NYS Department of Labor unemployment is taking too long - what can I do to speed this up?

Filed my unemployment claim 6 weeks ago and it's still showing pending in my account. I've been doing the weekly certifications but haven't received a single payment yet. The automated phone system just says my claim is being reviewed and there's no timeline given. I tried calling multiple times but either get disconnected or told the wait time is over 2 hours. My rent is due next week and I'm starting to panic. Has anyone dealt with this kind of delay? What can I actually do to get someone's attention at NYS Department of Labor?

This is unfortunately becoming more common lately. Six weeks is definitely too long for a standard claim. First, check if there are any pending issues in your my.ny.gov account under the 'Correspondence' section - sometimes there are requests for additional documentation that people miss. If there's nothing there, your claim might be stuck in adjudication which means they're reviewing some aspect of your eligibility. Keep filing your weekly claims even while it's pending or you could lose benefits for those weeks.

I checked correspondence and there's nothing there. It just says 'claim under review' with no other details. Should I keep trying to call or is there another way to contact them?

Try calling right at 8am when the phone lines open - that's your best shot at getting through. Also make sure you're calling the right number for claim inquiries, not the general NYS Department of Labor number. If your claim has been pending this long without any correspondence, there might be an issue with your separation reason or wage verification that's holding things up.

I've been calling at 8am every day for two weeks and still can't get through! The system just hangs up on me after an hour on hold.

I had a similar situation last year and ended up using a service called Claimyr that helped me get through to an actual NYS Department of Labor agent. You basically give them your info and they call for you until they reach someone, then conference you in. Found them at claimyr.com and they have a video demo at https://youtu.be/qyftW-mnTNI showing how it works. Took about 3 days but I finally got to speak with someone who could see what was holding up my claim. Turned out there was a wage discrepancy they needed me to clarify.

That sounds too good to be true... how much does something like that cost? I'm already broke waiting for benefits.

It's worth checking out their site for details. For me it was totally worth it since I was losing weeks of benefits just sitting there waiting. The peace of mind alone was huge.

Six weeks is INSANE. I swear the NYS Department of Labor just hopes people will give up and stop filing. They're probably understaffed and just letting claims pile up. Have you tried contacting your state representative? Sometimes political pressure helps move things along faster than going through normal channels.

Yeah the whole system is a mess. I know someone who waited 10 weeks last year before getting approved.

Make sure you're documenting everything - dates you called, times you were on hold, any reference numbers they give you. If this drags on much longer you might need to file an appeal or complaint. Also double-check that your direct deposit info is correct in your account, sometimes payments get delayed because of banking issues even after the claim is approved.

I went through this exact same situation last month - 7 weeks of pending status with no communication. What finally worked for me was filing a complaint through the NYS Department of Labor's online complaint form on their website. You have to dig around to find it, but there's a section for "delayed benefit payments" under their complaint system. I also sent a message through the secure messaging in my ny.gov account explaining my situation and the financial hardship it was causing. Within 48 hours of doing both, I got a call from a caseworker who resolved the issue - turns out there was a simple coding error that had my claim stuck in limbo. Don't give up filing your weekly certifications though, you'll get backpay for all those weeks once it's resolved.

This is really helpful! I didn't know there was an online complaint form - I'll definitely try that. How long did it take you to find the complaint section on their website? And when you filed the complaint, did you need to provide specific documentation or was describing the situation enough?

@Mateo Perez - I'm dealing with something similar right now (week 5 of pending status). One thing that helped me get more information was creating an account on the NY.gov website and checking the "Message Center" section - sometimes there are automated messages there that don't show up in the regular correspondence section. Also, if you haven't already, try calling the technical support line instead of the claims line - they can sometimes see different information about what's causing the delay. The number is different from the main unemployment line and usually has shorter wait times. For the immediate financial pressure, check if you qualify for emergency assistance programs through your county's social services department - some have funds specifically for people waiting on unemployment benefits. Keep hanging in there, most people do eventually get through the system and receive all their back payments.

@Olivia Garcia This is really good advice about the Message Center - I didn t'know there was a difference between that and the correspondence section. Do you happen to know what the technical support line number is? I ve'only been calling the main claims number and getting nowhere. Also curious about the county emergency assistance - is that something you apply for online or do you have to go in person? Thanks for mentioning the back payments too, that gives me some hope that all these weeks won t'just be lost.
