NY unemployment denied me after waiting 3 months - now facing eviction with family

Just got the dreaded determination letter from unemployment after waiting for almost 3 months. They're saying I'm not eligible for benefits. No explanation, just a flat denial. I've been counting on this money since I lost my job in February when our company downsized. Rent is already 45 days past due, and my landlord won't wait any longer. My wife, our 5-year-old daughter and I are probably going to have to look into family shelters next week if something doesn't change. I've been applying everywhere but the job market is terrible right now. Called the unemployment office over 20 times and never got through to anyone who could help. What are my options? Can I appeal this? Anyone else been through this nightmare?

Definitely appeal!!!! You have 30 days from the date on the determination letter. Don't wait - do it right away and make copies of EVERYTHING you submit. Sometimes they deny people for stupid reasons and an appeal fixes it. I got denied for "voluntarily quitting" when I was actually laid off, appealed with proof and won.

My appeal took about 6 weeks. Not fast, but faster than the initial claim. In the meantime, call 211 for emergency rent assistance. Some counties have programs for exactly your situation.

Same thing happnd to me last year. Appeal it ASAP. Dont throw away the letter. Do it online. Also contact your state senator/assembly person - they can sometimes intervene. Worth a shot.

Have you checked eligibility requirements? There are a bunch of reasons they can deny you: - Not enough work history in your base period - Fired for misconduct - Not available for work - Not enough income in previous quarters - Didn't register for work search Knowing exactly why they denied you is key to a successful appeal. You can call and ask for specifics - but good luck getting through. I had to call 72 times before connecting to someone who could actually explain my issue.

The letter just says "not eligible based on information provided" - super vague. I worked full-time for 3 years before being laid off and have been documenting all my job searches.

That's weird. Sounds like they might have messed up. Could be they think you quit or something. Definitely appeal and clearly state you were laid off due to downsizing. Include any layoff documentation from your employer if you have it.

The ny unemployment system is TRASH 🗑️ I've been fighting with them since January. You absolutely need to talk to a live agent but GOOD LUCK with that. I spent HOURS on hold every day for weeks!!! Try calling right when they open at 8am, sometimes that works.

Try 7:55am and be ready to dial. I got through that way after days of trying. Also try the call back feature if they offer it to you.

Apply for SNAP benefits if you haven't already 3. Call 211 to find local charities and orgs that provide rental assistance 4. Check with local churches - many have emergency funds 5. Contact local tenant advocacy groups who might help with your landlord Whatever you do, DON'T wait until you're actually evicted to start looking for help. The system is broken, but there are resources. I went through similar hell last summer and eventually got everything sorted, but only because I was aggressive about finding help. Also, you absolutely need to talk to a live person at unemployment. Regular calling rarely works - I finally got through using claimyr.com after weeks of trying. It's a service that gets you connected to an agent without the hours on hold. The agent I spoke with immediately saw the error in my file and fixed it. Worth every penny since I got thousands in back benefits.

OP: immediately contact your state assembly person and senator. do not delay. I know this sounds weird but their office has special contacts at unemployment. My cousin works for a state rep and helped multiple people fix unemployment issues that were "impossible" to fix through normal channels 👀

Not to be that guy but check if ur application had errors. I got denied bcuz I accidentally put the wrong last day of work (was off by ONE day) and they used that as reason to deny me. Had to appeal and wait another 7 weeks 🤦‍♂️

Look into whether you qualify for the ERAP program (Emergency Rental Assistance) - it can cover up to 12 months of back rent and 3 months future rent in some cases. Saved my family when we were in a similar situation with unemployment.

call your LANDLORD immediately!!! don't just disappear. most landlords would rather work something out than have you go to a shelter. my landlord let me do a payment plan when I was 2 months behind.

Ask if they'd accept partial payment for now while you sort things out. Also, in NY there are some strong eviction protections - they can't just kick you out without going through the courts. That process takes time.

Does the letter give ANY reason at all? Even a code or section number? Look that up online. Sometimes its something simple you can fix by uploading a document or making a phone call to clarify something.

That section is about insufficient work history/wages in your base period. Did you work all 4 quarters before applying? If you started your job less than 18 months ago, that could be the issue.

This is why I hate the ny unemployment system so much. They deny people for no reason hoping they wont appeal, and make it IMPOSSIBLE to talk to anyone. It's cruel and designed to prevent people from getting benefits they deserve. 😡
