Both weeks showing 'disqualified' on ESD claim - business closure not my fault!
I'm losing my mind trying to figure out why my ESD claim keeps saying 'disqualified' for the last two weeks! My restaurant closed permanently (the owners just decided to retire) and I filed for unemployment right away. I didn't quit and definitely wasn't fired - there's literally no business anymore! What's driving me crazy is my coworker (another server) is already getting her payments weekly without any issues. I thought mine would be straightforward too. I've been trying to call ESD since 7am this morning - literally hitting redial for HOURS and can't get through to anyone. I sent a message through eServices but who knows when they'll respond. I even called the governor's office in desperation, but they said they can't intervene unless it's been at least 4 weeks of problems. I've got rent due in 10 days and utilities piling up. Does anyone know what could cause a 'disqualified' status when the business closed? Any tricks to actually reach a human at ESD? This whole process is making my anxiety skyrocket.

Check your 'Notices/Letters' section in eServices immediately. The disqualification letter will explain EXACTLY why you were disqualified. Most common reasons for disqualification when a business closes are: 1. You didn't have enough hours in your base year 2. You indicated something incorrectly in your application (like accidentally saying you quit or were fired) 3. You answered a weekly claim question incorrectly (especially the 'able and available' ones) 4. Your employer contested the claim Once you know the reason, you can appeal it within 30 days of the determination date on the letter. For business closure, you should qualify as long as you meet the work history requirements.

•Thank you! I found the letter and I'm in shock. It says I selected 'voluntarily quit' as my reason for separation! I absolutely did NOT check that. I specifically selected that the business closed. Should I appeal this or try to call them to fix it?

SAME thing happnd to me!!!! Got disqualified even tho I lost my job when the company downsized. Turns out the employer said I was a contractor but I was actually an employee. took me 6 WEEKS to get it fixed!!!! the esd system is a NIGHTMARE designed to deny people benefits!!!

•True about contractor vs employee issues - but in OP's case, if they accidentally marked 'quit' instead of 'business closed,' that's actually a relatively easy fix. They just need to talk to someone at ESD. The system isn't designed to deny people - it's just overwhelmed and poorly designed. I had the same issue last year and got it resolved with backpay.

You need to appeal this immediately. Don't wait for a call back. The appeal process is actually pretty straightforward: 1. Go to your eServices account 2. Find the determination letter under Notices/Letters 3. Click on "Appeal" link at the bottom of that letter 4. Explain that you incorrectly selected "quit" when the business actually closed 5. Upload any documentation you have that proves the business closed (final paystub, communication from owners, news article, etc.) While the appeal is processing, continue to file your weekly claims even though they'll show as disqualified. Once the appeal is approved, you'll get backpay for all those weeks. In the meantime, you still need to talk to someone at ESD to potentially speed this up. The standard phone line is impossible, but I used a service called Claimyr (claimyr.com) that got me through to an ESD agent in about 15 minutes after trying for days on my own. •Thank you SO much for this detailed info! I just submitted the appeal with all the documentation I had (including the closure announcement email from the owners). I'll check out that Claimyr service too - at this point I'd do anything to talk to an actual person at ESD.

I deal with ESD issues every week for my clients, so let me clarify a few things: 1. If you got disqualified because the system shows you "quit," you MUST appeal this. Don't rely on messages or calls alone. 2. Continue filing weekly claims - this is critical! Many people stop filing when disqualified, which causes more problems. 3. The governor's office is right about the 4-week timeframe for their intervention, but your state representative's office can often help sooner. Try contacting them. 4. When you file your appeal, use very specific language: "I did not voluntarily quit. My employment ended because the business permanently closed on [date]. This was incorrectly entered in my application. I have attached documentation proving the business closure." The good news is that business closure situations almost always get approved on appeal when you have documentation. The bad news is that it can take 3-5 weeks for the appeal process. Backpay will include all weeks you properly filed claims for.

The EXACT thing happened to me in January! Restaurant closed down and somehow I got marked as "quit" on my application. I tried calling for TWO WEEKS with no luck. Eventually I went in person to a WorkSource office (they don't process claims but sometimes have ESD staff) and explained my situation. They couldn't fix it directly but gave me a special number to call where I actually got through. Took about 10 minutes for them to correct it once I finally talked to someone. Got paid for all back weeks about 3 days later. Have you tried going to a physical WorkSource location?

•Bring your ID, your ESD paperwork showing the disqualification, and any proof you have of the business closing (final paystub, termination notice, etc). Also, get there early! My local office gets packed by mid-morning.

One more important thing to check: look at your most recent "Monetary Determination" letter in your eServices account. Make sure you had enough hours in your base year to qualify. Even if the business closure issue gets fixed, you still need to meet the 680-hour requirement in your base year (the first 4 of the last 5 completed calendar quarters before you applied). Also, did your employer report your wages correctly? Sometimes small businesses miscategorize employees or don't properly report wages to ESD, which can cause qualification issues.

•I just checked my monetary determination letter and I definitely have enough hours - it shows I worked 1,842 hours in my base year. I was at that restaurant for over 2 years full-time, so hours shouldn't be an issue. I think it really is just that somehow the system has me marked as quitting when the business actually closed.

omg i just remembered!! there was a glitch in the ESD system back in february where a bunch of people got wrongly disqualified. maybe its happening again?? the website has been super glitchy lately

•While there have been system issues, OP found the actual problem - the system shows they voluntarily quit when they didn't. This is most likely either a data entry error when filing or possibly an employer miscoding the separation reason. Technical glitches usually cause delays, not incorrect separation reasons. Either way, OP needs to appeal and try to contact ESD directly.

Quick update for anyone following this thread - the Claimyr service I mentioned above worked for me during two separate claim issues. Both times I got through to ESD in less than 20 minutes after spending days trying on my own. The agents were able to fix my issues immediately once I actually reached them. For anyone in a similar situation as OP, remember that you have multiple options: 1. Appeal through eServices (always do this first to meet deadlines) 2. Try to reach ESD directly (phone or services like Claimyr) 3. Visit a WorkSource office in person 4. Contact your state representative Don't rely on just one method - use all available channels when your benefits are on the line. And always keep filing those weekly claims, even when disqualified!

She filed a correction request that should process in 72 hours. She said to keep filing weekly claims, and once it's fixed, I'll get backpay for all weeks.
