Can I apply for Washington ESD unemployment while on short term disability?

I've been on short term disability through my employer for the past 6 weeks due to a back injury. My STD benefits are about to run out but I'm still not cleared to return to work by my doctor. Can I apply for unemployment benefits through Washington ESD while I'm still technically on disability? I'm confused about whether being on STD disqualifies me from UI benefits. My employer hasn't terminated me yet but they're saying I need medical clearance before I can come back. Anyone dealt with this situation before?

This is tricky territory. Generally you need to be able and available for work to qualify for unemployment. If you're still on disability that usually means you're not available for work.

That's what I was afraid of. So I'm stuck in limbo until my doctor clears me?

•

Not necessarily. There might be options depending on your specific medical situation and what kind of work you can do.

You need to be very careful here because Washington ESD has strict able and available requirements. If you file while unable to work due to disability, you could end up with an overpayment situation later. However, if your doctor says you can do some types of work but not your previous job, that might be different. You'd need to document everything properly.

My doctor hasn't said I can do other work, just that I can't do my regular job which involves heavy lifting. Should I ask about desk work or something?

Yes, get specific documentation about what you can and cannot do work-wise. If you can perform some types of work, that changes things significantly for your UI eligibility.

I was in a similar spot last year. Couldn't get through to Washington ESD on the phone to get clarification on my situation. Kept getting disconnected after waiting hours. Finally found this service called Claimyr that helped me get through to an actual agent. They have a website at claimyr.com and there's a demo video at https://youtu.be/7DieNd3C7zQ showing how it works. Really saved me from making a costly mistake with my claim.

How does that work exactly? I've been trying to call Washington ESD for days.

They basically help you get through the phone system and connect with an actual ESD agent. Way better than sitting on hold for hours just to get hung up on.

Is that legit? Never heard of paying someone to make phone calls for you.

whatever you do dont lie on your application about being able to work if you're still on disability. thats fraud and they will catch you eventually

Definitely don't want to commit fraud. That's why I'm trying to figure out the rules before I apply.

Good call. Better to ask first than deal with overpayment demands later.

The key issue is the 'able and available' requirement. You need to be physically able to work and available to accept suitable work. If your disability prevents you from working entirely, you wouldn't qualify. But if you can work in some capacity - like light duty or different type of work - you might still be eligible. The timing of when your STD ends versus when you apply for UI also matters.

My STD ends next Friday. Should I wait until after that to apply for unemployment?

Sergio Neal

•

That would probably be safer. You don't want overlapping benefits. Apply after STD ends and make sure you can honestly answer yes to being able and available for work.

Also make sure you understand what 'suitable work' means in your situation. Washington ESD might consider work you physically can do as suitable even if it's different from your regular job.

Been through this exact situation. You absolutely cannot collect unemployment while receiving disability benefits - that's double dipping and Washington ESD will flag it. Wait until your STD period officially ends, then apply for UI if you meet the able and available requirements.

Did you have to provide medical documentation when you applied after your disability ended?

Elin Robinson

•

Yes, I had to get a letter from my doctor stating I was cleared to return to work. Washington ESD wanted proof I was actually able to work before approving my claim.

This whole system is so confusing! Why can't they just have clear answers for these situations?

Because every situation is different and they want to review each case individually. Pain in the butt but probably prevents a lot of fraud.

yeah the rules are definitely not user friendly

One thing to consider - if your employer is holding your job open while you're on disability, you might not qualify for unemployment anyway since you technically still have employment. UI is for people who are unemployed through no fault of their own.

They're saying they'll hold it open but only if I get medical clearance soon. It's not guaranteed.

0 coins

That's still considered having a job available to you. You'd need to actually be separated from employment to qualify for UI benefits.

Unless they terminate you for inability to perform job duties, then you might have grounds for UI. But that's getting into complicated territory.

My cousin used that Claimyr thing someone mentioned earlier when she couldn't get through to Washington ESD about her claim status. Said it was worth it just to avoid the hours of hold time. Might be worth looking into if you need to talk to someone there directly about your specific situation.

I'm definitely going to check that out. These phone systems are impossible.

Same here. Spent 3 hours on hold yesterday just to get disconnected when they closed.

Have you looked into Washington State's Paid Family and Medical Leave program? Might be another option to bridge the gap between your STD ending and being able to return to work.

Freya Ross

•

I hadn't thought of that. Is that different from regular unemployment benefits?

0 coins

Kiara Greene

•

Yes, it's specifically for people who can't work due to their own serious health condition. Might be more appropriate for your situation than UI.

Good point. PFML might actually be the right program here instead of unemployment insurance.

Whatever you decide make sure you keep detailed records of everything - medical appointments, correspondence with your employer, benefit applications, etc. If there are any issues later you'll want documentation.

Good advice. I've been keeping everything but I'll make sure I'm more organized about it.

Yeah learned that lesson the hard way. Washington ESD loves their paperwork.

Just to add another perspective - I had a friend who tried to file for unemployment while still technically on disability and it created a huge mess. Took months to sort out and she almost had to pay back benefits. Really recommend getting everything sorted with your medical situation first.

That's exactly what I want to avoid. Thanks for sharing that.

Yeah those overpayment notices are no joke. Better to be cautious.

Which is why talking to an actual Washington ESD agent is so important. They can tell you exactly what applies to your situation instead of guessing.

Bottom line - you can't collect unemployment if you're not able and available for work. If your doctor hasn't cleared you to work, you're probably not eligible yet. Wait until you have medical clearance or at least documentation that you can perform some types of work.

That makes sense. I'll wait until I have clearer medical guidance before applying.

Smart move. Better safe than sorry with these things.
