Can teacher aides collect unemployment during summer break in Washington state?

I work as a teacher's aide at an elementary school and our last day was June 15th. I won't be back until late August when school starts again. Can I file for unemployment benefits through Washington ESD during the summer months? I heard mixed things about whether school employees can collect during breaks. My supervisor said something about 'reasonable assurance' but I'm not sure what that means for my situation. Has anyone else who works in schools been able to get benefits over summer?

It depends on whether you have reasonable assurance of returning to work. If your school district gave you a contract or letter saying you'll be back in the fall, Washington ESD will likely deny your claim. But if there's no guarantee you'll be rehired, you might qualify.

I don't have a contract for next year yet, just verbal assurance from my principal. Does that count as reasonable assurance?

0 coins

Verbal assurance usually isn't enough for Washington ESD to deny benefits. They need written documentation of reasonable assurance.

0 coins

I tried filing last summer as a substitute teacher and got denied immediately. Washington ESD said I had reasonable assurance even though I was just a sub with no guarantee of work.

0 coins

That's frustrating! Did you appeal the decision?

0 coins

Yeah I appealed but it took forever and by the time they reviewed it, school was starting again anyway.

0 coins

File anyway! The worst they can do is say no. Teacher aides often get approved because you're usually not guaranteed hours or positions year to year. Make sure to mention in your application that you don't have a written contract for fall.

0 coins

Good point, I'll file this week. Do I need to do anything special on the application?

0 coins

Just be honest about your employment situation and that you have no written assurance of work in the fall.

I've been trying to call Washington ESD for weeks about my own summer claim and can never get through! The phone system is terrible. Has anyone found a way to actually talk to someone there?

0 coins

I had the same problem until I found Claimyr.com - it's a service that helps you get through to Washington ESD agents. They have a video demo at https://youtu.be/7DieNd3C7zQ showing how it works. I was able to speak with someone within a day of using it.

0 coins

Really? That sounds too good to be true. How much does it cost?

0 coins

It's worth checking out their site for details. Way better than spending hours on hold getting nowhere with Washington ESD's regular phone system.

0 coins

the school system is so unfair to support staff!! teachers get paid all summer but we get nothing and have to scramble for other work or benefits

0 coins

I know right? It's not like we choose to not work over the summer.

0 coins

Actually teachers don't get paid all summer - their annual salary is just spread out over 12 months instead of 9. But I agree support staff get a raw deal.

0 coins

I worked as a para for 5 years and collected unemployment every summer. The key is whether your district sends Washington ESD a form saying you have reasonable assurance. Most don't bother for paraprofessionals unless you have a union contract.

0 coins

That's encouraging! Did you ever have any issues with Washington ESD questioning your eligibility?

0 coins

Nope, went through fine every year. Just had to do the weekly claims and job search requirements like anyone else.

0 coins

Wait, we have to do job searches even though we know we're going back to school in fall?

0 coins

Yep, Washington ESD doesn't care that you plan to return. You still need to show you're looking for work while collecting benefits.

0 coins

File ASAP because there's usually a waiting period. I filed in mid-June and didn't get my first payment until July. Washington ESD has to process everything and verify your wages.

0 coins

Good to know! I was hoping to get benefits right away since our last paycheck was already two weeks ago.

0 coins

Yeah unfortunately there's always a delay. But once it gets approved the payments are retroactive to when you first became unemployed.

My sister is a teacher aide in Spokane and she gets unemployment every summer. She says the trick is to not mention returning to the same job when you file your claim.

0 coins

I wouldn't recommend being dishonest on your application. That could lead to overpayment issues later if Washington ESD finds out.

0 coins

She's not lying, just not volunteering information they don't specifically ask for. There's a difference.

0 coins

Better to be upfront and honest. Washington ESD will find out about your school employment anyway when they verify your wages.

0 coins

Check with your union if you have one. They usually know the ins and outs of summer unemployment for school employees. SEIU or whoever represents support staff in your district.

0 coins

I don't think we have a union at our school. It's a smaller district.

0 coins

Even non-union districts usually have someone in HR who deals with unemployment questions. Worth asking.

0 coins

I got denied for summer unemployment as a custodian because they said I had reasonable assurance. But my friend who's a lunch lady got approved. It seems really inconsistent how Washington ESD handles school employee claims.

0 coins

That's so weird! You'd think they'd have consistent rules for all school support staff.

0 coins

Right? I think it depends on which adjudicator reviews your case and how familiar they are with school employment.

0 coins

Make sure you understand the job search requirements if you get approved. You need to log your work search activities every week and they can audit you at any time.

0 coins

How many jobs do I need to apply for each week?

0 coins

I think it's 3 job search activities per week minimum. Could be applications, networking, or other approved activities.

0 coins

It's actually 3 work search activities per week, and they have to be documented in your WorkSourceWA account.

0 coins

Whatever you do, don't wait too long to file. I waited until July thinking I needed to see if I'd find summer work first and it delayed my whole claim.

0 coins

Thanks for the warning! I'll file this weekend.

0 coins

Good idea. The sooner you file, the sooner you can start getting benefits if you're approved.

0 coins

Has anyone had luck with the Claimyr service that was mentioned earlier? I'm getting desperate trying to reach Washington ESD about my own claim issues.

0 coins

Yes, I used it last month when I couldn't get through on my own. Really made a difference in getting my adjudication issue resolved quickly.

0 coins

I was skeptical at first but tried it when I was stuck in adjudication for weeks. Worth every penny to actually talk to a real person at Washington ESD.

0 coins

Okay you've convinced me. Going to check out their site now.

0 coins

Just want to add that if you do get denied initially, you can appeal the decision. School employee cases are often overturned on appeal if you can show you don't have true reasonable assurance.

0 coins

How long does the appeal process take?

0 coins

Usually 4-6 weeks, but it can be longer during busy periods. That's why it's better to get it right the first time if possible.

0 coins

I'm a bus driver and face the same situation every summer. The uncertainty is the worst part - not knowing if you'll get benefits until you apply.

0 coins

Do you usually get approved for summer benefits?

0 coins

About half the time. It really depends on whether the district sends in paperwork saying we have reasonable assurance or not.

0 coins

Pro tip: if you get approved for unemployment but then the school calls you back early for summer work or training, you need to report that income on your weekly claims.

0 coins

Even if it's just a day or two of training?

0 coins

Yep, any income needs to be reported. Washington ESD can reduce your benefit amount for that week based on what you earned.

0 coins

Good luck with your claim! Summer unemployment saved me financially when I was working as a para. Hopefully Washington ESD approves you quickly.

0 coins

Thank you! Fingers crossed. This thread has been really helpful.

0 coins

Let us know how it goes! Always good to hear success stories for other school employees.

0 coins

One more thing - if you're thinking about taking summer classes to improve your skills, check if Washington ESD has any training programs that let you collect benefits while in school.

0 coins

I hadn't thought about that option. Are there specific programs for education workers?

0 coins

There are various workforce training programs through WorkSourceWA. Worth looking into if you want to use the summer productively.

0 coins

The whole system is frustrating but don't give up. School support staff deserve benefits during unpaid breaks just like any other worker who gets laid off seasonally.

0 coins

Exactly! We didn't choose to be unemployed over the summer.

0 coins

Right, it's not like we can work at the school when it's closed. We need income too.

0 coins

Remember to keep all your documentation from the school about your employment status. If Washington ESD questions your claim later, you'll need proof of what assurances you did or didn't receive.

0 coins

Great advice! I'll make sure to save any emails or letters from my principal about next year.

0 coins

Exactly. Paper trail is everything when dealing with unemployment claims.

0 coins

I work as a classroom aide too and successfully got unemployment benefits last summer! The key thing that helped me was being very clear in my application that I only had verbal assurance from my supervisor about returning in the fall, not any written contract or formal letter. Washington ESD approved my claim within about 3 weeks. Make sure you emphasize that your position isn't guaranteed and you have no written documentation promising you'll be rehired. Also be prepared for the job search requirements - I applied to retail and office jobs during the summer even though I knew I'd likely return to the school. It felt silly but it's required to keep getting benefits. File as soon as possible because there is definitely a waiting period!

0 coins

That's really encouraging to hear! @Laura Lopez Thanks for sharing your experience. Did you have to do anything special when explaining your employment situation to Washington ESD, or was just mentioning the lack of written assurance enough? I m'planning to file this weekend and want to make sure I phrase everything correctly on the application.
