NYS Department of Labor disqualified my claim - can I reapply for unemployment benefits?
I got disqualified from my unemployment claim about 6 months ago because they said I quit without good cause (which wasn't true but that's another story). My situation has changed now and I'm wondering if I can apply again for benefits? I lost my job last week due to layoffs at my company. Does anyone know if being disqualified before prevents you from filing a new claim? I'm really stressed about this and don't want to waste time if it's not even possible.

Yes, you can absolutely file a new unemployment claim even if you were disqualified before. Each claim is evaluated separately based on the circumstances of that specific job separation. Since you were laid off this time (which is qualifying), your previous disqualification won't automatically affect your new claim. You'll need to file through the NYS Department of Labor website and they'll review your most recent work history and reason for separation.

•That's such a relief to hear! Do I need to mention the previous disqualification when I file or will they see it automatically in their system?

I was in almost the exact same situation! Got disqualified 2 years ago for attendance issues, then got laid off from a different job last year and was able to collect benefits no problem. The key is that your most recent separation has to be qualifying - sounds like yours is since it was a layoff.

•Did they ask you about the previous disqualification during the application process?

•They didn't bring it up during filing but I think it shows in their system. The adjudicator only cared about why I lost my most recent job.

If you're having trouble reaching someone at NYS Department of Labor to ask questions about your specific situation, I used a service called Claimyr (claimyr.com) that helped me get through to an actual agent. They have a video demo at https://youtu.be/qyftW-mnTNI that shows how it works. Really helpful when you need to speak to someone about complex claim issues like yours.

•How much does something like that cost? I'm already broke from being unemployed...

•It's worth checking out their site for the details, but honestly when you're dealing with potential weeks of benefits it's usually worth it to get answers quickly rather than spending days trying to call.

The NYS Department of Labor system is so confusing about this stuff. I think they should make it clearer on their website whether you can reapply after being disqualified. Like why do we have to guess about these things??

To answer your question about mentioning the previous disqualification - you don't need to volunteer that information, but if they ask directly you should be honest. Focus on your current job loss and the fact that it was through no fault of your own. Make sure you have documentation from your employer about the layoff if possible.

I went through something similar a few years back. Got disqualified initially but was able to file a new claim when I got laid off from my next job. One thing that helped me was keeping all the paperwork from my layoff - the WARN notice, any emails about the company restructuring, etc. Having that documentation ready made the process smoother when they reviewed my claim. Also, don't stress too much about the previous disqualification - like others said, they really focus on your most recent job separation. Good luck!
