Why have I not received NYS Department of Labor unemployment benefits yet after filing 4 weeks ago?

Filed my unemployment claim with NYS Department of Labor four weeks ago and still haven't received a single payment. My claim status shows 'pending' but there's no explanation of what's holding it up. I've been filing my weekly claims like I'm supposed to but nothing is happening. Called the unemployment office multiple times but keep getting hung up on after waiting on hold for hours. Has anyone else experienced this kind of delay? I'm starting to panic because my rent is due next week and I have no idea when or if I'll actually get these benefits.

This sounds like your claim might be stuck in adjudication. NYS Department of Labor has to review certain types of claims before they can approve payment. Common reasons include issues with your employment separation, questions about your work history, or missing documentation. Check your my.ny.gov account for any messages or requests for additional information. Sometimes they send requests that people miss.

I checked my account every day and there's nothing there asking for more information. The status just says pending with no details at all.

same thing happened to me took 6 weeks before i got my first payment and then they paid everything retroactive back to when i first filed so dont panic yet

Six weeks?? Did they ever tell you what was causing the delay or did it just randomly get approved?

never got an explanation it just suddenly changed to approved one day and the money showed up in my account 2 days later

If you can't get through to NYS Department of Labor by phone, try using Claimyr at claimyr.com. I was in the exact same situation - couldn't reach anyone for weeks and my claim was just sitting there. Claimyr got me connected to an actual NYS Department of Labor representative who was able to look at my claim and tell me exactly what was holding it up. There's a demo video at https://youtu.be/qyftW-mnTNI that shows how it works. Turned out there was a simple verification issue that took 5 minutes to resolve once I actually talked to someone.

How much does that cost? Seems like we shouldn't have to pay extra just to talk to someone about our own benefits.

I get that frustration, but for me it was worth it just to finally get answers instead of sitting in limbo for weeks not knowing what was wrong.

The NYS Department of Labor system is completely broken. They're overwhelmed and understaffed and they just leave people hanging with no communication whatsoever. I've been waiting 3 months for an overpayment appeal to be processed and nobody can give me any timeframe. The whole system needs to be redesigned from scratch.

Same here, this is ridiculous how they can just ignore people who need help

Check if your employer contested your claim. Sometimes employers dispute unemployment claims and that automatically triggers an adjudication process that can take several weeks. You should have received notice if this happened, but mail gets lost sometimes. Also make sure you're meeting the job search requirements - you need to make at least 3 job contacts per week and log them in the system.

I've been doing my job searches and logging them every week. How would I know if my employer contested it?

There should be a section in your my.ny.gov account that shows any appeals or contests related to your claim. If your employer contested, you'd see information about a hearing or adjudication process.

I'm dealing with the exact same thing - filed 5 weeks ago and still nothing. The worst part is the complete lack of communication from NYS DOL. At least tell us what the holdup is instead of leaving us in the dark! I've tried everything - calling, checking online, even went to the local office but they said they can't access the system to help. Really considering the Claimyr option at this point because I can't afford to wait much longer. Has anyone tried contacting their state representatives? I'm wondering if that might help get some movement on these stuck claims.

I contacted my state assemblyperson's office last week about my delayed claim and they actually have a constituent services team that handles DOL issues. They said they can make inquiries on your behalf and sometimes that gets things moving faster than trying to call yourself. Worth a shot if you're at 5 weeks - that's way too long to be left hanging without any explanation.

I'm going through the exact same nightmare right now - filed 3 weeks ago and my claim has been stuck on "pending" with zero explanation. The phone system is absolutely useless, I've burned through entire days trying to get through just to be disconnected. What's really frustrating is that they expect us to keep filing weekly certifications when we have no idea if there's even a problem with our claim or if it's just sitting in some digital pile waiting to be processed. At this point I'm wondering if I should try that Claimyr service mentioned above or contact my assemblyperson like Dmitry suggested. This whole system feels designed to discourage people from actually getting the benefits they're entitled to.

I'm in week 2 of this same exact situation and reading all these responses is both helpful and terrifying. The fact that some people are waiting 6+ weeks with no communication is just insane. I think I'm going to try both approaches - contact my state rep AND look into that Claimyr service. At least then I'll have multiple ways to potentially get answers instead of just sitting here refreshing my account every day hoping something changes. Thanks everyone for sharing your experiences, it helps to know I'm not the only one dealing with this broken system.

I went through this exact same situation last year and it turned out my claim was flagged for identity verification. Even though I had submitted all the required documents when I first filed, the system somehow didn't process them correctly. What finally worked for me was sending a secure message through the my.ny.gov portal with copies of my ID, Social Security card, and proof of employment attached. Make sure to reference your confirmation number in the subject line. It took about 10 days after sending that message for my claim to get approved, and then I received all the back payments. Also, if you haven't already, double-check that your banking information is correct in your profile - sometimes payments get delayed because of incorrect routing numbers.

This is really helpful Ana, thank you! I haven't tried sending a secure message yet - I've been so focused on trying to call that I didn't think about using the messaging system. I'm going to check my banking info right now and then send a message with all my documents attached. Did you get any kind of confirmation that they received your message, or did you just have to wait and see? Also wondering if there's a specific department or subject line format that works better for getting attention.
