Can you get Washington ESD unemployment if you owe child support - worried about garnishment

I'm about to file for unemployment benefits through Washington ESD but I'm behind on child support payments. I owe about $4,200 and haven't been able to keep up since I lost my job 2 weeks ago. Will they deny my unemployment claim because of the back child support? Or will they just take money out of my benefits? I really need these benefits to survive but I'm scared they'll either reject me completely or take so much that I can't pay rent. Has anyone dealt with this situation before?

You can still get approved for unemployment even with child support debt. Washington ESD doesn't deny claims based on owing child support. However, they will garnish your weekly benefits - I think it's up to 50% that can be taken for child support obligations.

50%?? That would leave me with like $200 a week. How am I supposed to survive on that?

0 coins

It's actually better than having no income at all though. At least you'd have something coming in while you look for work.

0 coins

The child support garnishment happens automatically once your claim is approved. Washington ESD coordinates with the Division of Child Support (DCS) and they'll start withholding from your first payment. You should still file immediately though - don't let the fear of garnishment delay your claim.

0 coins

Should I contact DCS before filing or just let it happen automatically?

0 coins

You can contact them to discuss a payment plan, but the garnishment will happen regardless. Might be worth calling to see if they can work with you on the amount.

I've been trying to get through to Washington ESD for weeks about my claim status but can never reach anyone. The phone lines are always busy or I get disconnected after waiting forever. Has anyone found a better way to actually talk to someone there?

0 coins

I was having the same problem until someone told me about Claimyr. It's a service that helps you get through to Washington ESD agents by phone. I used it last month and actually got connected within an hour. Here's their site: claimyr.com and they have a demo video showing how it works: https://youtu.be/7DieNd3C7zQ

0 coins

That actually sounds helpful. I'm desperate at this point. Did they charge you a lot for it?

0 coins

They focus more on getting you connected quickly rather than cost. Way better than spending entire days trying to call and getting nowhere.

0 coins

wait so they can take half your unemployment?? that seems like way too much especially when you're already struggling

0 coins

It's federal law for child support enforcement. They can garnish wages, unemployment, tax refunds, pretty much any income.

0 coins

Yeah it sucks but kids need support too. At least he's getting something instead of nothing.

0 coins

This happened to my brother last year. He owed like $6k in back support and they took about 40% of his weekly unemployment. It was rough but he managed to get by. The important thing is to file right away because there's a waiting period anyway.

0 coins

How long was his waiting period? I heard it's different now after COVID.

0 coins

I think it was just one week. But he had some adjudication issues that took like 3 weeks to resolve, so it was a month before he saw any money.

0 coins

The system is so broken. They'll take money for child support but won't help you get through to actually file your claim or fix problems. I've been waiting 2 months for my adjudication to clear and can't reach anyone at Washington ESD to explain what's happening.

0 coins

Have you tried that Claimyr thing someone mentioned earlier? I'm thinking about using it myself since I can't get through either.

0 coins

No I haven't heard of it. What is it exactly?

0 coins

It's a service that helps you get connected to Washington ESD agents. The person who mentioned it said they got through in an hour instead of spending days calling.

0 coins

You definitely need to file ASAP. Every week you wait is a week of benefits you can't get back. Even if they garnish some for child support, you'll still have income. Plus you need to start your job search requirements right away.

0 coins

What are the job search requirements? I haven't worked in unemployment in Washington before.

0 coins

You need to make 3 job search contacts per week and keep a log. They can audit it anytime so make sure you document everything properly.

0 coins

Actually I think it's 2 job search contacts per week now, not 3. But yeah definitely keep good records.

0 coins

I'm confused about something - does the child support garnishment start immediately or do you get a few payments first? I'm in a similar situation and need to know what to expect.

0 coins

It typically starts with your first payment. The systems are connected so once Washington ESD processes your claim, DCS is notified automatically.

0 coins

That's what I was afraid of. Guess I better prepare for a smaller first payment then.

0 coins

Can you appeal the garnishment amount if it's too high? Like if taking 50% would leave you homeless?

0 coins

You can't really appeal the garnishment through Washington ESD, but you might be able to work with DCS on a hardship modification. You'd need to show your living expenses and income.

0 coins

Good luck with that. DCS doesn't care if you're homeless as long as they get their money.

0 coins

Well that's encouraging... not.

0 coins

Make sure you file online through the SecureAccess Washington portal. It's faster than trying to call or go in person. You'll need your Social Security number, driver's license, and employment history for the past 18 months.

0 coins

Thanks for the tip. Is there anything else I should have ready before I start the application?

0 coins

Bank account info for direct deposit, and make sure you have exact dates and wages from your recent jobs. The more accurate you are upfront, the less likely you'll have adjudication issues.

I hate to be that person but... maybe try to get caught up on child support when you do find work again? Those kids are depending on that money too.

0 coins

Trust me, I want to pay. I lost my job because the company downsized. It's not like I'm trying to avoid my responsibilities.

0 coins

Mei Lin

I get it, sorry if that came across wrong. Losing a job sucks and having garnishments on top of it makes everything harder.

0 coins

The whole system is designed to keep people down. How are you supposed to get back on your feet when they take half your unemployment?

0 coins

Does anyone know if the garnishment applies to the extra $300 pandemic payments too? Or just the regular state benefits?

0 coins

There aren't any extra pandemic payments anymore. Those ended in 2021. You'll just get regular state unemployment benefits now.

0 coins

Oh right, I forgot those were over. Shows how long it's been since I needed unemployment.

0 coins

Whatever you do, don't let owing child support stop you from filing. A reduced unemployment check is still better than no check at all. And if you don't file within a certain time frame, you could lose benefits entirely.

0 coins

How long do I have to file? I was laid off 2 weeks ago but haven't filed yet.

0 coins

You should file immediately. There's no specific deadline but you want to start the process ASAP. The sooner you file, the sooner you can start receiving benefits.

0 coins

I used Claimyr a few months ago when I couldn't get through to Washington ESD about my pending claim. Honestly it was a lifesaver - I had been calling for weeks with no luck and they got me connected the same day I used their service. Worth every penny when you're desperate to talk to someone.

0 coins

How does it work exactly? Do you just pay them and they call for you?

0 coins

They have a system that helps you get through the busy phone lines more efficiently. Check out their demo video at https://youtu.be/7DieNd3C7zQ - it explains the whole process.

0 coins

Just wanted to add that you should also look into other assistance programs while you're unemployed. Food stamps, rental assistance, utility help - every little bit helps especially if your unemployment is being garnished.

0 coins

Good point. I should probably apply for food stamps too since my income is going to be so low.

0 coins

Definitely. And check with 211 (dial 2-1-1) for local resources. They can point you to food banks, rent assistance programs, all kinds of help.

0 coins

One thing to keep in mind - your unemployment benefits might be taxable income, so set aside a little bit for taxes even after the child support garnishment. Don't want to get hit with a surprise tax bill next year.

0 coins

Ugh, I didn't even think about taxes. So they take money for child support AND I still owe taxes on it?

0 coins

Unfortunately yes. You can elect to have taxes withheld from your unemployment payments, which might be easier than owing a lump sum later.
