Can you file for unemployment before your last day - Washington ESD timing questions
My company is laying me off next Friday but I'm wondering if I can file for unemployment before then? I've heard mixed things about timing and I don't want to mess up my claim. Some people say you have to wait until after your last day of work, others say you can file ahead of time. What's the actual rule with Washington ESD? I'm worried about delays if I wait too long but also don't want to get in trouble for filing early.

You should wait until after your last day of work to file your initial claim. Washington ESD requires that you be actually unemployed when you file. If you file before your last day, it could cause issues with your claim approval.

•That makes sense. So file the Monday after my last day on Friday?

Nolan Carter
•Exactly. File on Monday or over the weekend. Just make sure you're actually unemployed when you submit the application.

I made this mistake last year and filed 2 days before my last day. Washington ESD flagged it and I had to wait weeks for adjudication to sort it out. Definitely wait until after.

•Oh no, that sounds like a nightmare. How long did the adjudication take?

•Almost 6 weeks. I couldn't get through to anyone to explain what happened. Finally used this service called Claimyr that helped me get connected to a real person at Washington ESD to straighten it out.

•Never heard of Claimyr. Is that legit?

•Yeah, it's at claimyr.com. They basically help you get through to Washington ESD agents when the phone lines are jammed. There's a demo video at https://youtu.be/7DieNd3C7zQ that shows how it works.

The rule is simple - you must be unemployed to file for unemployment benefits. Filing early can trigger an adjudication review which delays your benefits. Always wait until after your last day of work.

•What if your last day is on a Friday? Do you have to wait until Monday to file?

•You can file on Saturday or Sunday online. The Washington ESD website is available 24/7 for initial claims.

I was told by HR that I could file early but now I'm second guessing that advice. Maybe they were wrong?

•HR departments often give incorrect unemployment advice. They're not Washington ESD experts. Follow the official guidelines.

•Good point. I'll wait until after my last day to be safe.

Just went through this last month. Filed the day after my last day and had no issues. Claim was approved within a week.

•That's encouraging. Did you file online or by phone?

•Online. Much easier than trying to call. The website walks you through everything step by step.

THE SYSTEM IS RIGGED!! Why do they make it so confusing about when you can file? It's like they WANT people to mess up so they can deny claims!

•The rules are actually pretty clear if you read them. You just have to be unemployed to file for unemployment.

•Clear to WHO? I've been trying to figure this out for days and getting different answers everywhere!

Don't overthink it. Last day of work = Friday. File on Saturday or Sunday. Simple.

•Yeah, I think I was making it more complicated than it needs to be.

Here's what happens if you file early: Washington ESD will see that you had work income after your claim date and automatically flag it for review. This triggers adjudication which can take 4-8 weeks to resolve.

•This happened to my cousin. She filed on a Thursday and her last day was Friday. Took forever to get sorted out.

•Exactly. The system is designed to catch these timing issues automatically.

I was in the same boat as you OP. Company gave me notice but I waited until after my actual last day. Filed on a Saturday morning and it was super easy online.

•How long did it take to get your first payment?

Bruno Simmons
•About 2 weeks. Had to do the waiting week and then got paid the following week.

Just curious - are you getting severance pay? That might affect when you can file too.
0 coins
Daniel White
•Yeah I'm getting 2 weeks severance. Does that change anything?

Aileen Rodriguez
•You'll need to report the severance when you file. It might delay when your benefits start but you should still file right after your last day.

•Severance is reported as income for the weeks it covers. Your benefits will start after the severance period ends.

Quick question - what if your last day is on a holiday? Do you still wait until after?

Nolan Carter
•Yes, you still wait until after your last day regardless of what day of the week it falls on.

Just to add - when I had my adjudication mess from filing early, I tried calling Washington ESD for weeks. The phone system would just hang up on me after being on hold. That's when someone recommended Claimyr and it actually worked to get me through to a human.

•How much does that cost? I'm already going to be tight on money.

•It was worth it to get my claim unstuck. Way better than sitting on hold for hours just to get disconnected.

One more thing - make sure you have all your employment info ready when you file. Dates, wages, reason for separation, etc. It'll make the process go faster.

Daniel White
•Good tip. I'll gather all that info this week while I'm still employed.

•Smart. Also get your employer's contact info and your supervisor's name if you don't already have it.

Washington ESD is pretty strict about the timing stuff. Better to be safe and wait than risk delays.

Daniel White
•Definitely. I'll file on Saturday after my Friday last day.

I filed the same day as my last day (after work ended) and didn't have any problems. But I guess waiting until the next day is safer.

Tasia Synder
•That's cutting it close. Safer to wait until the next day to avoid any potential issues.

Good luck OP! The filing process is actually pretty straightforward once you get to it. Just follow the prompts and be honest about everything.

For anyone else reading this later - the key takeaway is wait until after your last day of work before filing your initial unemployment claim with Washington ESD. Don't risk the adjudication delays by filing early.
