PA UC claim reversal taking forever - regular UC not paying off PUA overpayment since 2020

I'm at my wit's end dealing with this bureaucratic nightmare! Back in January 2023, my regular PA unemployment claim was initially denied, so I was directed to file for PUA instead. I received PUA benefits for about 3 months (around $8,700 total). Then out of nowhere, I got a determination letter saying I was actually eligible for regular UC all along and that I had an 'overpayment' on the PUA side. Here's the crazy part - they processed the PUA overpayment notice IMMEDIATELY, like within 24 hours. But it's been almost 7 MONTHS and they still haven't processed my original regular UC claim that's supposed to offset the PUA overpayment! I've called the PA UC office literally 47 times (I've been keeping track). Today the agent just shrugged and said there's "no timeframe" for when this might be resolved. I've tried everything - called my state rep's office, filed complaints, sent messages through the portal. The UC rep told me today that "the UC system and PUA system don't communicate with each other" and that's why it's taking so long. When I asked why they can't just handle it manually, they had no answer. Is anyone else stuck in this weird limbo between regular UC and PUA overpayments? What did you do to get it resolved? I'm seriously considering hiring a lawyer at this point.

They told you 6-8 months?? At least they gave you a timeframe. The agent I spoke with yesterday literally said "could be next week, could be next year" - not helpful at all. The worst part is that if WE made a mistake on our claims, they expect it fixed immediately or they cut off benefits!

I actually managed to get my cross-program issue resolved, but it took threatening legal action. After 9 months of waiting, I sent a certified letter to the UC Office stating that I would be filing a complaint with the PA Attorney General's Office for administrative negligence if my case wasn't resolved within 30 days. Magically, two weeks later, my regular UC was processed and applied against the PUA overpayment. The key was sending the letter to the UC Program Director for your region (not just the general office), and citing specific sections of Pennsylvania Code Title 34, Chapter 65 regarding timely determination requirements. One thing I've learned from my experience - DON'T agree to a repayment plan for the PUA overpayment until your regular UC is processed. Once you acknowledge the debt by setting up payments, it becomes much harder to get them to prioritize processing your regular UC to offset it.

After trying for MONTHS to get my cross-program issue resolved through normal channels, I finally got it fixed by contacting my state senator (not representative). Their office has a dedicated staff person who deals with UC issues, and they have direct contacts with higher-level UC administrators. Within 3 weeks of involving them, my regular UC was processed and applied against the PUA overpayment. Might be worth trying if your state rep hasn't been helpful.
