TWC appeal for separation issues - what does this status mean??

I just had my appeal hearing with TWC on Wednesday about separation issues from my retail job. Now my account just shows 'Appeal - Pending Resolution' with no other information. I'm so confused because during the hearing the examiner didn't really say what would happen next or when I'd get an answer. It's been 2 days and I'm getting anxious since rent is due next week. Has anyone been through the separation appeal process recently? How long does it take to get a decision and what does 'pending resolution' actually mean for my payments?

Pending' Resolution just means they'haven t made their final decision yet. After your appeal hearing for separation issues, the hearing officer typically needs 7-14 business days to review all testimony and evidence before issuing a written determination. You should receive their decision in the mail, and it will also eventually show up in your online account. The good news is that if the decision is in your favor, TWC will release any back payments'they ve been holding while your case was underappeal.

7-14 BUSINESS DAYS?? That's like 3 weeks! I thought they'd decide right after the hearing. So there's literally nothing I can do but wait? My landlord isn't going to care about TWC's timeline...

Thanks for the tip about checking correspondence. Did you have to request payments during those 3 weeks of waiting? I'm worried about doing something wrong.

The TWC system is SO frustrating! I had my separation appeal back in November and waited almost a MONTH for the decision! Then when I finally got approved, it took another 2 weeks for them to release my backpay. The whole system seems designed to make people give up. I called literally 47 times trying to get updates and always got busy signals or disconnected.

If you're having trouble getting through to TWC agents, I'd recommend trying Claimyr. After struggling with the phone lines for weeks, I used their service and got connected to a TWC agent in about 20 minutes. They basically hold your place in line and call you when an agent is available. Saved me hours of redial frustration when I was dealing with my own separation appeal issues. You can check out how it works at claimyr.com or watch their demo at https://youtu.be/V-IMvH88P1U?si=kNxmh025COIlIzKh

Important: You need to continue requesting payment every two weeks even while waiting for your appeal decision! Many people miss this step and it causes more problems. If your appeal is approved, you'll only get paid for weeks you properly requested payment for. As for timing, separation issues can take 10-21 days for a decision because the hearing officer has to review all testimony, check employer records, and write up detailed findings of fact to support their decision.

Omg thank you - I had no idea I still needed to request payments! My claim status just shows "pending" so I thought requests wouldn't matter. I'll make sure to keep doing that.

Was it a telephone hearing or in-person? My brother had his appeal last year and the judge actually told him at the end of the call that he was approving the claim but it still took like 10 days to show up in the system.

It was a telephone hearing. The examiner didn't give any hint about which way they were leaning. Just thanked us for our testimony and said we'd be notified of the decision.

That's pretty normal then. They usually don't tell you during the call. My brother got lucky I guess.

Just wondering - what kind of separation issue was your appeal about? Misconduct or voluntary quit? I'm asking because I've noticed misconduct appeals seem to take longer than quit-related ones. In my case (voluntary quit for good cause), I got my decision in exactly 8 business days. My friend who had a misconduct appeal waited almost a month.

It's a misconduct issue. My employer is claiming I was terminated for violating company policy, but I never received any warnings and the "violation" was something everyone did with manager approval. Now I'm really worried it's going to take forever to resolve.

That definitely sounds like something that could go in your favor! Misconduct cases usually require documented progressive discipline. If they can't show they warned you about this "violation" before, you have a good chance. Good luck!

That's a good point about checking your physical mail. The decision will be sent both electronically to your correspondence inbox AND via USPS mail. Sometimes the physical mail arrives first.

I went through a separation appeal last September and it was nerve-wracking! The "Pending Resolution" status is totally normal - it just means the hearing officer is reviewing everything from your hearing before making their final decision. In my experience, the waiting is honestly the hardest part because you're left wondering what's going to happen. Since you had your hearing on Wednesday, I'd expect to hear something by next week at the earliest. Keep checking both your online correspondence and physical mailbox daily. And definitely keep requesting payments every two weeks like others mentioned - that's crucial! Hang in there, the waiting sucks but at least you got your hearing done.

Thanks for the encouragement! It really helps to hear from someone who's been through this exact situation. September feels like forever ago - do you remember if there were any signs in your online account before you got the official decision? Like did the status change at all or did it just stay "Pending Resolution" until the very end? I'm probably checking my account way too much but I can't help it!

I'm going through the same thing right now! Had my separation appeal hearing last Friday and my status also just shows "Appeal - Pending Resolution." It's so stressful not knowing when you'll hear back, especially when you're counting on that money. From what I've been reading online, it sounds like 7-14 business days is pretty standard, but some people are saying it can take up to 3 weeks depending on how complex the case is. I've been obsessively checking my account multiple times a day even though I know it's not going to change that fast. The waiting game is brutal when you have bills to pay. Hopefully we both hear back soon with good news!

Nathan, I'm glad I'm not the only one going crazy checking my account every few hours! It's reassuring to know someone else is in the exact same boat right now. Last Friday puts you at about the same timeline as me since I had mine Wednesday. I keep telling myself that no news isn't necessarily bad news, but it's hard not to overthink every little thing from the hearing. Did your examiner give you any indication of how they were leaning, or were they pretty neutral like mine? Fingers crossed we both get good news soon - this financial stress on top of the waiting is really getting to me!

I just went through this exact same process in December and totally understand your anxiety! "Appeal - Pending Resolution" is standard language that shows up after your hearing while the examiner reviews everything. From my experience and what I've seen others report, separation issue appeals typically take 10-15 business days, so you're looking at roughly 2-3 weeks from your Wednesday hearing date. The examiner has to write up their findings of fact and legal conclusions, which takes time especially for misconduct cases. Make sure you keep requesting payments every two weeks even while waiting - this is super important! Also check both your online correspondence inbox AND your physical mailbox daily since the decision can show up in either place first. I know the waiting is torture when rent is due, but hang in there. Most people I've talked to say the hardest part is just the uncertainty of waiting, but once you get that decision letter it moves pretty quickly from there.

This is really helpful Taylor, thank you for breaking down the timeline so clearly! I'm feeling a bit more patient knowing that 2-3 weeks is actually normal for these types of cases. Quick question - when you got your decision in December, did it show up in your online correspondence first or did you get the physical mail first? I'm trying to figure out which one to focus on checking more frequently. Also, did your account status change at all before you got the official decision, or did it just stay on "Pending Resolution" the whole time until the letter came through?

I'm in a similar situation - had my separation appeal hearing about 10 days ago and still showing "Appeal - Pending Resolution" with no updates. The waiting is absolutely killing me! What really helped me was setting up a routine to check my correspondence inbox and mailbox at specific times (morning and evening) instead of obsessively checking throughout the day. I also called my local workforce office and they confirmed that separation appeals are taking 10-20 business days right now due to high volume. One thing that gave me some peace of mind was learning that if you win your appeal, TWC will pay out all the back weeks you've been requesting payments for during the waiting period. So definitely keep doing your biweekly requests! I know it's hard but try to stay positive - most people in this community seem to have good outcomes with their appeals, especially when employers can't provide proper documentation of progressive discipline.
