PA UC appeal won - how long for backpay & will 2011 overpayment affect it?

Finally some good news! I just won my PA UC appeal hearing last Friday (March 18, 2025). The referee agreed that my employer terminated me without just cause. Now I'm wondering how long it typically takes for the backpay to hit my Money Network card? It's been almost 3 months of waiting since my initial claim and I'm seriously behind on bills. Also, there's something weird showing up on my dashboard about an overpayment from 2011?? I honestly don't even remember claiming UC back then (was working retail and got laid off briefly). Will they automatically deduct that old overpayment amount before sending me my current backpay? Anyone dealt with this before? Getting anxious because I really need this money ASAP!

Congrats on winning your appeal! For backpay after a successful appeal, it typically takes 7-14 business days for the funds to be released to your Money Network card. However, if there are other issues on your claim (like that overpayment), it could take longer. Regarding the 2011 overpayment - yes, PA UC will typically recover old overpayments from your current benefits. They usually withhold a percentage (often 1/3 of your weekly benefit amount) rather than taking it all at once. You should receive a notice explaining exactly how they'll recover it and how much of your backpay will be affected.

Thank you! Do you know if there's any way to see exactly how much I supposedly owe from 2011? It doesn't show an amount on my dashboard, just says 'overpayment on record'. I'm getting worried they'll take a huge chunk when I really need every dollar right now.

omg the SAME thing happened to me!!! won my appeal in january and it took almost 3 weeks to get my backpay. and i also had an old overpayment from like 2016 and they took 33% of each week to pay it back. so frustrating bc they never told me about it until they started taking the money!!! make sure u check ur determinations section online to see if theres more info about how much u owe.

They always get their money back somehow. PA UC is notorious for holding onto these old overpayment records FOREVER. Even if you don't remember it from 2011, trust me, their system does! I had one from 2014 and they took money from my benefits last year. The system is designed to squeeze every penny from us while making us wait weeks for what we're rightfully owed.

For the backpay timing, there's a two-step process after winning an appeal: (1) The referee's decision needs to be implemented in the system, which takes 5-7 business days, and (2) Then the actual payment processing takes another 3-5 business days before it hits your Money Network card. Concerning the 2011 overpayment, there's a 10-year collection period for non-fraud overpayments, but if they determined it was due to fraud, there's no time limit. You should immediately call PA UC to get details on: - The exact amount of the overpayment - Whether it was classified as fraud or non-fraud - How they plan to recover it from your current benefits You do have options - you can request a repayment plan or possibly apply for an overpayment waiver if paying it back would cause financial hardship.

Thanks for the detailed info! I've been trying to call them for 3 days now but keep getting busy signals or disconnected. It's so frustrating trying to reach someone. I definitely need to find out if they classified it as fraud (which it absolutely wasn't - I probably just misunderstood something back then). Do they ever actually approve those hardship waivers?

If you need to reach PA UC about that old overpayment, I'd recommend using Claimyr to get through to an agent. I was in a similar situation with an overpayment from years ago and spent days trying to get answers. Finally used Claimyr (claimyr.com) and got connected to a UC rep in about 20 minutes. They have a video showing how it works: https://youtu.be/CEPETxZdo9E?si=WL1ZzVZWG3KiHrg2. The agent I spoke with was able to pull up all the details about my overpayment and explain my options.

Just to add some accurate info here: Under PA law, they can recoup up to 1/3 of your weekly benefit amount for non-fraud overpayments. But if they determined it was fraud, they can take up to 100% of your benefits until it's repaid. And here's something important - if it truly was from 2011, and it wasn't fraud, they might be outside the 10-year collection window. I'd definitely get more information before they start taking money. The overpayment notice should have been mailed to you with appeal rights at the time it was established. If you never received that, mention it when you speak with them.

That's really helpful info! It definitely wasn't fraud - I probably just made an honest mistake or misunderstood something when filing. Maybe I'm lucky and they're outside that 10-year window? I'm going to try calling again tomorrow morning right when they open. Fingers crossed I can actually get through to someone who can help.

One more thing - make sure you continue filing your weekly claims while waiting for the backpay. Sometimes people think they don't need to after winning an appeal, but you absolutely should keep filing for every week you're eligible.

Oh! I actually didn't know that - I thought once I won the appeal I just wait for them to process everything. I'll make sure to keep filing. Thank you!!

PA UC is such a mess with their systems. I bet that 2011 overpayment isn't even real!!!! Their computer systems are so old they probably have errors all over the place. My friend had something similar happen and when she FINALLY got someone on the phone they admitted it was a system error from when they upgraded their computer system in 2017. But good luck getting anyone to answer the phone to fix it!!

You might be right. It seems crazy they'd suddenly bring up something from 14 years ago that I never heard about before. I'm going to try that Claimyr service someone mentioned above - at this point I'd pay anything just to talk to a real person who can explain what's going on.

Just to follow up - once you do receive your backpay, check the payment details carefully. They should provide a breakdown showing the weeks paid, any deductions for the overpayment, and the net amount. If anything looks incorrect, you'll want to contact them immediately. Also, for anyone dealing with overpayments, you can request a Statement of Overpayment Account by calling or writing to the Overpayment Collection Unit. This will show exactly what you owe and the history of the overpayment. Very helpful if you're questioning an old debt.
