PUA appeal won - will I get backpay after PA UC overpayment reversal?
I've been fighting with PA UC for months! Last December, they hit me with a non-fraud overpayment notice claiming I was never eligible for PUA benefits. They wanted me to pay back almost $14,300! I filed an appeal right away and FINALLY had my hearing last week. The referee actually ruled in my favor! She specifically said I WAS eligible for PUA and that my overpayment should be reversed. I'm so relieved, but now I'm confused about what happens next. Does this mean I'll also get the backpay for all those weeks they stopped paying me while this was being resolved? It's been nearly 5 months without any benefits, and I'm really struggling financially. Has anyone dealt with this situation before? How long before they actually reverse the overpayment and potentially release any backpay?

congrats on winning ur appeal! thats huge. i had somthing similar but with regular UC not PUA. took about 3 weeks after my appeal decision for the overpayment to disappear from my portal. the backpay came like a week after that. but mine was only for like $2600 so yours might take longer?? idk good luck!

•Thanks for the response! That gives me some hope. Did they notify you when they processed the backpay or did it just show up in your account one day?

Yes, you should receive backpay for any weeks you were eligible but not paid due to the incorrect overpayment determination. The referee's decision becomes final 15 days after the mailing date unless either party appeals to the UC Board of Review. After that, the system should automatically process your claim adjustments. Here's what to expect: 1. The overpayment will be removed from your account (usually 2-4 weeks after the decision becomes final) 2. Any eligible weeks that were withheld will be processed for payment 3. You'll receive notification through your PA UC dashboard Make sure all your weekly certifications are filed for those missing weeks. If you didn't certify for some weeks, you may need to file for those separately once the overpayment is removed.

•Thank you for the detailed information! I did file all my weekly claims even though I wasn't getting paid, so hopefully that helps speed things up. I'll keep checking my dashboard for updates.

The same thing happened to me last year and I won my appeal too. But I NEVER got my backpay!! They reversed the overpayment but said I needed to reapply for the missed weeks. When I tried to do that the system wouldn't let me because the weeks were too old. Been fighting with them for MONTHS trying to get someone to help me!!!!

•Oh no, that's exactly what I'm afraid of! Have you been able to talk to anyone at UC about your situation? I've been trying to call them but can never get through.

I had a similar issue with my PUA claim in 2025. After winning my appeal, it took about 5 weeks for the overpayment to be removed from my account, and then another 3 weeks for the backpay to process. They should automatically process eligible weeks that you've already certified for. However, to speed things up, I recommend trying to speak with someone directly. After two weeks of calling and getting nowhere, I used Claimyr (claimyr.com) to get through to a PA UC agent. They have this service that helps you bypass the busy signals. They have a video on how it works: https://youtu.be/CEPETxZdo9E?si=WL1ZzVZWG3KiHrg2 Once I reached an agent, they were able to expedite the process and clear the flags on my account that were holding up payment. The agent confirmed that yes, you ARE entitled to backpay for all certified weeks once an overpayment is reversed due to an appeal decision.

•That's really good to know! I've been trying to call them every day with no luck. I'll check out that service - at this point I just need to talk to a real person. Did they give you an exact timeframe for when you'd receive the backpay?

•Thank you! It does feel good to be validated after months of stress. A month seems like a long time to wait but at least there's light at the end of the tunnel!

The same exact thing happened to me, but when they reversed my overpayment, my backpay never came through automatically. I had to call them like 50 times before I finally got through to someone who could help me. They said there was some "system flag" that needed to be manually removed by a specialist. It was a NIGHTMARE dealing with their phone system! Make sure you keep filing your bi-weekly claims even though you aren't getting paid. And document EVERYTHING - save screenshots of your portal, the appeal decision, everything. The UC system is so broken and they make so many mistakes.

•This is why I tell EVERYONE to document everything with PA UC! They messed up my claim THREE TIMES last year and each time I had to prove what happened with my own documentation because their records were "incomplete." The system is completely broken. OP - if you haven't already, take screenshots of your portal showing the overpayment, save PDFs of any communications, and get a copy of your appeal decision. You'll likely need all of this when fighting for your backpay.

To update on what I mentioned earlier - you should also check if the "Payment Type" for your eligible weeks shows as "Credit Applied to Overpayment" in your payment history. If so, once the overpayment is removed, these payments should be reissued to you. Regarding your appeal decision, you can typically access a copy through your dashboard under "Appeals" or by contacting the UC Service Center. Having this document is crucial if you need to follow up on your case.

•I just checked and yes, several payments say "Credit Applied to Overpayment"! That makes me feel better that they're in the system. I'll look for the appeal decision in my dashboard too. Thank you for the information!

Based on your update about seeing "Credit Applied to Overpayment" on your payments, that's actually good news. It means the system has record of those payments, and they should be released to you once the overpayment is removed. One thing I learned from my experience - if it's been more than 3 weeks since your appeal decision became final and you don't see changes in your account, don't just wait. That's when issues tend to fall through the cracks. Try to get through to someone who can check if there are any holds or flags on your account that need manual intervention.
