NY unemployment benefits stolen - KeyBank card used at old address

I desperately need advice on a serious NY unemployment fraud situation. Back when I was laid off in July 2024, I filed for unemployment. Here's the problem - I STILL haven't received the KeyBank card that's supposed to have my benefits on it for all the weeks I've certified so far. After weeks of trying, I finally got through to KeyBank yesterday and they dropped a bombshell: they mailed the card to my old address last November (I moved in August) and someone has been using it all over the place! I've already done two things: 1) reported the fraud to KeyBank, and 2) filed a police report about the identity theft. But now I'm completely stuck because I CAN'T get through to anyone at NY unemployment - the phone system just disconnects me every single time. Is there another department or number I should be calling to report this? I've been waiting over 4 months for my benefits and someone else has been spending MY money! What specific steps do I need to take to get my stolen benefits replaced?

I went through something very similar last year. It's absolutely critical that you do the following: 1. Document EVERYTHING - dates you called KeyBank, case number from your police report, and all attempted contacts with NYSDOL 2. Submit a secure message through your NY.gov account - go to your unemployment dashboard, click on "Messages" and specifically state this is regarding BENEFIT FRAUD/IDENTITY THEFT 3. Contact the NYSDOL Fraud Investigation Unit directly at 888-598-2077 (this is separate from the regular unemployment line) 4. File Form TC-1 (Stolen Benefits Claim) - you can download it from the NYSDOL website under "Forms" The regular unemployment lines are completely overwhelmed right now due to the seasonal layoffs, but the fraud department should respond within 7-10 business days. They'll freeze the compromised account and start an investigation.

OMG this EXACT thing happened to me!!! The whole KeyBank system is a JOKE. I spent MONTHS trying to get my money back after someone stole my card. The DOL doesn't care AT ALL and just keeps telling you to call KeyBank, then KeyBank tells you to call DOL. It's a complete scam if you ask me. I filed all the reports back in May 2025 and I'm STILL fighting with them! Good luck getting through to anyone who actually helps.

FINALLY got it back after 4 months of calling EVERY SINGLE DAY. Had to threaten legal action before they took it seriously. Make sure you don't have mail forwarding set up with USPS because apparently that causes problems with the KeyBank cards specifically (no one tells you this).

I've used Claimyr twice when I couldn't get through. It's legit - they just find a way to get you into the phone queue faster. I waited 3 weeks trying to call myself, then got through same day with them. Worth it for something urgent like stolen benefits.

I DID update my address with NY unemployment when I moved! That's what's so frustrating - I updated it in the system in August, but KeyBank said they sent the card in November to my old address anyway. Successfully used Claimyr to reach an agent who put a hold on the compromised account The agent I spoke with said this happens more often than people realize. They're sending me a new KeyBank card to my CURRENT address and started the fraud investigation. They said I should expect to wait about 30-45 days for the investigation, but at least new benefits will be protected. I'll update again when I know more!

Excellent progress! Make sure you keep certifying for benefits each week even while this is being resolved. The system will hold those payments until your new payment method is established, but if you miss certifying, you can't get those weeks retroactively. Glad you're getting it sorted out!
