PA UC appeal hearing conflicts with new job orientation - can it be moved to phone?

I finally got my appeal hearing scheduled for my PA unemployment claim after waiting for almost 2 months, but just my luck - it's scheduled for May 14th which is exactly when I start orientation for my new job! The notice says it's an in-person hearing at the Harrisburg service center. Does anyone know approximately how long these appeal hearings usually take? Mine is about being denied benefits after I was let go during a probationary period. Also, is it possible to request a phone hearing instead? I really don't want to miss my first day at this new job, but I also need to resolve this appeal to potentially get backpay for those 6 weeks I was without income. Has anyone successfully changed their hearing format before?

Congrats on finding a new job! Yes, you can definitely request to change to a phone hearing. I had to do this back in January when my car broke down the day before my hearing. Call the appeal office at the number on your hearing notice ASAP - don't wait until the last minute. Most UC appeal hearings take about 30-45 minutes, but it really depends on how complex your case is and if your former employer participates. Since yours involves a probationary period termination, it might take a bit longer if there's disagreement about the circumstances. Make sure you have all your documentation ready regardless of whether it's phone or in-person!

Thank you so much! I'll call first thing tomorrow morning. Do you know if they're usually accommodating with these requests? I'm nervous they'll deny it and I'll be forced to choose between the new job and the hearing.

Not my experience AT ALL. My hearing took almost 2 hours because my former employer showed up with their HR person AND a lawyer! They contested EVERYTHING. The system is rigged against workers!!!

I had the EXACT same situation happen to me last year! Definitely call the appeals office RIGHT AWAY and explain your situation. I waited too long (only 2 days before) and they denied my request to switch to phone. I ended up having to reschedule my first day at my new job which was super embarrassing. Don't make my mistake! BTW if you're having trouble reaching anyone at the appeals office, I used this service called Claimyr that got me through to an actual person at PA UC after trying for days. Their website is claimyr.com and they have a video showing how it works here: https://youtu.be/CEPETxZdo9E?si=WL1ZzVZWG3KiHrg2 - total lifesaver when you NEED to talk to someone urgently.

That's exactly what I'm afraid of! I don't want to start off on the wrong foot with this new employer. I'll check out that service if I can't get through tomorrow. How far in advance did you end up rescheduling your hearing?

As a former appeals referee, I can confirm that you should request the phone hearing as soon as possible. Typically, they require at least 7-10 business days notice for format changes unless it's an emergency. The request should be in writing, though calling first is wise. Regarding your specific situation (probationary period termination), these hearings can range from 30-60 minutes depending on complexity. Be prepared to explain why you believe you're eligible for benefits despite being terminated during probation. The key factors will be whether the employer can demonstrate misconduct or failure to meet clearly communicated job expectations. If you absolutely cannot get the hearing changed to phone format, you have the option to request a postponement, but be aware this can delay your decision by several weeks and is not guaranteed to be approved.

This is so helpful! Quick question - do you have to have a lawyer for these hearings? My brother is going through something similar.

THE PHONE HEARING IS ACTUALLY WORSE!!! I did that and regretted it because I couldn't see the referee's face or read body language. Plus my phone kept cutting out and I missed some questions. If your orientation is important, just ask for a postponement instead. The UC system is BROKEN and they don't care about our schedules AT ALL!!!

While phone hearings have limitations, they're often the only viable option for those with scheduling conflicts. A postponement is a valid alternative, but as I mentioned, it can significantly delay the process. Each situation is different - some cases are better suited for in-person hearings while others work fine via phone. The important thing is making the request promptly and properly documenting your need for accommodation.

I ended up having to postpone my hearing by almost 4 weeks because I didn't act quickly enough. Definitely don't wait! I finally got through to someone after using that service I mentioned, and they were able to help me figure everything out. Just make sure to have your appeal docket number ready when you call.

I just called the appeals office this morning and they said they'll need my request in writing! Going to fax it over today and follow up tomorrow. Fingers crossed they approve it. Thanks everyone for the advice!
