TWC deducted overpayment from my weekly claim AFTER I paid in full - can I get a refund?

I'm so confused about my TWC overpayment situation. Last month, I received a letter saying I owed $2,840 due to an overpayment from last year (they said I reported my work hours incorrectly). I panicked and immediately paid the full amount through the online portal using my credit card. But when I checked yesterday, I noticed TWC had ALSO deducted the overpayment amount from my two most recent weekly benefit payments! So now they essentially collected twice - once from my direct payment and again from withholding my benefits. Has anyone dealt with this double-collection issue? Will they automatically refund the excess payment or do I need to contact them? The wait times are insane when I try to call the main number.

The same exact thing happened to me in February!!! TWC is such a mess with these overpayments. They took 3 MONTHS to process my refund and I had to call them like 20 times. They won't automatically refund you - you have to specifically request it. Good luck getting through on the phone tho 🙄

3 months?! I can't wait that long, I maxed out my card paying them. Did you have to submit any specific forms or just call?

This happens more often than it should. According to TWC policy, you're entitled to a refund of the overpaid amount. But you need to contact them directly to initiate the refund process - it's not automatic. Here's what you should do: 1. Document everything - when you made your payment, the amount, and when they deducted from your benefits 2. Call the TWC Benefit Payment Control department at 512-463-2999 3. Explain the situation clearly and request a refund of the duplicate payment 4. If they confirm the double collection, ask for an estimated timeframe for your refund 5. Get the name of the representative you speak with Be prepared to wait 4-6 weeks for processing. If you haven't received your refund after that time, follow up with another call and reference your previous conversation.

Thank you so much for the detailed steps! I'll start calling that number tomorrow morning. Really appreciate the help - this has been so stressful.

I'm just wondering - how did you not notice they were taking it from your weekly payments? Doesn't it show up on your payment summary? Just curious because I want to avoid this happening to me!

Honestly, I paid the lump sum right away when I got the letter, then I wasn't checking my payment statements carefully for the next couple weeks. I just noticed the reduced amount hitting my bank account and then went back to check the statements. My mistake for not paying closer attention!

I went through this exact nightmare last year when TWC double-collected my overpayment. I tried calling for WEEKS and couldn't get through - busy signals, disconnections, or 5+ hour hold times. I finally used a service called Claimyr (claimyr.com) that got me connected to a TWC agent within 30 minutes. Totally worth it to avoid the phone frustration. They have a video showing how it works: https://youtu.be/V-IMvH88P1U?si=kNxmh025COIlIzKh Once I got through, the agent transferred me to the Benefit Payment Control unit, and they processed my refund request. Still took about 5 weeks to get my money back, but at least the process was started.

I've never heard of that service before, but I'm getting desperate after trying to call all morning. I'll check out that video - thanks for the suggestion!

@profile8 It definitely worked for me. They don't handle your claim or anything - they just connect you with an actual TWC agent instead of you having to redial 100 times. Once you're connected, you're just talking directly to TWC.

The TWC system is COMPLETELY BROKEN when it comes to overpayments!!! I had to fight for SEVEN MONTHS to get a $3,200 refund after they double-collected from me. They kept saying "it's being processed" every time I called. Then they had the NERVE to tell me my refund request was "lost" and I had to start over!!! The only thing that finally worked was filing a complaint with my state representative's office - suddenly TWC found my paperwork and issued my refund in 2 weeks. The whole system is designed to make it so difficult that people give up!!

That's horrifying! I hope my case doesn't take that long. What was the process for filing a complaint with your state rep?

Just google your TX state representative, most have a "constituent services" form on their website. Explain your situation, include your TWC claim number, the dates of payments, and mention you've been unable to reach anyone. They have special channels to contact government agencies. Works WAY better than calling yourself!

i worked for twc before and heres what happens: the computer system automatically takes money from benefits even if youve paid already. its a separate system from the payment portal. once u get thru to someone they have to manually mark it as refund eligible in the system. make sure u get confirmation number or name of person who helps u!

This is correct. TWC uses separate systems for benefit payments and overpayment collections that don't communicate in real-time. The manual intervention is necessary, and documentation is crucial.

UPDATE: I finally got through to TWC after using that Claimyr service someone suggested. The agent confirmed they collected twice and submitted a refund request for me. She said it will take 4-6 weeks to process and will come as a paper check, not direct deposit. She gave me a confirmation number and the name of the person handling it. Thanks everyone for your help!

Make sure you follow up if it doesn't arrive in 6 weeks! And don't lose that confirmation number!!

Glad you got through! That's exactly what happened with mine - paper check after about 5 weeks. Make sure you watch your mail carefully.
