Can you get Washington ESD unemployment if you owe child support - worried about garnishment
I'm about to file for unemployment benefits through Washington ESD but I'm behind on child support payments. I owe about $4,200 and haven't been able to keep up since I lost my job 2 weeks ago. Will they deny my unemployment claim because of the back child support? Or will they just take money out of my benefits? I really need these benefits to survive but I'm scared they'll either reject me completely or take so much that I can't pay rent. Has anyone dealt with this situation before?

You can still get approved for unemployment even with child support debt. Washington ESD doesn't deny claims based on owing child support. However, they will garnish your weekly benefits - I think it's up to 50% that can be taken for child support obligations.

The child support garnishment happens automatically once your claim is approved. Washington ESD coordinates with the Division of Child Support (DCS) and they'll start withholding from your first payment. You should still file immediately though - don't let the fear of garnishment delay your claim.

The system is so broken. They'll take money for child support but won't help you get through to actually file your claim or fix problems. I've been waiting 2 months for my adjudication to clear and can't reach anyone at Washington ESD to explain what's happening.

You definitely need to file ASAP. Every week you wait is a week of benefits you can't get back. Even if they garnish some for child support, you'll still have income. Plus you need to start your job search requirements right away.

Make sure you file online through the SecureAccess Washington portal. It's faster than trying to call or go in person. You'll need your Social Security number, driver's license, and employment history for the past 18 months.

Whatever you do, don't let owing child support stop you from filing. A reduced unemployment check is still better than no check at all. And if you don't file within a certain time frame, you could lose benefits entirely.

Just wanted to add that you should also look into other assistance programs while you're unemployed. Food stamps, rental assistance, utility help - every little bit helps especially if your unemployment is being garnished.

One thing to keep in mind - your unemployment benefits might be taxable income, so set aside a little bit for taxes even after the child support garnishment. Don't want to get hit with a surprise tax bill next year.
