Can you collect Washington ESD unemployment after being on short term disability?

I was on short term disability through my employer for about 4 months due to a back injury. The disability benefits just ended last week and my doctor cleared me to return to work, but when I contacted my employer they said my position was eliminated during restructuring. Now I'm wondering if I can file for unemployment benefits through Washington ESD since I'm able to work again but don't have a job to return to. Has anyone been in this situation before? I'm not sure if being on disability affects my eligibility for UI benefits.

Yes, you can definitely apply for unemployment benefits after short term disability ends, as long as you're now able and available for work. The key is that you need to be physically capable of working and actively seeking employment. Since your doctor cleared you and your job was eliminated, you should qualify.

That's a relief to hear! Do I need to provide any documentation from my doctor proving I'm cleared to work?

It's not required upfront, but Washington ESD might request medical documentation if they have questions about your ability to work. I'd keep that clearance letter handy just in case.

I went through something similar last year. The main thing Washington ESD cares about is whether you're able and available for work NOW. Since you were on legitimate medical leave and your position was eliminated while you were out, that's not considered quitting or being fired for misconduct.

Did you have any issues with the application process? I'm worried they might think I quit my job or something.

Nope, it was pretty straightforward. Just be clear on your application that you were on approved medical leave and your position was eliminated due to restructuring, not performance issues.

This is good info. I'm dealing with something similar but haven't been cleared by my doctor yet.

One thing to watch out for - make sure there's no overlap between when your disability benefits ended and when you file for unemployment. Washington ESD doesn't allow you to collect both at the same time since disability means you can't work and unemployment requires you to be available for work.

Good point. My disability ended last Friday and I got medical clearance on Monday, so there shouldn't be any overlap.

I had this exact situation happen and had trouble getting through to Washington ESD to explain the timeline. Spent hours on hold trying to reach someone who could help sort it out. Finally found this service called Claimyr (claimyr.com) that helped me get connected to an actual agent. They have a video that shows how it works: https://youtu.be/7DieNd3C7zQ. Made the whole process way less stressful.

Wait, I'm confused. If your employer eliminated your position while you were on disability, wouldn't that be considered a layoff rather than you becoming unemployed after disability ended?

Mateo Perez

•

That's a good distinction. It would technically be a layoff, but the timing matters for when you can start collecting benefits. You can't collect UI while on disability, so even if you were laid off during that time, your benefits would start when you became able and available for work.

So I should mention on my application that I was laid off while on medical leave? I want to make sure I explain this correctly.

Mateo Perez

•

Exactly. Be transparent about the timeline - you were on approved medical leave, your position was eliminated during that time, and now you're able to work but have no job to return to.

this happened to my sister except her company fired her while she was on disability which was totally illegal but thats another story. anyway she got unemployment no problem once she was cleared to work again

Wow that's terrible! At least my company was decent about it and it was just restructuring, not retaliation.

Companies can be such jerks about this stuff. Glad yours handled it properly.

One more thing to consider - your benefit amount will be based on your earnings before you went on disability, not the disability payments. So if you were making good money before the injury, your UI benefits should reflect that.

Nia Davis

•

That's actually really helpful to know. I was worried my benefits would be calculated based on the lower disability payments.

•

Nope, Washington ESD looks at your base period earnings from actual employment, not disability or other non-work income.

This is really useful information. I had no idea how they calculated the benefit amounts.

You should also be prepared for potential adjudication since your case is a bit complex with the disability situation. Washington ESD might need extra time to review your eligibility, but don't let that scare you off from applying.

What exactly is adjudication? I keep seeing that term but don't really understand what it means.

0 coins

Adjudication is just when Washington ESD needs to investigate your claim more thoroughly to determine eligibility. It can add a few weeks to the process, but it's pretty routine for situations involving medical leave or job separations that aren't straightforward.

I've been stuck in adjudication for over a month on a much simpler case! The wait times are brutal right now.

Don't forget you'll need to do your weekly claims and job search activities once you start receiving benefits. Since you're coming off medical leave, make sure you're actually ready to start working immediately if you get a job offer.

Yeah, I'm definitely ready to get back to work. Been going stir crazy sitting at home for months!

The job search requirements are pretty specific too. Make sure you understand what counts as a valid job search activity.

Nia Davis

I'll definitely look into those requirements before I start filing weekly claims.

I had a somewhat similar situation but with workers comp instead of short term disability. The process was pretty smooth once I got all my paperwork together. The main thing is being honest and thorough in your application.

Good advice. I'll make sure to include all the relevant details about the medical leave and position elimination.

Documentation is key with these kinds of cases. Keep copies of everything!

Just want to echo what others said about being able and available for work. That's the big requirement. Since you have medical clearance and your job was eliminated through no fault of your own, you should be good to go. File as soon as possible since there can be delays in processing.

If you run into any issues getting through to Washington ESD during the process, don't hesitate to use services like Claimyr to help you connect with agents. Sometimes these complex cases need direct communication to get resolved quickly.

I'll definitely keep that in mind if I need to speak with someone directly. Thanks for the tip!

Yeah, trying to get through on your own can be a nightmare with their phone system.

One last thing - make sure you file your claim for the correct week. Don't backdate it to when your disability ended if you weren't actually available for work until after your doctor's clearance.

0 coins

Nia Davis

•

Good point. I should probably start my claim from the week I got medical clearance, not when disability ended.

0 coins

Miguel Ramos

•

Exactly. The effective date should be when you were both able and available to work, which sounds like it was after your doctor's appointment.

This is really detailed helpful stuff. Thanks for sharing your experience OP!
