemployment at the same time. But here's what I learned: if your job is gone when you're cleared to return, you can absolutely file for Washington ESD benefits then. Make sure you document everything about the position elimination.

•Did you have any trouble with Washington ESD when you applied after disability? I'm worried they'll question the gap.

•Nope, no issues. Just had to explain the situation during the initial claim interview. They understood.

Word of advice - when you do apply for UI benefits, you might need to talk to someone at Washington ESD to explain your situation since it's not straightforward. I spent weeks trying to get through on the phone when I had a similar issue. Finally used this service called Claimyr (claimyr.com) that helped me get connected to an actual agent. They have a video demo at https://youtu.be/7DieNd3C7zQ that shows how it works.

•How much does something like that cost? I'm already stressed about money.

•It was worth it for me to avoid the endless busy signals. Much less stressful than calling hundreds of times.

•Never heard of Claimyr but the phone situation with Washington ESD is absolutely ridiculous. Might be worth checking out.

WAIT HOLD ON. If your employer eliminated your position while you were on disability, isn't that potentially wrongful termination?? You might want to talk to an employment lawyer before worrying about unemployment benefits.

•I wondered about that too but they eliminated several positions, not just mine. Seems like legitimate budget cuts unfortunately.

•Still might be worth a consultation. Some lawyers will review the situation for free.

This exact thing happened to my sister in law. She was on STD for pregnancy complications and her company did layoffs while she was out. She couldn't file for unemployment until after her maternity leave ended and she was medically cleared. Then Washington ESD approved her claim without any problems.

•That's reassuring to hear. How long did it take for her claim to get approved?

•I think it was about 2-3 weeks? Pretty standard timing from what I understand.

Don't forget you'll need to register with WorkSource Washington and do job searches once you start collecting UI. Make sure you're actually ready to work before you apply because they take the able and available requirement seriously.

•Good point. I definitely don't want to mess up my claim by applying too early.

•Absolutely right. Wait until you have medical clearance in writing.

Just curious - are you getting any severance from your employer since they eliminated your position? That could affect your unemployment timing too.
0 coins
Ella Knight
•They mentioned something about severance but I haven't gotten details yet. How would that impact unemployment?

•Severance pay usually delays when you can start collecting UI benefits. You'd need to report it on your application.

The whole system is so confusing when you have overlapping situations like this. I had a friend who tried to navigate something similar and it took months to sort out because nobody at Washington ESD could give her straight answers.

•That's exactly why I mentioned Claimyr earlier. Sometimes you just need to talk to someone who actually knows the rules.

•Yeah, I'm definitely keeping that in mind for future reference.

Make sure you keep all your medical documentation and any communication about the position elimination. Washington ESD will want to see proof of both the disability period and the job loss when you apply.

•Good thinking. I'll start organizing everything now so I'm ready when the time comes.

One thing nobody mentioned - check if your state has temporary disability insurance that's separate from unemployment. Washington doesn't but some states do and it can bridge the gap.

•Washington doesn't have state disability insurance, just what employers provide or what you buy privately.

Christopher Morgan
•Right, that's why I mentioned it. Always worth double checking though.

This is such a stressful situation. I hope everything works out for you. At least it sounds like you have a clear path forward once you're medically cleared.

Just want to emphasize what others said - DO NOT apply for unemployment while still on disability. Washington ESD will deny your claim and it could complicate things later. Wait until you're 100% cleared to work.

•Understood. Better to wait and do it right than rush and mess it up.

•Exactly. Patience now will save you headaches later.

Have you considered appealing the position elimination? Sometimes companies have to follow specific procedures when laying people off while they're on medical leave.
0 coins
Ella Knight
•I'm not sure what grounds I'd have for an appeal. They eliminated multiple positions due to budget constraints.

Jayden Reed
•Still might be worth having someone review the timing and procedures they followed.

When you do file for unemployment, be prepared to explain the whole situation clearly. Write down a timeline of events so you don't forget anything important during the interview.

•That's a great idea. I'll put together a chronology of everything that happened.

The good news is that Washington ESD has dealt with situations like this before, especially with all the layoffs that happened during COVID. They should understand your circumstances.

•That's reassuring. I was worried this was too unusual of a situation.

Lauren Johnson
•Not unusual at all. Unfortunately these overlapping situations happen more than you'd think.

Don't forget to save money from your STD payments if possible. There might be a gap between when disability ends and when unemployment kicks in.

Ella Knight
•Yeah, I'm trying to budget carefully just in case there's a delay.

Quick question - when your STD ends, will you be getting any continuation of health insurance? That's another thing to factor into your planning.

Ella Knight
•Good point. I'll need to check on COBRA options since I'm losing my job.
0 coins
Zane Hernandez
•Definitely look into that soon. COBRA can be expensive but you don't want a gap in coverage.

I went through something similar and the key is just being honest and upfront with Washington ESD about everything. They're more understanding than people think when you're dealing with legitimate circumstances.

•Thanks for sharing that. It helps to hear from people who've been through it.

Bottom line - wait until you're medically cleared, document everything, and then file your claim. Washington ESD should approve it once you meet the able and available requirement. Good luck!

•Remember about Claimyr if you need help getting through to Washington ESD when you do apply. Makes the whole process much less stressful.
