Can felons get unemployment benefits in Washington state?
I got out of prison 8 months ago and have been working at a warehouse job since February. My employer just laid off half the crew due to budget cuts and I'm wondering if I can file for unemployment benefits with Washington ESD. I have a felony conviction from 2019 - does that automatically disqualify me from getting UI benefits? I've been paying into the system through my paychecks but I'm not sure if my criminal record affects eligibility. Has anyone with a felony record successfully gotten unemployment in Washington?

Having a felony conviction doesn't automatically disqualify you from Washington ESD unemployment benefits. The key factors are whether you lost your job through no fault of your own and if you meet the work history requirements. Since you were laid off due to budget cuts, that should qualify as job separation through no fault of your own.

•That's really helpful to know. I was worried they'd reject me automatically because of my record. Should I mention the conviction when I file or just answer honestly if they ask?

•Be honest if they ask directly, but your criminal history isn't typically part of the initial eligibility determination. Focus on your work history and reason for job separation.

I had a similar situation last year. Filed for UI benefits with Washington ESD and my felony from 2018 wasn't an issue at all. They care more about whether you're actively looking for work and available to work. The main thing is making sure you have enough work credits in your base period.

•How long did it take for your claim to get approved? I'm nervous about the whole process.

•Mine took about 3 weeks, but that was pretty standard timing. Just make sure you file your weekly claims on time even while waiting for approval.

You should be fine to apply. The main disqualifications for Washington unemployment are things like quitting without good cause or being fired for misconduct. Being laid off definitely qualifies you to receive benefits if you meet the other requirements.

•What if you were fired from a previous job for misconduct but your most recent job was a layoff? Does that affect anything?

•They typically only look at your most recent job separation for eligibility purposes. If you were laid off from your current job, that's what matters for your claim.

Just went through this myself. Had trouble getting through to Washington ESD to ask questions about my claim status. Kept getting busy signals or being put on hold for hours. Finally found this service called Claimyr (claimyr.com) that helped me get connected to an actual agent. They have a demo video at https://youtu.be/7DieNd3C7zQ showing how it works. Made the whole process way less stressful.

•How does that work exactly? Do they charge you to make the call for you?

•They basically keep calling Washington ESD for you until they get through, then connect you to the agent. Worth checking out if you run into issues reaching them.

•That's reassuring to hear. Were you able to find new jobs pretty easily while collecting benefits?

•yeah took me about 6 weeks the first time and 4 weeks the second time. just gotta keep applying and documenting your job search like they require

The job search requirements are the same for everyone regardless of criminal history. You'll need to make at least 3 job search contacts per week and keep records of your applications. WorkSourceWA can help you with job search assistance too.

•Do I need to register with WorkSourceWA right away or can I wait until after I file my claim?

•You should register with WorkSourceWA within your first week of filing. It's one of the eligibility requirements to maintain your benefits.

•I waited like 3 weeks to register and they didn't seem to care when I finally did it. But better safe than sorry I guess.

Make sure you have all your employment information ready when you file - employer names, addresses, dates of employment, and reason for separation. The Washington ESD application asks for details about your last 18 months of work history.

•I only worked at one place since getting out. Is that going to be a problem for meeting the work requirements?

•As long as you worked enough hours and earned enough wages in your base period, having one employer shouldn't be an issue. They'll calculate your benefit amount based on your earnings.

honestly the hardest part is dealing with washington esd's phone system when you have questions. i spent 4 days trying to get through to ask about my pending claim last month. finally someone told me about claimyr and they got me connected in like 20 minutes. saved me so much frustration

•Is that service legit? Seems too good to be true that they can actually get through when nobody else can.

•yeah its legit, they just keep redialing the numbers until someone picks up. way better than sitting there hitting redial yourself for hours

Your felony record shouldn't affect your unemployment benefits at all. I've been helping people navigate the Washington ESD system for years and criminal history is not one of their disqualification criteria. Focus on meeting the work requirements and being available for suitable work.

•Thank you, that makes me feel a lot better about applying. I was really worried they'd automatically deny me.

•No problem! The worst thing you can do is not apply when you're eligible. You've been paying into the system through your payroll taxes, so you've earned the right to benefits when you need them.

File as soon as possible because there's a waiting week before benefits start and you can't backdate your claim. Even if you're not sure about your eligibility, it's better to apply and let them make the determination.

•Good point about the waiting week. I'll file this weekend so I don't lose any time.

•Yeah definitely don't wait. I made that mistake and ended up losing two weeks of potential benefits because I was worried about applying.

The Washington ESD online system is pretty straightforward for filing. Just have your Social Security number, employment history, and bank account info ready for direct deposit. Takes about 30-45 minutes to complete the application.

•Do I need to have my tax returns or pay stubs when I file, or just the basic employment information?

•Just the basic info for filing. They might ask for additional documentation later if there are any questions about your earnings or employment history.

been collecting unemployment for 6 weeks now and the process has been smooth. make sure you file your weekly claims every week even if your initial claim is still pending. you can do it online or over the phone

One thing to keep in mind is that if you have any issues with your claim or need to speak with an agent, the Washington ESD phone lines get really busy. I tried calling for weeks about an adjudication issue. Someone suggested using Claimyr to get through and it actually worked - they connected me to an agent the same day I tried it.

•How much does something like that cost? I'm already stressed about money.

•It was worth it for me to avoid the stress of trying to get through myself. Check out their website for details, but getting my claim resolved was the most important thing.

Washington state doesn't discriminate based on criminal history for unemployment benefits. You earned those benefits through your work and payroll contributions. As long as you meet the standard eligibility requirements, you should be approved.

Just want to add that you should also look into any job training programs available through WorkSourceWA. Sometimes they have special programs for people with criminal backgrounds that can help with job placement.

•That's a great suggestion. I'll ask about training programs when I register with WorkSourceWA.

•Yeah they have some good programs. I did a forklift certification through them while on unemployment and it definitely helped me get my next job.
