NY unemployment backpay delayed after filing new claim when BYE date expired
I finally got my first unemployment payment after waiting 6 weeks, but now I'm having issues with my backpay. I was told my backpay should arrive by this week, but I just had to file a new claim because my Benefit Year End (BYE) date was up. I've been trying to call NYSDOL all morning - I even tried going through the governor's office to get answers! No luck reaching anyone. Now I'm worried this new claim will cause more problems. Do I have to wait for DocuSign forms for my new claim before they release my backpay? Will they automatically release the money I'm owed from before? Will my new claim delay my backpay even longer? I'm seriously stressed about this!

•3 more weeks?! I can't afford to wait that long. Did you have to keep certifying for the old weeks or just the new ones?

Unfortunately filing a new claim almost always delays any pending payments. When your BYE date expires, the system basically puts everything on hold while they process your new claim. To answer your questions: 1. You'll likely receive DocuSign forms for your new claim that need to be completed before ANY payments (including backpay) are released. 2. They won't automatically release the money - your backpay is tied to the verification of your new claim. 3. Yes, your new claim will delay your backpay until the new claim is fully processed and approved. Keep certifying weekly while you wait. The good news is that once they approve the new claim, they typically release all backpay at once.

•This is exactly what I was afraid of. I have bills that were counting on that backpay! Do you know if there's any way to escalate this or get someone on the phone who can help?

I had this EXACT problem last month!!! The system is SO BROKEN! I filed a new claim after my BYE date and then all my pending payments just sat there for weeks! I called literally 50+ times and couldn't get through to anyone. The only thing that finally worked was using Claimyr to get through to an agent. I was skeptical at first but my friend used it and said it worked. Basically they wait on hold for you and then call you when they have an agent. I got through in about 45 minutes and the agent was able to release my backpay that same day! Check it out at claimyr.com - they have a video showing how it works: https://youtu.be/Rdqa1gKtxuE

•Thank you!! I'm going to try this right now. I've been calling all day with no luck. Did they ask for any verification when you finally got through?

•@OP - Yes, have your claim ID and SSN ready when they connect you. The agent will verify your identity and can see both your old claim and new claim in their system. @skeptical - It definitely worked for me. My friend used it first and recommended it. They just automate the calling process and connect you when there's an agent. It saved me days of frustration.

Let me clarify some confusion here. When your BYE date expires and you file a new claim, the system will indeed put a temporary hold on payments while they determine your new eligibility. However, there are some important facts to understand: 1. DocuSign forms: Yes, you'll likely receive these and they must be completed promptly. 2. Backpay processing: Once your new claim is approved, any eligible backpay from your previous benefit year should be processed automatically. The key word is 'eligible' - make sure all those weeks were properly certified. 3. Timeline: NYSDOL is currently taking 2-4 weeks to process new claims in 2025, but this can vary. 4. Verification: They may request additional identity verification documents, which could further delay processing. The most effective solution is speaking directly with an agent who can manually review both claims in the system. If calling hasn't worked, try contacting your state assembly member's office - they often have direct channels to unemployment assistance.

•Thank you for the detailed explanation. I did certify for all those weeks properly, so hopefully they'll be processed once the new claim is approved. I'm going to try the calling service mentioned above, but will also reach out to my assembly member as a backup plan.

im so confused abt this whole process!! when my BYE date expired in december I filed a new claim and then like a week later they sent me an email saying I didn't need to file a new claim after all?? and they just continued my old claim somehow? maybe they changed the rules since then but it was super weird. did u actually need to file a new claim or did someone tell u to do that?

•This happens sometimes and depends on your specific situation. If you're still within the same base period and have the same qualifying wages, NYSDOL might extend your claim rather than require a completely new one. It sounds like their system initially prompted you to file new, but then their review determined an extension was appropriate. Each case is unique based on employment history.

Listen, I've been dealing with NY unemployment for years (unfortunately) and I can tell you that the WORST thing you can do is just sit and wait. The second you filed that new claim, your backpay got stuck in bureaucratic limbo. Your file probably got flagged for manual review, which means it's sitting in someone's digital queue. Calling is absolutely essential in these situations, but as you've discovered, it's nearly impossible to get through. I second what someone else said about using Claimyr - I've used it twice when I was desperate. Once you get an agent on the phone, specifically ask them to "release the pending payments from your previous benefit year." Use those exact words. Also, document EVERYTHING. Note the date/time of calls, agent names, and what they tell you. This documentation can be crucial if you need to escalate further.

•Thank you for this advice! I just tried Claimyr and got through to an agent after about an hour. You were right - they said my backpay was stuck in manual review because of the new claim. The agent was able to release 4 weeks of my backpay right away, and said the remaining weeks should process within 3-5 business days once they finish reviewing my new claim. Such a relief!

when i had a simular issue last year i found out that sometimes they hold backpay if theres any discrepancy between ur old claim and new claim like if u reported different employers or something they might be investigating. did u have the same employer the whole time?

I'm glad you got through! Make sure you keep certifying every week while waiting for the remaining payments. And if the rest doesn't show up in 5 business days like they promised, don't hesitate to call again. I've learned that with NY unemployment, you sometimes have to be really persistent.

my cousin works for the state (not unemployment but another agency) and she says they're implementing a new computer system this year that's causing all kinds of delays with payments. might be part of why this is happening to so many people lately.

I want to add something important for anyone else reading this thread with similar issues: If you're approaching your BYE date but still have a balance remaining, you should continue certifying without interruption. The system will prompt you if a new claim is needed. For those who do need to file a new claim after BYE expiration, here's what typically happens in NY as of 2025: 1. File the new claim immediately after BYE date expires 2. Continue certifying weekly without interruption 3. Complete any DocuSign forms within 48 hours of receiving them 4. If no payment after 2 weeks, contact NYSDOL directly The current NYSDOL guidelines state that backpay should be released within 2 weeks of new claim approval, but as we've seen in this thread, it often requires direct intervention by an agent.

Quick update for anyone with similar issues: I received the remaining backpay this morning! All 9 weeks hit my account at once. The key really was getting someone on the phone who could manually review my claim and release the payments. Thanks everyone for your help and suggestions. This community has been a lifesaver!

•Great news! Make sure you set aside money for taxes. NY unemployment doesn't automatically withhold taxes, and that backpay could put you in a higher tax bracket for 2025.

•Thanks for the reminder! I did opt for tax withholding when I first applied, but I'll double-check my payment statements to make sure they're actually taking taxes out.
