Can I get my waiting week payment after being disqualified but finding full-time work?

So I had a whole mess with my TWC claim back in January. Got laid off from my warehouse job, filed for unemployment, and then got hit with a disqualification because they said I didn't provide enough documentation about my previous employer (even though I swear I uploaded everything they asked for). Anyway, I served that one week waiting period before all this happened. Two weeks after the disqualification, I actually found a really good full-time job that pays better than my old one (thank goodness). My question is: Can I still request that waiting week payment even though I was disqualified and now have full-time work? I heard someone say that once you work enough at your new job, you can go back and claim that waiting week payment. Is that true or am I out of luck? I'm not trying to be greedy, but that week of pay would really help with some medical bills I've been putting off.

You actually CAN get your waiting week paid, but only after very specific conditions are met. According to TWC rules, you need to have received benefits for at least 3 weeks AND returned to full-time work. The disqualification complicates things though. If your entire claim was disqualified, then unfortunately you probably won't get that waiting week paid because you never actually received benefit payments after it. If only certain weeks were disqualified but you received benefits for 3+ other weeks, you might still qualify. I'd recommend calling TWC to verify your specific situation. I WAS IN THE EXACT SAME SITUATION last year!!! Filed in March, got DISQUALIFIED because my previous employer lied about why I left (they said I quit when they actually cut my hours to almost nothing). I appealed and won but by that time I already found another job. TWC said I couldn't get the waiting week because I never actually received 3 weeks of benefits payments. It's RIDICULOUS because we still had to WAIT that week but get NOTHING for it even though it wasn't our fault!!!! The system is designed to make us lose money no matter what.

It worked for me! I was skeptical too but was desperate after trying to call for a week straight. They basically have a system that keeps dialing for you until they get through.

From what I understand the waiting week is basically like a deductable on insurance. You don't get that week back unless you meet all the conditions, and being disqualified means you definitely don't meet them. I think they do it this way to discourage super short term claims? My cousin works at TWC and says they're really strict about the 3 weeks of benefits rule.

Im going thru something sorta similar. If i were u I would log into your TWC account and submit a message through the contact system asking specifically about your situation. Sometimes its easier than calling. And make sure to keep checking back for messages cuz they dont always email u when they respond. At least then youd have an official answer specific to ur claim without sitting on hold for hours.

After reading through all the comments, I agree with the consensus that you probably won't get the waiting week paid. But for future reference (or anyone else reading this thread), here's the official TWC rule about waiting week payments: "The waiting week is the first week of your claim. You must request payment for this week, but you won't get paid for it until: - You return to full-time work, or - You exhaust all of your benefits, or - You have received 3 times your weekly benefit amount in benefits" Since you were disqualified and never received benefits equaling 3x your weekly amount, the waiting week remains unpaid. The system is designed this way to prevent people from filing for very short periods of unemployment.
