NYS Department of Labor adjudication - what is the main cause of unemployment denials?
Been waiting 6 weeks for my unemployment claim to get through adjudication and I'm starting to panic. My case worker mentioned something about them reviewing 'separation circumstances' but didn't give me details. I was laid off when my company downsized their marketing department in December - seemed pretty straightforward to me. Now I'm wondering what is the main cause of unemployment claim denials? Should I be worried they're going to find some reason to disqualify me? I reported everything honestly on my initial application but this waiting is killing me financially.

The main causes of NYS Department of Labor denials usually fall into a few categories: voluntary quit without good cause, termination for misconduct, not meeting work search requirements, or issues with your base period wages. Since you were laid off due to downsizing, that should qualify you for benefits. The adjudication process just means they're verifying the details with your former employer. Most legitimate layoffs get approved once the investigation is complete.

•That's reassuring to hear. My former employer said they'd cooperate with any NYS Department of Labor inquiries. I'm just stressed because I've never filed for unemployment before and don't know what's normal.

ugh the waiting is the worst part! mine took 8 weeks last year when i got laid off from my restaurant job. they kept saying they were waiting for employer response but eventually it got approved retroactively so i got all the back pay

•Eight weeks?! I don't know if I can wait that long. Did you do anything to speed it up or just had to wait it out?

If you're having trouble reaching NYS Department of Labor by phone to check on your adjudication status, I recently discovered this service called Claimyr that helped me get through to an actual agent. You can check it out at claimyr.com - they have a video demo at https://youtu.be/qyftW-mnTNI that shows how it works. It was way better than spending hours on hold or getting disconnected. They helped me resolve an issue with my job search log that was holding up my weekly claims.

•How much does something like that cost though? I'm already strapped for cash waiting for my benefits to kick in.

•It's worth checking out their site for details, but for me it was definitely worth it to get my claim moving again instead of being stuck in limbo for weeks longer.

The whole adjudication system is a joke honestly. They make you wait forever just to verify obvious stuff. Like if your employer reports you were laid off, why does it take 2 months to confirm that?? It's just another way for NYS Department of Labor to delay paying out benefits and save money.

•I understand the frustration, but the adjudication process does serve a purpose. They need to verify information to prevent fraud and ensure benefits go to eligible claimants. The delays are usually due to high volume and limited staff, not intentional stalling.

same boat here! been in adjudication for 4 weeks after getting fired. well not fired exactly but they said i violated company policy by being late too many times. im worried thats going to count as misconduct even though i had a good reason (car troubles). anyone know if transportation issues count as good cause?

•Transportation difficulties can potentially be considered good cause, but it depends on the specific circumstances and whether you made efforts to resolve the issue or notify your employer. You might want to gather documentation about your car problems and any communication with your employer about the attendance issues.
