5 weeks in ESD adjudication after firing - employer responded but no updates
I got fired on November 10th and filed my UI claim the same day. My identity verification went through quickly, but my claim immediately went into separation adjudication. The status updated once on November 21st but nothing has changed since then. It's been almost 5 weeks now with zero communication from ESD! I contacted my former employer and they said they already submitted their response to ESD over 3 weeks ago. I'm completely in the dark about what's happening. My rent is due next week and I have no income coming in. Has anyone experienced adjudication taking this long? Is there anything I can do to speed things up or at least get some kind of update on my claim status? I'm really starting to panic here.

Unfortunately this is pretty common with ESD right now. Adjudication can take anywhere from 4-10 weeks depending on their backlog and the complexity of your case. Since you were fired rather than laid off, they have to determine if you were terminated for misconduct, which affects your eligibility. Did you include a detailed explanation of the circumstances when you filed?

•I did explain everything in detail when I filed. My termination wasn't for misconduct - they said it was performance-based after putting me on a PIP that I didn't have enough time to complete. I'm just worried that my claim is stuck somewhere or that they're missing information. Is there any way to check the status beyond what shows online?

my claim was stuk for 7 WEEKS in adjucation last year!!! esd is a nightmare and nobody ever picks up the phone. i tried calling like 50 times and got hung up on every time. the only thing that worked was emailing my state rep who forwarded my case to someone. might try that??

If your former employer already responded, that's actually a good sign. The biggest delays usually happen when employers don't respond promptly. Make sure you're still filing your weekly claims even though you're not getting paid yet. When they finally approve your claim (assuming they do), you'll get paid retroactively for all those weeks. Have you tried using Claimyr to get through to ESD? I was stuck in adjudication for weeks and couldn't get anyone on the phone until I used their service. They connect you directly to an ESD agent so you can ask about your claim status. •I've never heard of Claimyr before. I'll check out that video. At this point, I'm willing to try anything to get some answers. And yes, I've been diligently filing my weekly claims even though nothing is being paid out. I just hope when they finally make a decision it's in my favor.

Call first thing in the morning (7:00am) when they first open - that's when wait times are shortest 4. Document all attempts to contact them (dates, times, outcomes) 5. If it goes beyond 8 weeks total, consider filing a formal complaint through the ESD website I was an adjudicator for ESD before retiring, and while backlogs vary by season, 5-6 weeks is unfortunately within normal range currently. The good news is that once they make a decision, payment for all back weeks typically comes within 48 hours if approved.

Ugh I know exactly what ur going through!! My claim was stuck in adjuidcation for 6 weeks last month and it was TORTURE. I kept calling and getting nowhere. What is even the point of having a phone number if nobody ever answers?? The whole system is designed to make people give up. Makes me so MAD.

•The system is totally broken. My neighbor works for ESD (not adjudication) and says they're severely understaffed since they laid off all the pandemic hires. They still have nearly the same claim volume but like half the staff. Not an excuse, but explains why everything takes forever now.

I was in exactly your situation in February - fired for "not meeting expectations" after being with the company for 3 years with no previous issues. My adjudication took 7 weeks, but I was eventually approved because performance-based terminations usually don't disqualify you unless there's evidence you deliberately underperformed. One thing that helped me was uploading additional documentation to my claim - I added copies of my performance reviews showing I had been trying to meet expectations but struggled with new systems they implemented. I also uploaded the written warning I received before termination to show there was a paper trail. This gives the adjudicator more context without them having to request additional info. Hang in there! The waiting is absolutely brutal, but once adjudication completes, things move quickly.

have you tried contacting the obusdman office? they help with stuck claims sometimes. my cousin did this and got his claim fixed in like 4 days after being stuck for months

•Just to clarify, it's the "Office of the Ombuds" at ESD (not obusdman). This office can help with claims that have been stuck for an extended period or have processing errors. However, they typically only intervene after you've exhausted normal channels and after the claim has been pending longer than the expected timeframe. At 5 weeks, it's approaching that point, but they may consider it still within normal processing time. Their contact form is on the ESD website under "Contact Us" then "Office of the Ombuds".

UPDATE: I finally got through to ESD this morning! I took the advice about calling right at 7am, and after a 40-minute wait, I spoke with an agent. They said my claim is still in adjudication but confirmed they have all the necessary information from both me and my employer. The agent said they're currently working through claims from early November, so mine should be decided within the next 7-10 days. She also noted that performance-based terminations generally do qualify for benefits as long as there wasn't willful misconduct. Feeling much more hopeful now. Thanks everyone for your advice!
